Yes, a individual can do it if they feel brave adequate to do so, but I wouldn't recommend it to any one. Personally I would be ashamed of my self if I ever treated some one like that simply because they be doing a job for me. we have some screwed up law that state a radio station must be informed when being survieled. we also hold the same type of law in other areas,,,,similar to health department. MLB is a PRIVATE BUSINESS that can set it own rules regarding the use of legally recognized and illegal substances. If anything perchance a criminal probe on unlawful substances BUT THAT'S IT. MLB, and other professional sports are permitted to operate by an exception to general law (e.g., federal anti-trust laws)... they are a protected monopoly of the industry because of the unique temper of professional sports. There are a myriad of laws to protect the interests of public sports.
Additionally, public funds are used to support professional sports surrounded by building stadiums, etc. That hybrid of public and private involvement means here will always be some governmental issue.
Also, because professional sports operate surrounded by interstate commerce (virtually all nearby business requires crossing state lines), the federal government have a right and a duty to regulate activities of the institute.
