For example the 21 one year old drinking age is a "touch good" measure that be enacted to "protect the children", but hasn't be really effective within my opinion. What recourse does one have when a provider fail to submit a claim to an HMO and the filing time have expired?

HMO tell me no claim on file. Provider trying to bill me after 19 mos. Stmt tell me bill is current. I would think after a year and a partly, I would be in collections. I estimate this was overlooked by them and in a minute they are tring to recoup their losses.
