Generally, just because a country is a democracy, it doesn't tight-fisted it will inherantly make the right decision for the people. On the other foot, do you really want the Government doing what the people speak ? Oh that was fine put a bet on in the 50's or so when empire had morales, that they didn't stomp on every cross that be perched on a hill or whine going on for being sensitive by manger scenes, but in a minute, we have socialists, suedo communists, islamist, assorted people who's radical have be enemies of America contained by the past or prove to be one contained by the future. These populace and thier destructive ideology now dwell amongst us, and they vote.
No, I don't want to bring back into Vietnam as an example of it being suitable, because when you look back at that protest, it didn't do any apt. It alienated out allies, set a bad precident about how the USA treats its ally when the going gets tough, it resulted within over a million people human being put in concentration style camp and even those decrying that they help saved the lives of American soldiers turned around and spat on our own troops when they returned calling them babe-in-arms killers. So who did these supposed peace activist serve ? It wasn't the country, or our troops.
However, even though it is generally breaking the tenet, there have to be a way for someone to effect swing when the powers that be make a desperate decision. But to fray some sort of morale imperitive to commit acts of civil disobedience would be like reasoning that Terrorist use. It isn't liked, or above-board, but it does work.
Or rather, it would work if they could come up near some focused statement they were trying to create and a goal they be trying to reach. Terrorism in recent times ticks people past its sell-by date.
So does Civil disobedience. Do you really think that the individual showing up at work late because you blocked traffic is going to sustain your cause ?

To me, Civil disobedience is the last feat of a desperate person or relatives that think they own the right to be heard. You might hold the right to speak in America...but not a soul has to listen. Its not fully formed at best.
A better approach is say what happen when America stood up against the immigration reform. They shut down Washington next to all the call that flooded in. That signaled to them that we be mad, and we be serious.
Just because you live in a free country, that doesn't furnish you the right to interfere with others right to go, liberty and the persuit of delight. Traffic blocks, die in's and the like do that. They inconvenience fellow citizens...and are more than promising to make an antagonist of your cause than you are a comrade.

Environmental Law Question (Superfund)?

Let's say the state pass a law that requires more protective cleanup for a singular facility than the federal superfund standards. (assume the facility is a US-EPA listed superfund site).

Can the state come within and say "we close to EPA's cleanup requirements, but we want even stronger ones for this facility in our state?"

Answers: States and lower jurisdiction can do just that. In reality, that's the whole point almost federal standards; states, counties and such cannot have lower standards because it violate federal law.

So that's the doomed to failure side about lower jurisdiction stepping in, they regularly adopt tougher measures and often short scientific starting place for it.

How does one qualify for full time benefits in New York state?

Is an employer required by canon to give you full time benefits after working a minimum number of hours over clear in your mind time period?

Previously, I worked for a retailer that classified section time as working an average of 30 hours or less a week. If you averaged over 30 hrs a wk contained by a 12 wk period, the company be required to bump you to full time benefitted status. We were other told this was NY state directive that they were following.

Now I am working for a different retailer, averaging over 35 hrs a wk for over 16 wks. When I told my supervisor this practice at my previous employer, I be told that this was NOT New York state regulation.

So really my question, is "Which employer is correct, and surrounded by what state does this regulation apply?". I have a awareness that my current job is correct that it is not New York state directive, but I think my previous errand was following another state's ruling. California, perhaps?

The employer is not required to provide you next to full time benefits unless the employer has already promised to do so. Were the organization of the retailer that you previously work for in a association? Because if they were, that could be the object.

I feel the prior retailer probably had confederation employees working for them...if it's contained by the memorandum of understanding (union contract), later that's how it occurs. For example, one of my friends is classified as recreational and works in a company where on earth all workforce are union workforce. Even though she works full-time (40 hours or more per week), she still gets the "part-time" benefits (which are base upon hours worked, but since she works full-time, she gets the full-time benefits). If she be classified as "full-time," her employer would be required to always endow with her 40 hours per week (and the employer can't guarantee it).

So, in response to your query, your current employer is correct. There is no requirement under NY state tenet to bump you to full-time benefits, regardless of how many hours you work.

Awol and a Deserter?

It has almost be 3 years now. I be in the army for almost 6 months earlier I decided to bestow. I had a serious problem next to gambling that be the main apology for leaving. I called the GI rights hotline give or take a few 4 months ago and told them my story and they gave me a number to ring up to turn myself in. I call the number a sgt picked the phone up and I gave him adjectives my information phone# social security # and my address told him what I did and asked him what he required me to do. When he input my social it returned that I was seperated within 2004???? I never got a discharge what is going on??????????

Just to close the case. if it say you were seperated they in general have a code aft your name to further explain the discharge but i believe you weren't within long enough. within is a time line where on earth you can be charged or not but its not something that they really advertise for if everybody unsullied about that we wouldn't hold a mlitary anymore you know. i wouldn't worry something like it. if they wanted you stern they would have gotten you already.
