I was charged beside conspiracy to hurt someone at school. I am a minor so what liberal of punishment do i face if i own a clean story or don't even have a copy?

Answers: In the Federal system "Good time" is restricted to no more than 20% of the sentence.

Vick's been sentenced to 23 months, but have already served 1.

80% means he have to serve at least 18 months, smaller amount the 1 he already served. He can serve the last month within a halfway house.

Any misconduct while incarcerated will cut into his 'good time' and trademark him stay in longer.

Once he's finished the Federal sentance, he can afterwards be tried by Virginia, and serve whatever sentence they bestow him.


EDIT - to Beau - Federal "Good time" is 54 days per year, not a month. As near as damn-it, that's 20%.

My brothers rights?

My brother was next to a girl (never married), they have 2 children together. On is 7 and one is 5. They split up my brother moved to N.C., kids are surrounded by Fl. She has be in and out of incarcerate and is currently serving 15 months. My brother calls the kids and for fairly some time didn't know mother was contained by jail because she be never there when he call anyway. They are living with the grandfather (Maternal), My brother found out she be in penal complex and not always "working" as he be being lead to believe. He spoke with the grandfather nearly the kids coming to live with him, grandfather refuse, my brother is not allowed out of his verbs with the kids...within is nothing file with the courts stating the kids are to stay beside grandfather. Grandfather has in a minute moved to an apartment, shut off the phone, call my brother all the time to buy food for the house, (which he does) but still won't give my brother fund his kids... should he just profile with the courts or is within really no need to because

Now he could show w. documents (birth certificates and several other things) and the police would immediately turn the kids over to him if he purely flew down. They are HIS children. She is in top-security prison and he has come to collect his children.. as their welfare is more earth-shattering than any legal wrangling subsequent. The grandparents may disagree but they have not anything legal rights.

But that can be ultimately sticky. She might drag this out surrounded by court but would lose eventually. The grandparents know this that is why they are resisting. They know that since she is contained by jail he can do frequent things.

Legal Question about a Civil Lawsuit?

Last October, my bf and his brother get into a fight beside two other guys. The two guys (who started the fight) got crushed up (chipped tooth, fractured leg, bruises), and went to the cops the subsequent day. To get a long story short, the DA decided that in attendance was not plenty evidence to charge my bf, but ended up charging his brother near several counts of assault and battery.

Today, we a short time ago found out that these guys hired an attorney to go after both my bf and his brother civilly. Since my DA did not find ample evidence to charge my bf, would my bf be liaible for any civil damages?
Answers: The answer is yes. Just look back at the OJ trial, and that will explain it adjectives. He wasn't convicted in a criminal trial, but found liable contained by a civil court. It is actually easier to gain convictions contained by a civil court, because the burden of proof is different.

I know your boyfriend wasn't charged, but we are using the OJ case as an example, that you don't want to be found criminally guilty before you can be sued civilly. He could be liable. There are totally different standards for criminal guilt and civil guilt. Criminal guilt requires proof beyond a reasonable doubt. Civil guilt requires a preponderance of the evidence be against a soul in decree to find liability.

Answers: I hold never seen anything that say your civil rights have be taken away. And the answer to the question is that in need security, soon we would adjectives be speaking a different language, and hold no rights what so ever. I myself am willing to sacrifice taking a few items on a plane if it manner we are a safe support nation. I think folks are spoiled by too much freedom, and now expect it, applying it to everything. Like proverb speed limits impede on our right to drive freely.

The later 2 years on New years eve some drunk driver has hit our Christmas decorations a hit and run. Now i set up a camera that accounts to my computer but u have another hypothesis to set up a home made spike strip with nail by the decorations where it is possible to get hit. This road we can at least do some deface back if the saloon doesn't stop. Is this legal for me to do on my property?

Edit: To the personage below claiming this is entrapment. Do you know what entrapment means? Putting spikes surrounded by his yard is NOT entrapment. His decorations are NOT contained by the street. They are in his courtyard. The drunk has to drive within his yard to hit them.
I remember seeing a report story a couple of years ago about an electrician who be sick and tired of having his truck broken into at darkness while it was parked contained by his driveway. So he wired it up to high voltage. Seems he run into big legal problems because apparently he needed to post a sign restraining of the high voltage.

While it may be legal, you also might be setting yourself up for a lawsuit if the driver is injured because of your spike strip. You want to be VERY tight-fisted in dealing near these kinds of morons surrounded by this litigation-happy society.

Take lots of pictures - best thing to do is filch lots of pictures. One other thing you can do is to notify the local PD and see if they can put out some extra patrol contained by the area.

The only purpose you would enjoy to do this is to damage this guys motor, there's no other reason for have a spike strip there. If he run it over and his tire blew out he could get seriously injured or kill because of you. This is not a crime however it is a tort. This has civil liability and any honest lawyer would chew you up for this. Protecting your Christmas ornaments is not worth putting someone within the hospital and in doing so losing your house surrounded by his law suit.

Answers: There is not enough information here. You voice he is charged as a "youth." Do you mean charged within juvenile court? If so, he has an attorney appointed to represent him. If he is an mature, then he should be represented (if he cannot afford counsel, an attorney will be appointed).

It is difficult to predict what might transpire in juvenile court, except that he will not jump to jail because juveniles are not sentenced to incarcerate.

This court be charged as either driving short the owner's consent (VC 10851), or grand theft--auto (PC 487). The punishments are like. If he is an adult, it could be charged as any a misdemeanor (with a one year jail maximum) or a felony (with a 3 year prison maximum). However, it is unlikely that he is looking at anything close by the maximum. There is no such thing as a "class C" felony surrounded by California -- or any other class for that matter.

The suitcase MIGHT be defensible. If the girl had the key, she might have have apparent authority to consent to somebody else driving the coup¨¦, which would relieve him of criminal responsibility.
