Law Questions and Answers
Is it worth to hiring a lawyer for the nouns case?
I am 20, and be caught shoplifting for 150 dollars of merchandises. I have a clean text until that, and I live in Georgia. Can I win a lawyer to yak to the district attorney maybe to drop the charge? Or bring back a w/e minimum outcome? Please, I need assist. How much will it cost to hire a decent advocate to work on my case and shift to the court with me?Answers: Shoplifting, while a minor offense, is considered a crime of "moral turpitude" and could impair your flair to get a errand in the adjectives. This business of labeling crimes such as theft as crimes of "moral turpitude" is significant. In contrast, drug possession, potentially much more serious is not "moral turpitude." You could judge of "moral turpitude" as a crime involving basic dishonesty, recurrently economic. If you hire an attorney, you might be capable of get this reduced to a lower offense rather like lightning. Most prosecutors are very busy and if you enjoy either compensated for the mechandise or returned it, you might also be able to find a deferred sentence and keep this stale your record entirely. Your state may enjoy another term for "deferred sentence", but it mechanism the offense never gets reported if you do not own any other arrests for 6 months (in my state). Despite the cost, an attorney could avoid having this charge ever appear. Also, although 20 is thoroughly young, most relations who have criminal offenses approaching misdeamnors have deeply of priors, but you don't. You're a good contender for easy treatment by the court and the prosecutor. I hold done these type of prosecutions, and based on what you've said here I'd be jovial to make a treaty with you through your attorney. Finally, hiring an attorney is an indication you lift this seriously and the prosecutor will offer a better do business to your lawyer than directly to you. That's not necessarily "right" but to be precise the way it works.
They can charge $200 per hour.
Get a attorney but try to do most of the work yourself. Get yourself into therapy and find out why the urge is near. Then convince the judge that this be a random exploit that you now hold under control through analysis.
You need to get the drift why the urge is there, from childhood problems, and how you can rid yourself of this urge.
No consumer stock is worth your self esteem and reputation. I think you know this in a minute. You can find a way out of this.
Good luck!
As others said since it is your first offense the consequences will be minimal.
But here's the problem. You are simply 20 so who knows what you will do surrounded by life. Who know what sort of career you might find yourself within later. You might get hold of promoted into management, start your own business or doesn`t matter what. One never really knows. If you are convicted later this charge could cause problems beside background checks for a enormously, very long time. Or you may desire to one day travel to school and want to go and get government grant.
So in the long run have a lawyer is the approach to go as it could cost you far more next. Depending on the circumstances a lawyer might know how to cast some doubt on the charge itself, even if you be caught redhanded. He might even be able to give the name the company and convince them that not just dropping the adjectives thing would be more trouble than it's worth.
If to be precise not the case later a lawyer could conceivably do more. Maybe have the charge dropped within exchange for community service, some classes, or whatnot.
It's money well spent, no business what it takes to attain it. If you have to trade something... so be it. If it is a not telling the parents entry... you parents might be mad for a while but the primary hope is to safeguard your future. I give an account my kids.look if you get surrounded by trouble sure I will be ticked and you will be embarassed.. and yes you will deserve what coming to you. BUT family is ancestral so tell me so I can relief before they try to do it on their own. I would a bit know before they capture a raw settlement or endanger their future.
Cost? Who know as you will enjoy to shop around. I could be wrong but for something this simple maybe $1000 is a well-mannered round number. There are a million sites for lawyers that manipulate DWIs so I imagine that within are some that specialize in nouns and such.
Don't bother with a legal representative, too much money, besides they won't be able to do much for you.
I don't be set to to preach but.. come on man, your 20 knock it off - sheesh
Good luck bud
What do I do when I'm a subcontractor and my boss won't pay me?
I be told after completing all of my work successfully that the owner of the subcontractor company have to hold on to my money for 60 days to make sure adjectives my work cleared. It has very soon been 85 days and he refuse to pay me. He is surrounded by another state and the labor board cant do anything. What are my options? He have done this to 5 or more people. Can we folder a class action suit against him or his company?Answers: The time frame for a lien may enjoy already passed, depending on if the work was residential or commercial, and the state the work be done in. I would without beating about the bush contact an attorney and see if there is time to place a lien. If not, I would contact the owner of the property and the prime contractor on the project, they may be capable of help you as all right.
You CAN sue him - but the easiest solution, if he's out of State, is to put a workmans lien on the property on which you did the work.
That will get the property owner onto the prime contractors butt immediate time.
Richard
You have to receive certified by the courts to have a class bustle lawsuit, but if you have the right attorney, that shouldnt be a problem. It will lift time and money, but you can find an atty who will take that on contingency; i.e., wont procure paid till the completion.
Are you SURE the labor board cant do anything about it? They are a federal group, not a state group, and you should be capable of call their office in Washington DC and ask them what to do subsequent.
Aside from that, you can file a complaint contained by the state in which your boss is licensed and possible even appropriate out a lien on his license until he pays you.
GET HIM with the decree. There is a way to do it. Start within his home state and then appointment Washington DC.
From reading the question, it would appear that you are an hand of the subcontractor, but the question read like you are a subcontactor and your boss (who would be the contractor) won't settle up you. These are different prospects and its needs to be clarified.
You can not wallet a class action lawsuit. In establish for it to be a "class", you need at least possible ten people similiarly situation contained by the same situation. Since you own "5 or more" that is not sufficient unless you conquer atleast ten. If you hit ten its possible for them to be certified as a "class", but there is no definite benefit to being a class surrounded by this case. You are adjectives better off a moment ago retaining one attorney rather than file a class action.
Even if the subcontractor is within another state, he needs to be licensed within the state that the job be done in, otherwise the contractor himself can be surrounded by trouble for using an unlicensed subcontractor. Contact the licensing authority surrounded by your state AND in the state where on earth the contactors business is primarily located, explain the siutation, and ask them what they can do. One of the two labor boards should be able to do something.
If you are a subcontactor and its a contractor who won't compensate you, consider a mechanics lien on the property. These are very efficient. You SHOULD have an attorney for this, as the behaviour of perfecting a lien vary from state to state and if not done right can ruin a suit and prevent sentence. If the house hasn't been sold, you'll want to hold the lien placed on the property immediately, this will force the lien to be resolved formerly the property can be transferred. If the property has be transferred or the land be purchased and the house was build for the landowner by the contractor, still consider putting a lien on the property. Some states will allow you to sue the homeowner who contained by turn has to sue the nonspecific contactor to get the money hindmost (Connecticut is like this!).
If you are an member of staff of the subcontactor and you are just looking to be remunerated for your wages, do a couple of things. Call your local courthouse and ask them what the maximium amount is that you can sue for in small claims court. It vary from state to state. If you are looking to recover that amount or smaller number, save the attorneys fees and sue him yourself surrounded by small claims. If its more than that, find an attorney who will sue for breach of contract or other similar cause. Some states even own laws that will allow you to restore your health double or triple damages plus attorneys fees and expenses for breach of contact cases.
Also, if it is a subcontactor who does a lot of work contained by the area or have a "good" reputation, contact the local television station's "investigative communication team". They will send a crew who will investigate, including track this guy down and attempt to bring back his side of the story. Not wanting the bad press, he'll probably settle all of you.
If someone is holding a gun to your head, is it official for your friend to shoot him?
Answers: Yes.
Self defence, OR defense of a third body, are affirmative defences.
Richard
Surely it depends on:
1. If the gun is physical
2. If the gun is loaded
Eliminate all doubt!
yeah, I deem that is covered underneath the self-defense rulings.

I would consult someone from "legal aid" on this thing. They specialize in helping nation who might not be able to afford decriminalized advice. They habitually work "pro bono"..with no expectation of costs.

Reading the Bible is another way of climax depression.
Polygamy practice by Wipro Employee?
This is concerning a issue in India.Does anyone know how a IT company similar to Wipro may handle a polygamy skin practised by its employee.
I have it in mind it is known that multi national companies provide medical benefits to an employee's spouse and children. How would they switch a situation where at hand are 2 spouses and their children? . Do they allow the employee to select medical benefit for both spouses or one with the sole purpose ?
because being a muslim the member of staff can have 4 justifiably married wives as per the legal system. Being officially married all 4 wives hold right to get medical benefits from the company ??
Answers: Depends ENTIRELY on the decree of your country.
If your country recognizes polygamous marriage, then employer may offer medical benefits to multiple spouses. If the country where on earth you live does not recognize them, consequently they won't - even if you were married contained by a country where it be legal.
For example, if you be married in Saudi Arabia, but afterwards moved to the US, all marriage except the first would be null and void surrounded by the US, and the 2nd / 3rd / 4th wives would have no endorsed status as "wives" here at all.
Richard
Depends on the country you be married in. Currently it is not legitimate in the US to own more then one wife. If you are here working as a US Citizen you will one and only lawfully be capable of claim one wife. If you are working outside of this country and where hired by the company outside of the US, on lands not owned nor controlled by US Law afterwards you may have a defence.
It is also up to the company itself. If they are a multi-cultural corporation who hires people near the understand that they would bring international customs and law to the corporation then it would be surrounded by their best interest to insure all of your officially married wives.
If you are asking in a strictly American business or by American current regulation you would only know how to claim one spouse.
I would think that single applies is a predominantly Muslim country. But, based on your previous put somebody through the mill, you don't need to verbs about benefits, but a process out of a horrible marriage. Best of luck to you.
"Above the influence" commercials?
Has anyone noticed that the "above the influence" commercials are truly referring to the consequences of alcohol instead of marijuana? You know, like "Oh I can't believe they took that picture, I must've be 'high'!" Or "Oh God, I ran that little girl over because I be so 'high'!" Do people really infer that marijuana breaks down your judgement and motor skills or is this just senate propaganda at work?Answers: THC does alter your perceptions and inhibitions; it also effects your motor skills.
There is plenty of research on the topic.
When I saw the commercials for the first time, especially the one beside the girl who had a crazy Saturday darkness, I first thought the ads be referring to alcohol abuse. While I do believe that marijuana impair your judgement and someone under the influence of marijuana should not operate a vehicle, the concept that someone would just lose adjectives of their inhibitions because they were glorious is ludicrous. At least anecdotally, culture who are drunk are more impaired, mentally and physically, than folks who are stoned. The only regret I've hear people express after smoking is that they shouldn't own eaten that third slice of pizza - never I shouldn't hold taken off adjectives of my clothes and let someone thieve a picture of me.
The government is wasting so much money on these ad because of their firm belief that marijuana is a gateway drug. There is some evidence to support it, but not so much evidence that it should abandon its hard work in trying to prevent teenagers from using harder drugs, close to cocaine and meth, which can become addictive after one use. What a waste of my taxpayer money.
Getting in fight then going away?
If I am in my sports car and someone walks out to me from a building and threatens me, is it ok for me to quarrel them there and later. I know it may not be a good thought, but whats done is done. So, what is the consequence if I get within my car after I hit him a few times and drive away. I will doubtfully see them ever again. Yes they probably reported my plates, no i did not know this soul. Can i just deny everything. Yes near were witnesses but doubtfull they saw much.Answers: If you be not in the wrong, consequently there can be no damage in person honest.
If you lie, you sort yourself look guilty...the odds are that SOMEONE near will be able to identify you.
Bubba is waiting for you..

Why do cops handcuff everyone? Is it legitimate?
So I was sitting at home in the future about two weeks ago. It be about 5:30 after conservatory on a Friday. I was grounded, so I didn't stir to the mall next to my friends. And since I wasn't going anywhere, I felt too stagnant to change out of my academy uniform.Someone then knock on my door. It's a cop. He says one of my friends have been caught nouns, and since I was her closest friend, they needed to ask me questions in the region of her background. Of course I agree (you can't articulate no to a cop). So he takes out his chains, tells me to turn around, cuffs me down my back super tight, and sits me down on my couch. He consequently asks for my mom's phone number and he calls her to catch verbal consent nearly questioning a minor ultimately involved in a crime. She agrees.
I asked why I'm cuffed if my friend be the criminal. He said that "it's procedure." I kindly ask if he can free me for a sec to obtain a coat, but he refuses as that's a "sanctuary issue."
So he locks the house for me, and leads me surrounded by my school uniform in need a coat in December beside my hands down my back to his saloon.
We get here and he leaves me in his saloon handcuffed for 30 minutes. Finally he take me out and I ask "I'm I being arrested? If not, consequently why am I in shackles?" Again he said, you're not under arrest, I'm purely following procedure.
So he leads me through the station into a bleak room. He sits me in a bench (still cuffed) and cuffs my leg to the desk. Then a new cop walk in and asks me question about my friend.
After roughly an hour, he tells me I'm done. So I assume the cop will drive me rear legs to my house.
Wrong.
I'm lead to 5' x 5' holding cell (still within my handcuffs). My parents would have to come win me. About two hours later, they show up. They be still mad at me for disappearing while being grounded (did I own a choice?)
So they wouldn't talk to me and sent me to my room.
So why do cops chain everyone?
And is this legal?
Answers: my goodness--what state do you live contained by?
Anyway, you should never open the door for strangers when your parents aren't home--even if the folks outside are in uniform. Tell them through the door that you aren't allowed to open the door. They will probably say-so that you have to because they are the police, but unless they hold a warrant for your arrest, a search warrant, fine suspicion (like you have drugs or something surrounded by your house), or your permission, they are barred in. You own rights too, even though you are a minor. You don't have to be intimidated by adults surrounded by uniforms. You can other shout through the door that you won't come out until they send a womanly officer. You are allowed to be respectful & still protect yourself.
You put yourself into a dangerous circumstance by mortal a young womanly, alone--and allowing your self to be placed in a compromising situation. Lots of ancestors impersonate police officers to hold advantage of women. Even if though they be legitimate officer, unless you knew them individually, you can never be too careful. Please use more tip off in the adjectives. If your family isn't home, please be extremely reticent of anyone trying to get into your house (especially if they denote to handcuff you)!
This story sounds resembling a joke...
first of adjectives...minors shouldn't let anyone within the house.
what if he were a rapist dressed approaching a cop?
You have nice parents who can't find there any sooner than two hours.
I don't believe the cops would press you in this manor.
what did your friends steal?
Most of your answer sounds fiddle but I'll answer what I think you want to know..
Cops do infact chain people for their own safekeeping. (the person individual cuffed and the cop). If you are in cuffs, you can not struggle effectively and they won't hold to restrain you further. see, no one get hurt that way.
As for your story.. No cop would ever bring "permission" verbally over a phone to press a minor.
Nor would a cop EVER question a minor contained by any "official" capacity minus a parent present. Any "background" info on your friend would be done at another time when one or both parents could be present either at your house or, the cops would ask you to come downtown, but within either casing certainly beside a parent.
wow thats frekin awsome!! seriously i would want to get into that form of drama some day! wow!!... thats adjectives i can say i parsimonious, there frekin *** holes for doing that. i doubt they enjoy a right to be doing sh!t like that. wow. im starring this seriously...wow
im surrounded by shock
Yeahhhh, right.
Wanna buy a bridge in New York City? I've get one for sale
or
I've get some nice ocean front property contained by Florida for sale - unadulterated cheap
You speak very angelic English for someone who lives in Iraq!!!
You do not HAVE to consult to cops especially without a responsible grown actually next to you in any civilised portion of the world - you can say no!!
if this is true...consequently thats some bullcrap right there.
if someone is NOT underneath arrest.cops DON'T have the right to shackle them (unless their life is surrounded by danger or something approaching that)
as for the questioning...if you be techionally under arrest you could own left any time you considered necessary and NOT gotten into trouble...
off topic: didn't you enjoy another question somewhat similar to this, but!... you went to the shopping precinct with your friend.
sounds pretty virtual to me.
You asked a question yesterday just about being handcuff at the mall and how you be innocent and didnt even know the person involved. Now you are proverb that you are grounded and got handcuff again at your home. Something sounds fishy here.
Too bad for you that I enjoy an excellent memory.
I don't like Universal Health Care for uncaring reasons, what's your excuse ?
As a retired veteran I income $12 per office pop in $3 per perscription and $25 a day for hospitilization...and I don't see why you general public who haven't served deserve the same entity. Govt. HC is good, it works better than any other variety, but I DO deserve SOMETHING extra, don't I ?Answers: I support affordable healthcare, not universal parliament funded healthcare. As a veteran who has be to a VA hospital, I wouldn't wish that type of poor service on anybody.
I picture government funded healthcare as a cross between a trip to VA hospital and a trip to the DMV. Scew that, I'm greatful my brief has a great benefits collection.
We already have common health fastidiousness, and we don't need more. I'm on the Army's form care system. I haven't see an Army dentist in over two years. I guess that's what society want.
What the commoners don't realize is that the people peddle "universal" health attention to detail actually denote it as separate health meticulousness from theirs, not the same generous of treatment that the royalty get.
I don't estimate that the Health Care system in the U.S. is desperate, I think it is top within the World.
The real problem is the Health Care Insurance industry. That requirements a real overhaul. They enjoy gain too much power over the Health Care system and telling doctors what to do.
Health meticulousness 'provided' with the helpfulness of the Post Office and the loving kindness of the IRS.
'nuff said.
Veterans DO deserve something. However, you are VERY much misinformed just about the VA. The VA is given a budget each year. It "technique tests" everyone who is ELIGIBLE to see IF and I mean IF they will be ALLOWED to access VA services. If so, which ones and for what cost. There are plenty of nation who have served who do NOT acquire the access or care you do at adjectives or for what you are paying, so NO, government form care is NOT the best run diligence there is.
My father is a WWII vet and HIS co-pays are difficult than yours. I happen to be QUITE decipherable with the VA as are the tens of thousands who served and can't obtain served in return.
A better example of administration run health concern is Medicare. Premiums 1998: $43.80, 2008 $96.40--up 120% yet benefits are not up that rate. ALSO for those on Medicare HMOs they saw their prescription drug benefits DECREASE to conform to the BOGUS "donut hole" the feds come up with. The HMOs are also making more of the things they used to cover for $100 or smaller quantity in a co-pay cost the long-suffering the entire 20% co-pay. Doctors are leaving Medicare because:
it's low settle up
it's slow pay
when they try to harmonize the budget they do so at the doctor's expense--literally, reducing what they will pay HIM.
