Menendez Therapist Tapes - NOT PROTECTED BY CONFIDENTIALITY?

I recently watch a cable documentary about the Menendez Brothers shield.

Even though their therapist cassette recorded sessions, why weren't the tape protected by patient-doctor confidentiality?
Answers: The legal arguments over the tape took a long while. The state supreme court finally ruled that the threats the brothers made to the therapist removed the confidentiality balustrade. This article discusses the arguments: http://www.crimelibrary.com/notorious_mu...
Most of the tapes be kept confidential because of the "patient/therapist privilege.

However, some tapes be deemed to enjoy been made because their psychoanalyst was threatened by the bothers and those tape were not privileged.

Read the excerpt below:

"The Court established that the release of the tape be not barred by the patient-therapist privilege because Oziel believed that the brothers have threatened him during the sessions covered on the tape."

Nonetheless, most of the tape were kept confidential because of the "patient/therapist privilege.

Why was a man charged for murder when he be nowhere close to the victim.?

In Missouri a State Trooper be speeding on the interstate to get to the aid of fellow officer who were attempting to lock in a known criminal that be about 50 miles from his station. About 15 miles from be he left, he crashed into a stalled tractor trailer and get killed. The criminal be caught and tried for his crime plus the crime of murder . Why was he tried for murder when he be 50 miles away ?
Answers: In Missouri, a person is guilty of second scope murder if (s)he:

Commits or attempts to commit any felony, and, in the perpetration or the attempted perpetration of such felony or within the flight from the perpetration or attempted perpetration of such felony, another person is kill as a result of the perpetration or attempted perpetration of such felony or immediate flight from the perpetration of such felony or attempted perpetration of such felony.

This process that if someone gets kill as a result of your committing any felony, you are guilty of murder. The trooper would not be dead except for the suspect committing his crime, therefore he is on trial for 2nd level murder.
The fact remains the officer died within the attempt to catch the prep. this make him responsible for the death, because if he have not committed the crime the situation would not have presented itself for the officer to die.

Custody/Visitation?

I live in Kentucky but I be wondering if my babys dad is able to lug me to court for visitation rights if he is allowed to see our daughter? When he ask to see her he is able to, everytime, but he keep threatening to take me to court for some point...not real sure what his point is! But I don't see how the court could allow him to filch me to court for visitation when he isn't denied her?! She's only 2 months frail also!
Answers: go profile for child support and let the court work a visitation calendar, its a power play and you will win as long as you can support your child.
A smart father would go to court and gain an order of visitation - reasonably and in writing. This prevents the mother from denying him access to the child whenever she get in a snit.

And, yes, he is allowed to do that.

Why is it that once an atheist, becomes a theist during the criminals time within jail or prison?

I other notice how criminals adjectives of a sudden find God, or become Christians, even though they did not believe in God in the past they served their time in lock up or prison. What is the reasoning behind this? Any sort of assist would be greatly appreciated. Thank you in mortgage.
Answers: what makes you assume they be atheists when free. THe truth is that most of them weren't atheists. Sure, they "sinned" and probably didn't follow a strict religious life, but they still identified as christians...much approaching most of america-believing in god but making few sacrifice in lifestyles. Once surrounded by jail, they merley become closer and more intimate near religion as they have the time to do so.
Because they are WEAK...

Just close to people who find god on their demise beds
Generally it "looks good" when one is going up to that time a parole board to find "God."

Especially, now that the US is ruled by Corporate Cristian's.

Look at the multiple murder and rapist the the Christian Preacher Huckabee paroled because he found God. If he didn't proclaim his Christian dependence and get "saved" he wouldn't own gone free to commit further murders and rapes.

Do you understand it very soon?
I think they are trying to look pious for the parole board to get a shorter sentence so they can bring out and re-offend.
How many criminals do you know that go to prison and found God just to take out and re-offend? To many to count, right?
because to be exact what it took to get them to SEE THE LIGHT however some of them are of late fakin it till they get out. and it impress the parole board.
I will add my two cents on a hot topic here. I am a Corrections Officer contained by a max prison for the last 19 years immediately. There is not a lot that I enjoy not seen or experienced within that time. Although there is a VERY small percentage of inmates that honestly do try to rehabilitate themselves, the VAST majority are simply looking for something that will generate them appear to be recalcitrant when they go earlier a parole board. They constantly sign up for AA and NA ( Alcoholics Anonymous and Narcotics Anonymous) simply to get a slip of serious newspaper saying they attended classes for a specified length of time. All these deeply "religeous" men consequently get free rosaries from the chaplain within the prison and wear them around their necks close to a cross, which in NOT what a rosary is for. If you ask them, they honestly dont hold a clue what "praying a rosarie" means. My final point is the recidivism rate in our day. During the "crime and punishment" stage of incarceration ( up until the early 70's), recidivism ( the percentage of inhabitants that returned to prison for subsequent sentences) was 15%. Currently, underneath the new "Corrections and Rehabiltation" hypothesis, recidivism is 80%. Yet the liberals are yelling that they are abiding 20%, so their ideas are better. This is my personal thoughts on this, but it is base on many years of practical experience and familiarity.

My mother died in Oct. her insurance policy be to go to my brother. She wrote his term on the beneficary form

and signed it but didn't date it. Since she didn't date it the 50,000 went to my step father. When this be explained to my brother and stepfather at my mother's employer my step father told my brother that he would give him the money once he received it. GUESS WHAT... Last week my step father recieved the check later told my brother that he will not be giving it to him. A a-hole gave him some bs object why. Can my brother fight this contained by any way w/ the insurance company or the a-hole? Any design?

Any lawyers contained by Austin,tx want this case. Take the fees out of the money recieved. We are of a mind to pay top dollar. We purely don't want this a-hole to have it. better a attorney that actually worked for it instead of him.
Answers: Hire an attorney to look at the papers he can interpret it for you.
Talk to a advocate.
I think you and any other member of your immediate family connections have a legal claim to the money.
Chances are if you find an attorney who will take the armour on a contingency bases he will draw out the suitcase so long that he(the lawyer) will get most of the money. Buy your step Dad a bunch of cigarettes and booze. Maybe they will kill in cold blood him and then you will carry the money. Could be cheaper than retaining a lawyer.

Is it legal for my employeer to hold my final paycheck and not distribute it to me because she said i was stealing?

from the company. she said she dont enjoy to pay me
Answers: No. If she believes you stole from her she must still money you, but can then both wallet a criminal complaint against you, and sue you for her losses.

Both, though, will require that she be able to prove it. As of presently, though, depending on your State, you're very promising entitled to penalties from her for unsettled payment.

Richard
Your are asking a decriminalized question that should be address by an attorney.

However, an employer is liable for payment to an member of staff for work performed, regardless of motivation for termination. The employer may elect to not pay you any severance remuneration, unless you are employed under an employment agreement which states otherwise.

If the employer have stated before a witness who will testify to same, or give you written notice of temination including contained by said written notice her claim that your be stealing from the company and that is the judgment for your termination and etc., you may have a claim against her. Unless she have verifiable evidence to support her claim, you may have grounds for a sizable claim against her.

Only a foolish employer make a false claim against an employee for the purpose
termination, especially surrounded by a state where the hand is employed at the will of the employer and can be terminated with or short cause.

If you folder for unemployment benefits, plus unpaid wages, the employer have the right to protest your claim, but the burden of proof then become hers at any review process, or resulting hearing on the issue, conducted by the state unemployment agency. The determination of the state agency can be challenge in civil court, but you attorney's fees for such management may far exceed the money owed you by the employer should you lose the case.

Sometimes, within a questionable situation, it is simply less electric and, probably, less expensive for you chalk it up as a personal conflict brough going on for by the employer which resulted in her mistaken assumptions in relation to you, saddle your horse and ride out looking for another job.

Regardless of the facts, the aforelisted are things you should be aware of earlier proceeding with any conduct on your part.

Sometimes an attorney will not charge you for an initial inteview, but you should progress to the inteview prepared with a scarcely itemized statement of facts regarding the situation plus any evidence you may hold to support your postion and claims. Keep it beief and to the point, and no name calling or assumptions...in recent times the facts and any supportive documentation...keep appease and professional regarding the situation...you want the attorney to catch a positive image near respect to your demanor.
NO you need to contact your state's labor board and wallet a complaint. You may have other officially recognized rights under your states imperative and should atleast consult a attorney. Many will handle cases such as these for a percentage and some can achieve the job done next to a simple letter on their letterhead demanding fee.
