Answers: Sure, Rape is rape whether you assault a man or a woman.
Yes

A woman can rape a man as okay.
Yes. However the term rape contained by legal/court world is defined with it human being male and feminine.

Most male rape another manly cases are tried as sexual assault- easier to prosecute because of the actual legal written occupancy and specifics. Most male-female rapes that the defendant pleas out of gets the sexual assault charge. Sexual assault is more of a general ranging charge that isn't so cut and dry, locking up more of those who you know did something, but don't hold the exact, necessary evidence to acquire a rape conviction with.
yes

Does anyone else think its ironic that the merely reason those never wants to progress to jail is...?

Anyone think its weird that the object everyone doesnt want to go to incarcerate is because of activities that should be unjust and controled in put inside. Like rape from jail mate. I never heard the referee say surrounded by order for them to money for there crimes they can be raped and such. Also stabbing and forming of vicious groups should be restricted yet isnt. This is remnant on movies of course, never be to jail but I doubt its much different. Oh well just a thought.
Answers: yes those things do surface... and they are trying to be controlled. i study law. and enjoy seen motion picture after film, and sermon after lecture going on for this. the problem is, if they crack down more and make young offenders` institution a safe comforting place nearby is no fear. Fear of detention centre and ruining your life, is what keep people obey the law. If u needed to kill someone, you dont because u will walk to jail for existence. if u knew young offenders` institution was a 'good' entry, you wouldnt care at adjectives. they are making jails safer, and more controlled. The major problem in jail is overcrowding, which leads to adjectives these such problems and it is trying to be taken care of. some jail have cell meant for 2 citizens that have up to ten population in them by stacking the bunks. its easier for two populace to get along, later 10. hope i helped.
That's not the lone reason I've hear. Usually people don't want to dance to jail because they want to live their lives, not be incarcerated.

Washington state dui?

Obviousely, I do not condone drinking and driving, let me carry that out of the way first. My friend be at a party and be drinking, that's what he remembers...details are sketchy, sorry. He does not remember driving, or if he drove at adjectives, it was possibly a friend. What he remembers very soon, is he woke up from someone saying his truck be wrecked and the police were towing it. He get a ride to the scene and started talking to the officer about what happen, or what the police thought happened a bit. When asked to take a breathalizer, he denied it. The police arrested him for snarl-up, which got dropped, and also for DUI. My examine is, if someone drove him there, and the police could not prove he be driving, is it still lawful to bestow him a DUI? This all happen in the state of Washington.
Answers: The answer is NO here is no "D" in this DUI.

I hold represented over 2500 DUI cases here in CA. Question(s):
Were the vehicle keys contained by his pocket at the time of arrest?

What was the form position, taller or shorter person?

Likely your friend be drunk and wrecked his own truck and now desires to deny it. It happens adjectives the time in this business.

The prosecutor can and will use circumstantial evidence to place your friend trailing the wheel. It will be up to a jury to resolve if he was driving or not. However, hold on to in mind that it is practically impossible to appropriate a DUI driving issue to jury without your friend testify and offering a "reasonable" explanation as to how his truck got at hand and got wrecked.

DUI is not a popular crime and jury don't like drunk drivers. However, the " beyond a fine doubt" standard is very tough. He singular needs one juror to believe him to dangle the jury and avoid prosecution. If he is truly innocent then I would recommend he encounter it.

He needs to find a good attorney who specializes within DUI representation in your state.

Legal Question?

Can somebody explain heresy to me?
Answers: What one person say to the other. He said, she said type thing and doesn't produce complicated evidence against anyone in court.
Heresy is a "theological or religious view or doctrine maintained contained by opposition, or held to be contrary, to the Roman Catholic or Orthodox doctrine of the Christian Church, or, by extension, to that of any church, creed, or religious system, considered as orthodox. By extension, heresy is an assessment or doctrine in philosophy, politics, science, art, etc., at variance next to those generally agreed as authoritative

Basically you believe something that severly goes against your Church doctrine.
If somebody say that they were told something. . . that's hear-say.

It's not typically admissible as evidence contained by court.

If I saw somebody shoot your dog . . . and I told you -- and you sued that person, you wouldn't be allowed to share the judge, "Well, Brian said he saw that guy shoot my dog. . . ."

Instead, you'd enjoy to subpoena me, and I'd have to testify to the reality that the guy shot the dog, and that I personally saw the event.
Hearsay is severely complicated. The definition of hearsay is:
an out of court statement for the truth of the matter asserted. So, in that are two important parts. First, the statement have to be made out of court. (That part is uncomplicated.) Second, the statement has to be for the truth of the business asserted. This second part is vexing to lawyer and law students across the nation. I a moment ago started typing an explanation, but really, it's very difficult recognize - either supposedly or practically - without a considerable amount of instruction.

You should know, however, that some statements that would otherwise appear to be hearsay are admissible as "non-hearsay" or "admissible hearsay."

Perhaps, if you set aside a fact scenario I can explain why a statement plausible would or wouldn't be admissible per the federal rules of evidence.

Where can I find a breakdown of what is illegal and what is not contained by Austria (Drug wise)?

Looking for what can be purchased over the counter at the local drug store, as well as what sort of punishments exist for drugs approaching marijuana and ecstasy.
Answers: The following information is base on the "European Database on Drugs," which you can find at the link, below.

Austria is element of the European Union (EU). EU Member States classify drugs and precursors according to the three UN Conventions of 1961, 1971 and 1988.

The 1961 Convention deals next to narcotic drugs, the 1971 Convention with psychotropic substances. The Conventions classify drugs into four "schedules" contained by accordance with harmfulness. Schedule I contains drugs considered most bad for you and therefore subject to the greatest point of control.

Drugs in Schedule I of the 1961 Convention include cannabis and its derivatives, cocaine, heroin, methadone, morphine and opium. Psychotropic substances surrounded by Schedule I of the 1971 Convention include LSD, MDMA (ecstasy), mescaline, psilocybine and tetrahydrocannabinol.

Don't expect to be able to buy any marijuana or ecstasy contained by a drugstore or any other legal venue within Austria. The Austrian Narcotic Substance Act of 1998 does not link drug penalty to drug type, but I do not know what the penalties are.

# 1 ... This must be an old course book book, because the US Supreme Court ruled that local authorities have the right to appropriate private property for anything they please, and to pay the feeble owners what they think the property is worth. You cannot sue US rule cities, counties, school boards, etc. minus their permission.

# 2 ... Jeff's opinion, everyone has opinion. Juveniles have darn few rights.

# 3 ... People are held adjectives for trees that grow out of their property. However, going to court over this generous of stuff is a way to throw away money, because court costs will be much heavier than any cleaning bill.

# 4 Senator Russell is not in America, because such an belief will not get anyone elected to Congress.

http://www.firstamendmentcenter.org/news...

The first article is a bit old, but the second article is recent.
Do you suggest the gov't should be able to confiscate land to bestow to a private business enterprise (as opposed for building roads, etc). The claim is that it is for "the public good", I think it is lately to make big bucks.
Answers: It sucks not to be a attorney sometimes. People take authority of the law for their own gain.
The supreme court made a HUGE error on the subject of this issue in Kelo v. New London.

The problem is surrounded by the language used. They use to vote "public use" which conjures thoughts of roads, parks, sewage facilities etc. They changed the wording to "public good", or "public purpose", aphorism that they need it for police, fire etc. However, i doubt any of that money ever go to hiring any police of firefighters. It goes wager on into the city's coffers to be spent on entitlement programs.

Eminent Domain is being abused adjectives over this country, Justice Janis Rogers Brown should be on the Supreme Court because of her views on this issue.
The Kelo vs New London outcome sux big time and I will do everything in my power to hold on to that kind of baloney from happening again. I desire some courageous members of the House would present impeachment proceedings against the justices who voted surrounded by favor of it.

I'll be happy to try the impeachment within the Senate.

How much legal trouble can you procure into from a school fray?

Answers: depends on the ages of the people within the fight. If they are both below 18- No big deal...you hold nothing at adjectives to worry in the region of. If one is 18+ and the other is under 18- BIG trouble for the being who is 18+ and nothing at adjectives for the person beneath 18. If BOTH are 18 and over- I would say in attendance is SOME legal trouble, but nil all that big...smaller quantity than 20 hours of community service, and suspended for a couple of days.
arrested and suspended from school.

Use your words to defuse a situation. Self-defense is the ending option.
Unless in that is a serious injury or damage cause as a result, you'll likely in recent times be suspended from school. The police usually aren't going to pilfer the time charging a few school kids over a simple fist clash.

Iowa caucuses?

i am helpful of ignorant contained by politics.. so can you simply explain to me what it is, how it is done, and why is it held in Iowa instead of contained by another state? Thanks in credit!
Answers: It's the primary election. Every state does it. It's a vote - you catch to pick either republican or democrat ballot (only one) and vote for your favorite local, state, and national candidate.

The reason Iowa's is a big treaty is that it is the first one. It has the power to create or break a candidate, because one who does economically in the inauguration with acquire more funding by contributors for advertising, and will be more probable to win at the end.

It shows which candiates are strongest, and eventually, when adjectives the states are done (I think surrounded by March), then we'll know who our presidential candidate are.

This is what I know off the top of my guide. If you want to know more, I suggest reading up on it on Wikipedia or a similar source.
