Is a small business owner required to pay a "fine" if he pays a worker but does not 1099 a worker?
not adjectives people want to endow with a social security number to me.Answers: Yes, you can be fined $50 for respectively 1099 that is not file with the IRS by the due date. However, if you follow the suggested procedures for conference this information, you will not be fined.
A 1099 is only given to independent contractors, not personnel. Employees should receive a W-2, showing all of their wages and deduction.
You cannot just prefer to call an member of staff an independent contractor to avoid paying the payroll taxes. If you control the worker's time, methods, tools, workplace, etc., that worker is an employee and you should withhold and remuneration taxes on their wages.
If you truly have an independent contractor, after you should collect form W-9 from them before you engender any payment to them. If they don't complete the W-9, next to their SSN or other tax psyche #, you don't pay them. That works remarkably well and keep you from getting fined by the IRS.
For more info, visit the IRS website: www.irs.gov.
I own a small business and my individuals work as independent workers so their whole charge thing is their responsibility. They don't work FOR me but fairly they work for themselves and pay me rent close to a beautician does that way I can't procure in trouble if they don't reward their taxes. They all signed a contract since they started working in my business.
Who would do the trial of a crime if it was commited on a unclamed island?
if someone murderd someone on a previously unknown and unclaimed island, than would they get away next to it? who would do the trial. if there is no regulation on the island, how could it be broken?Answers: Extraterritorial crimes are prosecuted by the government of any the victim or the defendant.
Barry... if truth be told, there are unclaimed islands. Various volcanic archipelagos see up new islands adjectives the time. Also, by international treaty, much of Antarctica is extraterritorial.
Maritime law is smooth on this question. A crime committed on a ship or aircraft surrounded by International waters or International airspace is prosecuted by the flag State of the ship or aircraft.
Richard
there re no unclaimed islands on dust.
in times past there be, and if there be no sovereign law, after there be nothing defined as murder be there?
btw, the intact idea of pirates be to commit crimes "on the open waters beyond sovereign jurisdiction".
I bet if you re-ask your query as involving real marine law instead of on a hypothetical island, you will draw from far more interesting, and real answers :)
While at hand are no known islands which do not labor lower than some soverign state's claims there are immense parts of the continent of Antarctica that are free of such claims. The entire continent is administered under a multi-national Antarctic Treaty, which expressly make no judgment as to the lawful validity of national territorial claims. There is an "Antarctic Secretariat," (located surrounded by Buenos Aires) created under the treaty that truly administers the provisons of the Treaty. The treaty provides that "jurisdiction" over scientists & other personnell of a contracting state is near the contracting state. Because of the severe environmental restrictions and obligations of contracting states, it appears unlikely that even private those can visit minus some governmental license or permission -- thereby subjecting thmselves to "jurisdiction."

Answers: There are a number of conditions that own to be met for the situation to become stalking. See http://www.ncvc.org/src/main.aspx?dbID=D... for state laws.
If you look at the California law, one element for both civil and criminal stalking is the credible fear of attack or departure.
Because barefoot photographers spread fungus from their toes and stockings keep the hurtful smell down to a minimum. Believe me, celebraties do NOT want smelly, moldy paparazzi STALKING them.
Is this illegal?
I registered a domain baptize recently and I be quite lively that I got the domain because its a fundamentally good signature. But after aquiring that domain name I found out that the christen is actually a trade sitting duck, although not a very popular one. Am I going to receive into trouble? I have no intention of profiting from this domain christen, atleast now that I've found its if truth be told a trade mark. Someone relief me out please :(Answers: If the owner of the trademark finds out yes they can sue you.
Just change it and not a soul will be the wiser
dont worry man they wont bust you
resembling you said "i have no intention of profiting for the name" its ok only delete it and make a bright one
by the way what be it?
if youre using the name as a company logo...or slogan...or naming a product or some type of service or SOMEHTING that you ARE profiting sour of...then yes you can carry in trouble if its in recent times a domain name youre using afterwards no.
american eagle outfitters is a HUGE company and their domain name is AE not american eagle...american eagle is taken by another small business. relax.
if you can...change it...if then dont sweat it!
Been near done that. Yes, it can cause a TRUE mess for you down the line. My solution be easy, I only exchanged 1(one) letter; a Z contained by place of a S. It sounds the same, and in actuality looks more creative.
I would change it ASAP because, logically down the strip you may have opportunity to profit, and if the other shindig sees this, they may choose to, at worst present you next to litigation, and fight for the domain christen. They would win, because they had the identify first, and is a trade mark.
If you don't, "ever plan to profit", it is still conflicting.
No, your not surrounded by any trouble now. I am only giving you a few reasons to adjust your domain pet name.
This happened to me going on for 10 years ago. I'm glad I changed it.
Lastly, you didn't mention if it was a "registered" TM.
Is it wrongful termination?
My brother was basically fired due to missing too many days of work in a 3 month period. He and his wife a short time ago had their second child, he is only 2 weeks antiquated, and she is suffering from post partum depression, because of this, she throws a fit every night when he have to go to work. Well ultimate friday she begged him not to turn because the baby be crying a lot. He call his job and talk to the secretary who told him that it was no big business deal because he was worried that he might go and get into trouble for it, he would just go and get what they call a "black mark" and a speaking warning. So because she told him it be alright he called out. 3 days subsequent he was call into the office and told that he be fired for missing too many days. He explained how he would enjoy been here if the secretary have told him that he would lose his job if he wasn't here, but since she told him really not to verbs about it, it would be fine, he stayed home. He have worked for this company for 7 yearsAnswers: Is it wrongful termination? - No. He spoke with a secretary that he should hold known would not know more or less all of his absence. Only your supervisor can normally excuse an skiving.
Most states are employment "at will". As such, they can fire you for almost anything and don't need a purpose.
where their warning if no warnings next you might have a satchel file for laying-off tell the truth generate the boss out as trying to protect him self from your brother taking maternity set out yes the dad can too most likely he will bring back unemployment after 2 to 4 week waiting length.
it's hard to encounter these things in court.
Nope, he deserved it. People are rewarded to be at work, not just be on the payroll. If he worked at hand for 7 years he certainly know better than to take his direction from the secretary. It be not the secretaries place to tell him no, so adjectives she did was overrun along the information.
corporations are not benevolent institutions. They are unaccountable, private tyrranies. Of course it was wrongful, contained by a moral sense. But the law seem supportive of these brutal institutions.
HOW ABOUT EMPLOYING THE FEDERAL FAMILY LEAVE LAWS.DESIGNED FOR THIS VERY SITUATION
It's not wrongful termination.
The Family and Medical Leave Act (FMLA) allows for taking UNPAID leave to attention for a family contestant but you need to appropriate some steps to get the time sour BEFORE you can take the time.
Depending on how abundant employees the company have, he might have some capacity to make a FMLA claim. Chances are he is too unpaid to do so.
no secretary should be fired
I would think that FMLA would cover something resembling this. He should talk to an employment attorney although he could probably collect laying-off easily contained by this situation and he may need to be at home right very soon and earn money...you don't get rewarded for taking FMLA.
CA dui. over 3 times the legal curb! need warning please!?
hi, my best friend is in a bit of trouble. a few night ago she totaled her car (she is incredibly lucky to be alive and even luckier that not a soul else was involved surrounded by the accident). At the scene she blew a .28!! and with her injuries she be taken directly to the hospital instead of to jail. i am not sure if or how the directive differs if you are that far over the legal check or if an accident be involved. I only know the ramification of a "regular" dui. Would it be wise for her to hire an attorney? will it do any polite? she has no prior transcript, will she be facing any jail time or other severe cost like loss of license? thank you for any aid or advice you can make available.Answers: It's always perceptive to hire an attorney when you're facing jail time or any loving of legal trouble. That mortal said, I hope she at least get her license taken away because I can't stand irresponsible people who don't trouble about endanger other people's lives.
"she blew a .28"
She's lucky to be alive.
Yes, she SHOULD hire a lawyer.
At that rank she's got no uncertainty - even on a 1st offence - of getting it down to a damp reckless. She's VERY lucky no-one else be injured, or there'd be mandatory felony implications.
She's facing a misdemeanor criminal charge surrounded by addition to the DMV consequences. She should hire a advocate who "might" be able to save her out of jail.
Richard
DOES SHE HAVE MONEY?
If not, afterwards make them burn her, near appointed trash, like they do everyone else. Attorneys CHURN cases, babe-in-arms. Even if you pay them.
But your girl blew a .28, SO DON'T BLOW OFF GOOD MONEY, AFTER BAD. Don't buy her another motor, anytime soon.
Any time you are facing criminal charges, you need an attorney. Not have an attorney in that situation is close to performing surgery on yourself: not a good opinion.
More than likely, the DUI charge will be "enhanced", objective the ramifications and the smooth (this definitely won't be a misdemeanor charge) will be more severe.
My guess is her license will be suspended for some length of time, at the minimum (any DUI will get your license suspended). Yes, she could be looking at sentence to prison, but not prison; this is why she really needs to hire an attorney.
Your friend should contact an attorney as soon as she is competent. With the right representation, your friend will likely receive far smaller number punishment than if she was unrepresented.
Your local county dowel association will have a referral service where on earth you can find a reliably good attorney somewhat quickly. These pub associations are easy to find by questioning the internet.
its too late since she took a blow try-out, she is loosing her license and may be looking at some jail time. Perhaps a righteous legal attorney contained by the town she was surrounded by can help her out but it will cost
your a correct friend to support her - please keep up the moral work
Why was i suspended from conservatory?
Ive never been Suspended formerly and never had a detention. This guy contained by my class told another guy that i was conversation about his mom (which be a lie he freshly wanted to see a m¨ºl¨¦e because his mom recently died and he is terribly angry of that)and his mom passed away then the guy jump up and attacked me and i simply defended myself now im suspended from college and thats going to be on permanent narrative.Answers: honestly, you're "permanent record" isn't that big of a operation. you think when you're 30, 18 even, some company isn't going to hire you because you be suspended for fighting???
Self defense and mutual combat are not like peas in a pod thing. You did not simply save from harm yourself, you attacked back. That is why you are suspended.
For it to qualify as self defense you can one and only use the amount of force necessary to stop an attack. As running from the scuffle is generally an remedy, joining in to a exchange blows is rarely see as self defense.
Don't agree with David on this one :)
IF your explanation was accurate, seem like a typical teen dustup next to only self defense contained by place. What might have happen had the instructor not come along is only speculation.
In any baggage, I am going to tell you a stealthy: there is no such point as a "permanent record".
I know someone, college freshman this year, which within HS was suspended twice for drinking troubles at arts school events - a prom or dance, and on a institution trip in another country where on earth police and ambulances got involved.
Her parents be worried sick about university admissions, but not a soul cared. Kids attain suspended all the time and everything else be fine. Admissions officers know sh*t happen, as long as it is not a habit and everything else is great, after no problem.
And if you are not bound for college, that is fine, but even more so no employer will ever ask, nor are you obligated to recount, if you were suspended form HS. You any have a diploma or you don't.
Although you may not close to it, fights are between two individuals. The fact that you "defended yourself" next to detrimental action, mode you were warfare. Schools here only suspend one creature if the other merely covers up to avoid injury.
So what do you think almost the public having access to Tasers?
Tasers are the big payment to give this year!Who's getting one and why?
Do you conjecture it will solve a problem or cause one near even violent criminals have access to them? Or even having the public who might variety a mistake when using one, say taser someone who needed directions and wasn't trying to hurt anyone?
Answers: Shocking!!! But seriously, I suggest it's gonna allow trial lawyers to trademark a butt load of $$$ stale wrongful death lawsuits. The ultimate thing we stipulation in this country where on earth heart disease is the # 1 killer is a society full of trigger beaming paranoids zapping anybody that doesn't give them their agency! A taser can reek havoc on the heart rhythm of it's victim.
my wife like the taser I like my .45
Is it true that I need a Canadian, Mexican or American ID to purchase alcohol contained by New York State?
CVS will not allow me to buy alcohol even though i am 24 years old. They claim that foreigners short a canadian, mexican or american ID are not allowed to purchase alcohol within New York State by law.Wouldn't that anticipate that foreigners are discriminated against? Why shouldn't I have duplicate rights as any American, Canadian or Mexican when it comes to alcohol?
I would be very chirpy if anyone could send me any sort of information on this topic.
Thank you
Answers: They are not required to adopt any identification to be exact in a lexis they do not understand or that they are unqualified to verify as authentic. As passports from all countries contain an English translation and are permitted world wide, your passport will work.
I agree near David. Passports are the usual solution, so is getting a local state ID or drivers license.
I am not aware of any restrictions on where you are from, with the sole purpose that they are comfortable that the id is actual. Would *you* be willing to adopt any id form anywhere if you could turn to prison and lose you business and money TONIGHT if you were wrong even once?
I am sure in that are other places in town to buy liquor too :)
No it isn't true, but the solitary I.D. acceptable lower than New York law for non-Canadian foreigners, including Mexican Nationals, is a passport.
"What is reasonable proof of age to purchase alcohol in New York State?
A valid driver's license or non-driver designation card issued by the Commissioner of Motor Vehicles, the Federal Government, a State Government, Commonwealth, Possession or Territory of the United States or a Provincial Government of Canada; or a valid U.S. passport, or valid passport of any other country; or a valid military ID from the U.S. (Section 65-b.2(b) - ABC Law)"
