Is this a winnable case against our previous proprietor?
moved into a rental home in aug 07. things needed to be fixed, most of the things did not ever take fixed. for ex., some huge holes in the walls. he give us a bucket of spackle/hand tool - told us to fix it. basement leak bad - never fixed/not usable. the section was never cleaned until that time we entered it. & a strong urine smell from the hearth rug in the upstairs hallway. in postponed oct/early nov, we paid someone to do a move in/out cleaning and to see mat. were told the runner not cleanable. urine had soaked into the floor, which be not sealed. estimate = 3-5K. since we moved in, he said since we hold a pet, he did not want to replace carpet. cleaners also said the robustness risk was hugely bad & that it be prob making us sick. late nov - more problems come. washer broke. thanksg. heat broke. hotelier did not call stern. 3 weeks go by. we hail as him. he said he 4got. can we sue 4 all posterior rent and expenses he caused because of vigour, fire, safety hazard as well as sloppy actions?Answers: re: "we're not a short time ago concerned with merely getting out and running for it - he is letting us out of the lease, no prob. but we don't want this to take place to the next citizens who may move in. if we don't do something, what will stop this guy from man a reckless bump with someone else's lives?"
You could ring the local Legal Aid office and agree to them know - they handle cases that include landlord-tenant cases, especially when warmth gets shut rotten or other emergency situations. If you are willing to be a witness contained by a future travel case, you could let them know that.

Don't do it online, it sucks bigtime. Take a comedy class, at least the instructor can kind it a little smaller quantity boring. I live in Austin and know 2 those here who took the online class and they both hated it.

Answers: This query is far more difficult than it purports to be.
Law is a bit like math, it uses hugely definite principles to connect concept, to cull information, and to yield results. In this path, it obeys a unbelievably specific logic (except in cases of tyranny, which are by definition surrounded by violation of logic). However, tenet is built, like math, on axioms, or unquestioned assumptions. We assert, unquestionably, that at hand are inalienable rights, or some other set of axioms.
From here, we build our case, retroactively, that the best tenet is built off these premises. For instance, the premise used to be that the King be the unquestioned extoller of law, as special by God. We changed that premise because it was argued that a better society could be built bad the premise that all associates are equal, etc.,etc.
As others have brought up, from time to time we legislate lacking regard to those principles. Prohibition is a textbook example. Time, however, corrects these legislative deviations. The logic of ruling is designed so that, over time, the contradictions will become so evident that an ridiculous law will be struck down to favor greater consistency.
Law, though, unlike legislation, is not what a society feel. Law is based on these more primitive axioms and will reveal itself as such through further interpretation of legislation.
Maybe this isn't right, though. It's only my personal, theoretically-convoluted opinion.

It was a round table discussion. The point be that a lawyer that know the law better than his rival should win...at least since a Judge. Add the jury and the odds can modify from a little to profusely.

Logic? Most of the time.
Purpose? Always. (does not have to be a apposite purpose)
Driven by Public Emotion? Yes, however those seem to capture overturned by judges as Un Constitutional.
it is not true, in that is a purpose to law. Mainly to set down accepted norm for our society. As for logic, many law have be created in logical ways, for example, while it is against the law to break into a home, to commit a theft, it is not prohibited for a firefighter to break down a door for life safekeeping reasons.
Is it ok to torture a criminal for the greater good, why?
Answers: Recently a youthful man picked up the 13 year old sister of his girl friend, next to whom, he has a child, he took the younger girl somewhere kill her and hid her body.. he tried to not tell the truth his way out of it and very soon faces murder charges.. the body still have not been found.. Hundreds of volunteers are looking for her.. he know where the body is but he is not recitation.. her blood was on his shoes, within his car, and on his clothes.. several population knew he be going to pick up the girl and take her home.. he be seen beside her.. yet he still won't relay what he did with her body.. because he think that if there is no body he won't be convicted.. the family unit is devastated.. now if you be the girls father, would you want to torture the punk or not? I would. I would make the rat homily.. I would make him enlighten me where my daughter is.. What would you do?

Generally, no. This is a case of "the shutting justifies the means" type of argument. But this is the trail towards chaos. Once you bring that step that says, anything go for a good end in, then you enjoy stepped away from civilization.
In the USA we believe that everyone should have like peas in a pod rights. Including the criminal. Torturing a criminal violates our law that say a punishment should fit the crime but should not be any cruel or unusual. Torture generally falls lower than the "cruel" category. Also, if you are religious, think of what you are dictum based on the Golden Rule when you torture someone. Do you REALLY want populace to treat YOU that way?
Before anyone asks, it is my belief that the current furor over the prisoners at Guantanamo and the waterboarding thing are wrong, wrong, wrong. Some VERY misguided society are involved there and none of them are helping the USA. They are degrading the statue of Americans by doing the very things we hold to be incorrect behavior. I'm hoping that I'll live long ample to see that stigma fade out.

Answers: There are three branches to the government... Legislative, Executive, and Judicial.
The Legislative branch make the laws, the Judicial branch interprets the law. That leaves the Executive branch to enforce the laws.

Actually, we draw from the phrase "separation of church and state" from a letter written by Thomas Jefferson as president. Since he also be involved in writing the affirmation of independence and the constitution and the bill of rights, I presume it's safe to right to be heard his interpretation is likely to echo the intentions of the founders.

it is "wrong" -- but it is also the only hope you can hold of the criminal being competent to do something other than crime once he comes out of prison!
partly the time the reason they turn to crime is that they dropped out of some crack-drenched public arts school in the first place!

I hold mixed feelings going on for this but maybe within the long run it may be cheaper to educate these family, than the crime that they will generate when they go vertebrae on the streets near no education or skills that are adjectives to society. My guess is, most of them won't make the choice to receive educated anyway and the ones that do may hopefully hold out of crime.
Lifers that have no prospect of getting out should not enjoy us taxpayers pay for any type of background.
If they're willing to sit still for any considerate of useful training I'd speak let em enjoy it. Maybe not locksmithing.
Of course when you lock them all up together beside no other options they can other swap vocational training amongst themselves for free.

Well, I guess it coud be considered wrong but you have to distribute people hope if you want them to be successful at rehabilitation minus that what is the point?
Helping them educationally seems to me a viable solution for the problem.
The unbroken point of being incarcerated is to rehabilitate a criminal and bring in them fit to live in polite society again. Now, if they hold no chance of getting out (for instance, serving 4 twenty year sentences, or on demise row) then I don't surmise it would be productive for them to get any sort of further childhood since they can't use it to help themselves or anyone else. In my view, it would be wise for the organization to regulate who is able to take anything other than a soaring school diploma while surrounded by prison. There are parole hearings, they could enjoy education hearing. Now there's also a part of me (my darn diplomacy) clich¨¦ that any American has the right to instruct themselves, and yet another fragment that reminds me - they've committed a crime and any felon on parole has lost the right to even VOTE, so there's really no stopping our command from taking another right away from them when it's deserved. So really, I guess it all depends on the situation. Yes, it's wrong to be paid taxpayers foot the bill for a murderer to become a lawyer when he's never going to see a courtroom (without self the defendant,) but there are also those who are raise in environments that dispose them to commit petty crimes (not force, it is a choice but they're confidently influenced - possibly as a result of lacking education) who could really benefit from putting a level behind their name and making something of themselves, beside a thief or drug trader.

Ok so I pranked called wendys the other year. I didn't block my id (which be dumb) and I didn't say anything. It be funny because the guy got adjectives pissed. Someone gave this being a pornographic picture anonymously in the workplace. They, near a friend, went to several ancestors at work and showed them the picture asking them if they did it. This one person be highly upset and reported them to HR. Can the company be sued?Answers: Yes. This qualify as sexual harrasment.
Companies are responsible for instructing staff about what constitutes maltreatment, and also telling them WHO to travel to to report it. And they are required to investigate reported incidents by law. They after must be accountable within court for the findings of the investigation if a suit is brought. Usually an attorney will counsel the client to wrap in any entity who might hold had involvement - individuals, manager, and the company itself. After all they want to acquire as much $ as possible and leave no stone unturned.
Anyone can be sued, but you would not win. The company did zilch wrong, the employee did.

From what I own heard, these cases are terribly hard to prove and so not various lawyers will even clutch them on.
Maybe your friend should write up exactly what happened and place a copy of his nouns with his hand records within HR. He should apologize to the person who reported him, plead guilty that he did not handle the situation within the right way, and be the superlative employee for the subsequent 6 months so everyone will forgive and forget.
If that doesn't work he should learn from this mistake and start looking for a fresh job.
Tell him subsequent time someone at work pulls a mindless prank like this on him he should ONLY speak to folks he trusts about these awkward situations, not to everyone.
As for the idiot who give him the picture, he probably heard that the subject was showing it adjectives over the office and is any hanging his herald in shame or laughing his pave the way off.
