Are you surprised a court used common sense to generate a ruling?

http://www.msnbc.msn.com/id/22488113/

The Pennsylvania Supreme Court ruled that a woman who promised a sperm donor he would not have to recompense child support cannot renege on the deal.

The 3-2 declaration overturns lower court rulings under which Joel L. McKiernan have been paying up to $1,500 a month to support twin boys born surrounded by August 1994 to Ivonne V. Ferguson, his former girlfriend and co-worker.

“Where a would-be donor cannot trust that he is safe from a adjectives support action, he will be considerably smaller amount likely to provide his sperm to a friend or nouns who asks, significantly limiting a would-be mother’s reproductive prerogatives,” Justice Max Baer wrote in the majority feelings issued last week.
Answers: I didn't construe the courts knew what adjectives sense was.
Most rulings within civil court are based on adjectives sense. In "THIS" case, however, I infer that the dissenting opinion is more adjectives sense than the ruling.

Justice J. Michael Eakin, in a dissent, said a parent cannot negotiate away a child’s right to support. “The children point and say, ’That is our father. He should support us,”’ Eakin wrote. “What are we to reply? ’No! He made a contract to conceive you through a clinic, so your father obligation not support you.’ I find this unreasonable at best.”

I agree with Judge Eakin. McKiernan know he was getting the mother pregnant. It is not the twins responsibility that their mother has lost her assignment and cannot support them. Why should they spend their childhood in poverty when they own a rich father, just because their mother agreed not to aim child support for them?

“Where a would-be donor cannot trust that he is safe from a adjectives support action, he will be considerably smaller quantity likely to provide his sperm to a friend or nouns who asks, significantly limiting a would-be mother’s reproductive prerogatives,” Justice Max Baer wrote"

Sorry, Judge Baer, but I think we SHOULD be likely to "limit a mothers prerogative" to palpably conceive a child with no father to contribute to its support and to be precise likely to as a result be a drain on welfare.

Richard
Courts often use adjectives sense to make rulings and later explain them with legitimate terms and precedents. But I'm not sure I agree next to you that the court made the right ruling here. Generally the right to child support belongs to the child and it cannot be waived by one of the parents.

Rickinno's answer citing native tongue from the dissent explains this better. It's one of the best answers I've ever seen on Yahoo!
Very surprised.

How do you get a elder woman to turn in her drivers license, due to the reality she is a unsafe driver.?

Answers: Call the DMV and tell them she is unsafe. You can also call upon her insurance co and let them know.
transport an official looking message revoking her license or
quadrupling her car insurance
i don't know. if you find out, consent to us know.

i recently watch an old female near verbs a grocery store. as i stood behind her within checkout it was adjectives she couldn't read the numbers on her money. then i watch her go out and climb into a huge car, an calamity waiting to happen. who would endorse such a person for license?
if you are accurately, aware of the =Fact= she is, an unsafe driver You have a duty to bring this to the attention of the authorities.
It may ably be that if this lady is involved surrounded by a fatality when driving her car, she would be investigated by the police if they, consequently find, that you were aware of this. I would suggest you may be liable beneath the law?
Forget getting her to WILLINGLY turn it surrounded by! She is never going to admit she is an unsafe driver. Here are a couple of concept:

Talk to a police officer. Explain the situation. See - and then do - what the police officer suggests.

If she is an unsafe driver due to impairment of ability, (mentally and/or physically incapable) then you can own her doctor write a statement which can be turned into the DMV and the courts if it comes to that.

Why can you have sex at 16, economically any age I suppose, but not watch an R movie at the cinema?

I know this does nouns kinda stupid...
But I was bored.
And I've other kinda wondered this I suppose.

Anyway, any helpful answers are appreciated!
Answers: Because when you enjoy sex at age 16 or less, it is for two reason, first you are trying to be accepted; and second your hormones are doing the thinking.

R rate movies are rated for the sense it will give parents some control over what their children see, which is a polite thing, as some kids might enjoy nightmares or be permanently scar by some of the contents.

And as far as being competent to vote, serve in the military, drive a motor, drink etc, I believe the age for the all of the above should be 21, and if obligatory the young should hold to prove their are responsible enough to do any of it in the past they are given the privilege.
how can you be 16 when your other question you wrote aphorism your 14 and thinking your pregnant.troll!!!!!!and again saying your getting threaten by a guy?troll!!!!!

but I thought one crucial detail would help you back me.

I know her real mark, where she works, her work e-mail and phone number.

I've talk to her on the phone multiple times

and I realize I didn't handle this the right route.haha.thanks for not reminding me
Answers: You remunerated for a service or product not rendered, and are entitled to a refund. Scalping is merely illegal at the venue, so you haven't done anything bent.
Are you entitled to get your money rear legs? The answer would be yes as you paid for an item and did not receive it. Now, in actual fact getting it back is where on earth it becomes sticky.

Have you contacted ebay at adjectives and told them of the situation? That should be your first recourse.
Another option would be to sue her contained by small claims court in her county of residence. Since you both live contained by the same state, it shouldn't be too difficult to do that.
Did you buy the tickets from her through eBay? Or did you buy them from her directly? If you bought it through ebay, contact them and use their dispute resolution services. If not... boy did you formulate a mistake. You can file a imperative suit against her to get your money stern, but you will probably spend more than you recover.

Blockbuster is charging me for a movie I already returned?? What can i do =( ??

I rented a movie about 10-15 days ago and returned it prompt. Two days ago I received a notice within the mail wise saying that I owed them 5 dollars because i had not returned the movie in good time. Today I went to check my edge statement and there be a charge for 30 dollars on my account from Blockbuster. I know that I returned the movie and in a minute I don't know how to prove it? Can anyone help me please???
Also, shouldnt they beckon you before charging your justification, especially since they only sent me a spot in the letters two days before hitting my depiction?
Answers: you really need to run down there, to your local store or get hold of an office phone number.

you hold to be confident and dont let them hoof it over u as they could do.

There is NO WAY u shud have remunerated that and it was their mistake. dont lift no for an answer.

they owe you that money straight away in cash/to ur commentary and tell them to remove ur dune details from their system.

how rude of them!
Why did you give them access to your sketch in the first place? NEVER do that!

Call Blockbuster and let somebody know them they are in error. If they don't listen, ring up your bank and relate them that you never authorized that charge on your account.
Call thier cranium office.

I own had this little run surrounded by with blockbuster back. They charged my credit card 3 times for the same slow fee I remunerated in currency. All to the total of about $80. I have receipts and statement. They have all the same to refund it. Went to the BBB (better business bureau) file a complaint with them. Called visa in the order of the unauthorized charges. Nothing has happen.

4 years later I am still owed $60.

File a complaint beside the BBB. Call their corporate office. Call your wall. Finally, never rent from blockbuster again.

Is coercion considered rape...?

For example a woman has to sleep next to the owner of the house where she is hiding otherwise she'll be caught by the police and jailed. When a woman does that surrounded by order to escape a bigger threat . Is the man that uses this situation for his benefit a raper? Because technically she still have a choice.
Answers: Depends on the state law that define rape. In Washington state that would be rape.

Based on your justification, adjectives rape could be defended that way. A man produces a gun and say "have sex beside me or die". He has unused force, she has a choice. He did not snatch her etc. It's still rape,
No, technically it is prostitution, because she is offering her services as a form of payment for the opportunity to hide away at his house.

Rape requires force.
I'm a woman and I wouldn't consider that rape. If a woman uses her sex to get something, next heck no it isn't rape, she just bought someone sour with sex.
Now I don't guess a man should use sex against her and make her enjoy the choice of being turned contained by to the police, it violates a code of morals and nouns, but she should expect to put up with some bribes and some tough stuff to stay out of top-security prison.
To me, no it is not. She has the choice not to sleep beside the owner. Also, she chose to be a fugitive, and she put herself in this situation.
I don't regard it would be rape if she truly had the choice to read aloud no and walk away, but it could be considered blackmail or coercion and still a crime. Why would anyone stoop to that smooth to sleep with someone anyway?
"Based on your exoneration, all rape could be defended that agency. A man produces a gun and says "enjoy sex with me or die". He have not used force, she have a choice. He did not grab her etc. It's still rape,"

I don't agree. In the first valise, the owner threatened to do something that is decriminalized and was his right to do, namely, notify the police of her whereabouts. In the second valise, the man threatened to do something that is risky and not his right to do, namely to shoot her.
What if you had fall into an abandoned ably, and I happened by and hear you screaming for help. There is a rope I can drop down for you, but I say-so "I'll throw it down if you sign over your house and all your property." Would you consistency you had a tangible choice? Actually he could get within trouble for aiding and abetting a criminal within return for sex.

Legal jargon?

what does case/client intake tight-fisted?
Answers: Generally that would be whatever procedure the firm or bureau uses to create a file so that they can fire up working on whatever situation it is that they should do.
Usually is used in the context of pro bono or public interest clinics to refer to the process of screening and documenting the issues facing individuals beside potential legal problems.

When relatives attend clinics or other legal aid programs, they are first briefly interviewed by an attorney contained by order to determine the facts and common circumstances of the person's issues. The attorneys can then determine whether in that is an actual legal problem and sort it fittingly so it can be sent to an appropriate attorney, who is best suited to handle respectively clients particular situation.
