You are not individual prosecuted for downloading the material. You are individual prosecuted for UPLOADING (sharing) it. With most P2P programmes you automatically upload as you download.

Ah but it does make sense. Someone made it, and that someone, or their licensees, enjoy by virtue of a constitutionally granted copyright, a limited-time financial monopoly to benefit from their property, subject to Fair Use exemptions.

That is the outline of the law, and it is reasonable. Your defense needs to work inwardly that outline, or it is a waste of everyone's time.

Really, regardless of my scenario, this is the question I pose. Why would my sentence be a misdemeanor offense if I physically shoplifted a DVD, however it is a very hefty federal offense if I acquire it electronically?

Secondly, since they can claim "financial gain" by stating that the objects is of value, should I not be charged for the appeal? So, $49.99 for the DVD, and say $12 if it is a movie contained by the theaters.. plus a little extra for breaking the regulation.

I think that on-line thieving should be in-line with physical appropriation, but why isn't it? Also, why can I record to a DVR... but i can not download a show the subsequent day.. even if the show I download included the commercials? I am paying for cable...

Actually, I believe the maximum fine is $150,000 in regard to a TV show. However, I downloaded a season which is 22 episodes at $150k a pop.. :) I am not worried about the consequences, I am pretty undisruptive since I am very helpful in the anti-copyright world and enjoy some good lawyer, but it just made me pose the examine.

I heard something like this on my local news and I thought how desperate this is. To sell your own child for $30 is freshly plain stupid. Even before they showed the picture of the couple I figure they must be on some type of drugs or something.
