Answers: This is wretchedly normal behavior for our politicians. Few respect the law, and fewer enjoy any real calling to represent the populace. I would not vote for him for various reason, and this is just one of them.

1. Every leading politician has stuff approaching this in his long-gone, which his supporters don't think is crucial but his detractors do.
And
2. Politics and campaigning today is done mostly beside slime, by blowing small things out of proportion, 'spinning' stories to make them nouns different than they are, and even making stuff up out of whole cloth. Huckabee is a polite candidate for this style of treatment since he is going against some of the standard policies of his party, so they are more credible to 'slime' him as they did John McCain in 2000. So if this item become a big story, then we might find out more facts almost it that might change how you consistency about it.

I was within a serious truck accident and charged beside DUI, however, i wasnt drunk (I dont even drink alcohol), my workers comp rep told me he talked to the officer and said he charged me because he can "other drop it later, but cant add on it later if I be drunk" all test came backbone clean, etc. The charges are still in anticipation of (not dropped yet).
