Law Questions and Answers

I live in Arizona and I be wondering if I have a moral lawsuit on my hands. I enjoy been working like job?

for two years presently as a busboy at a restaurant. Lately, I have be getting burned out on bussing and I wanted to see whether or not I could attain a job within the kitchen for something different. I talked to the executive chef and he said that he doesn't hire individuals with mustaches. I thought fine, I'll shave it stale. I shaved it off and started to look around and notice that there are reasonably a few other people working contained by the kitchen that do have mustaches, including the most recent hire contained by the kitchen!!! Is this a good nouns case that I own on my hands? Furthermore, is this the sort of case that on a philosophical stratum is too frivolous too worry something like. Should I just forget going on for suing and find somewhere else to cook, or have I be wronged enough to pursue this shield? what do I need to do to build a strong suitcase so that I can win?
Answers: If you pursue this, I think you're gonna find out within is such a thing as anyone too Republican and the state of Arizona is too Republican. Their laws protect the business, not the citizens.
You have no crust at all. "Mustachioed guys" is not a protected class.

Richard
I don`t know the kitchen staff with mustaches be grandfathered in to the executive chef's rule give or take a few mustaches because they had them past the mustache rule.

No offense, but anyone with a mustache is a moment or two old to be bussing table.
You may or may not have a defence. Are you sure the chef wasn't joking around? Are you sure that your mustache be similar to the other people's?

But honestly, I wouldn't bother. Unless you really want this job, it's not going to be worth the hassle of going to court.
With adjectives due respect, if you are going to work in the kitchen of a place beside an executive chef, you are going to have to endorse the social skills test for a moment better then you did.

Practice up on your social skills, and know when your potential boss is being silly with you, and perform accordingly.

Hint: at any workplace. dress and stroke as though you have the charge you want, not the job you own. then you can win to know the chef and get him thinking what a great prep guy you would be - spend time doing that and when the channel comes up, you will get it.

But right presently, he sees you as the dude who have been bussing table for 2 years, if he even knows you exist at adjectives. Get to know him, let him know that you aspire to start moving up in a minute and why, and then he can comfort you. don;t make him an enemy.

If there is not such a opening at your current place, he probably knows big level citizens at other places too, so he can recommend you in.

But not if you are going to fly stale the handle and have a sneaking suspicion that lawsuit over an inane joke that he probably be just motto to break the conversational ice.

See how it works very soon? :)
You are obviously equipped to move on.

Do so by looking inward at what you want instead of what you don't enjoy.

Then, focus on what you want and seek out the appropriate training or teaching to produce that result.

You created the bussing job for 2 years so very soon CREATE something you want that will not only bring you JOY but will also result within more prosperity.

an employee is contained by floating status, is it right to hold or not giving their 13th month pay by their employer?
Answers: The 13th month is a bonus unless it is specified contained by the contract.
Bonuses are at the will of the employer
Every employee, regardless of status, is entitled to be rewarded for every hour they work.

An employer can't hold a check for any reason.

Richard
I'm not sure what you plan by 13th month pay, but it is a statute that an employee have to be paid at tiniest once every 2 weeks, of course nearby are some exceptions to the law, some branches contained by state government return with paid once a month though it is surrounded by violation of federal regulation.

Will I get within trouble for this forging?

There was this drawing int he shopping arcade for like some sports car, or somthing and my brother was going it cuz hes 18 and we be like let do it for dad and mom since they werent there and we did and after it came to signature so i of late wrote what i thought my moms signature looked like and i dropped it surrounded by, but i wanted to clutch it out but it was too unpunctually, what do you guys think?
Answers: no..i tight-fisted...it's illegal to forge a signature but I importantly doubt if your mom wins a saloon in a drawing that she's going to bring up to date them to pass it on as her son "forged" her signature.

Anyway...most of those drawings are really in recent times marketing tools to get your identify and address for other unrelated advertising to be sent your instrument.
well, here is no problem unless your mom wins. Then she will enjoy to say its her signature, which, she probably would if she won a coup¨¦.
Forgery is falsifying signature or documentation, and usually intent to be paid a profit or defraud of money or goods is a required proof. But, again, if your mom win the car, I doubt if she would speak anything except. 'yes, that is my signature'
Don't even verbs about it.
Nobody ever win those things anyway.
Why didn't you let your mom sign it if she required to bother?

Last month, I be pulled over by an obnoxious police offer and be issued two tickets, "failing to yield right of way" and "failing to concede traffic circle". I disagree with his claim but I did not argue. I really required to plead not guilty but I've been audible range that there really isn't any instrument of proving that I didn't do it. I wanted to jump to court to at least enter a plea rather (maybe lessen the penalty or not calculation points to my license). Well, on my ticket it states court date on 12/17/07 @ 7 pm. I travel for 2 hrs get to court at @ 5:00 pm to find out court is closed. I speak to the towns populace and they said court is closed. I also went to a local liquor store to speak to the Mayor that owns it but he wasn't here. I went stern to the court house to make sure there's no court and notice the door was accessible. The maintenance crew be there. They said there's no deferred court on Monday's but my ticket reflects court. Now what do I do? Please relieve.
Answers: You best go posterior and prove that you showed by providing your ticket. Go tomorrow before they issue a warrent. That happen to me in 04 and I am still enjoy problems.

What's your opinion of Utah's bright bill for sex offenders?

25 yrs-life for actual rape or sodomy of a child and15 yrs-life for attempted rape/sodomy. Do you discern these harsher penalties will deter this crime despite the perpetrators claiming they have "uncontrollable" urges? Perhaps we'll see if these urges were within fact controllable if the crimes decrease becausethe punishment isn't worth the urge. Personally, i will be glad they are off the streets long-term.
Answers: What this will do is increase the severity of the crime. Sex is regard as one of the biggest evils in america today probably even more so than murder, and society is in a state of hysteria over it. But harsher penalty will encourage perpetrators to step to harsher lengths to avoid person caught.. 25 years to LIFE? why not kill the "victim" and dump the body?

if the severity of the punishment exceeds that of the crime than the crime will inevitably increase surrounded by severity to match that of the punishment.

And it seem possible that this law is aimed at picking on homosexuals as you said 'sodomy'... sodomy contained by itself is not rape.
I have a problem beside it.

The penalty for raping a child is immediately, effectively, the same as that for slaughter one.

Since a murder is in nonspecific far harder to prosecute than a child molestation, because of the lack of witness nouns, I see a potential for an increase in molestors whose victims voice "I'm going to tell Mommy" massacre the victim.

Richard
The problem beside these laws is that they in reality make it more difficult to prosecute the cases. Child victims do not cause good witnesses. Recent decision written by Justice Antonin Scalia make clear that criminal defendants will go and get the opportunity to cross-examine these witnesses (undercutting some laws passed contained by the 1980s to minimize the trauma of these cases on child victims).

One way that prosecutors have to resolve these cases was to use shorter sentences and later hope that the defendants were latter found to be sexually violent predators. At the fundamentally least a plea to a seven year sentence assured that the defendant would enjoy to permanently register as a sex wrongdoer.

The reality is that no sentence will hold a deterrent effect on sex offenders because so few capture caught. All that these new law will do is guarantee that more of these sex offenders will progress free by eliminating any risk of going to trial.
the tenet is not that harsher enough for me..
it is zilch to the law here surrounded by
Philippines were rapist other get demise penalty
if convicted...

peace out.. ^_^v
I meditate that is a really polite bill personally. Why would an fully fledged rape a child in the first place? If they construe like that consequently of course they should be locked up for a long time. I know I wouldn't want anyone raping my children.

And if they do it once, within is a good uncertainty they might just do it again.

Ron Paul supporters, questions for you.?

I hold a few crucial questions that entail answered. If he is a libertarian as he says, how can he deny women free choice contained by the matter of abortion? Also, do you agree beside his idea to drastically scramble back the military and continue a policy of complete non-intervention. I am adjectives for scaling down the military, we spend more than the other 192 countries combined. Ron Paul have made it clear he wants a extraordinarily, very small defending force only. He's also said he would never intervene surrounded by genocides, for instance he would not have intervened contained by Rwanda, and would not intervene in Sudan. How do you discern about this? In a radio show my father runs here surrounded by Des Moines, IA, he was asked if he would hold supported the interstate highway system had the impression been proposed while he be president. He quickly replied, logically not, and continued to say that it be wasteful governing body spending on Eisenhower's part. Your thoughts?
Answers: "About 52 years ago President Dwight D. Eisenhower signed into imperative the 1956 National Federal-Aid Highway Act and since 1990 referred to as the Dwight D. Eisenhower System of Interstate and Defense Highways. He authorized the connectivity of 41, 000 miles of high feature highways across the United States. It would be financed by a combination of the Highway Trust Fund, federally imposed user fees on motor fuels and state user fees.

Eisenhower be prompted to persuade the nation’s ancestors to build the interstate system, as a matter of national collateral. Although not at war at the time, he believed it be imperative the interstate be designed for mass evacuation of cities in the event of a nuclear attack, surrounded by the era of the Cold War. The Act dictated that one out of every five miles must be straight, in writ to use as airstrips in times of time of war or other catastrophic emergencies...

And to that cessation, the success of national defense be dependent upon the navigability of large numbers of military personnel and their equipment during such a crisis. And even today, 75% of the interstate highway system represents the Strategic Highway Corridor Network (STAHNET) utilized by the U.S. military."

Since the Highway's are already nearby, and provisioned under National Security, I don't cogitate it's really wasteful spending. Federal coordination of highway is mostly of historical interest anyways these days. I would resembling to hear/see your source (if possible, not that I don't believe you). Even as insignificant this issue is compared to the problems facing us, Ron Paul's supporters want to know every detail of the person they support, virtuous or bad, and weigh it as expected.

The abortion answer you got, is roughly the gist of it, IMO, no candidate have a solution that could possibly please everyone.

I don't think we should directly intervene contained by genocides, but the news should report it, and allow race to donate to the cause, so possibly the UN or some NGO could take assistance of it. China spends no money caring in the region of genocides, why are we stuck with the bill/blame/ramifications/problems? I know that sounds cruel, but I try to sometimes think something like it logically. We haven't really intervened in most countries within such a way, that it really benefited anyone exactly as planned, we obligation to fix our own problems at home first.

Getting us out of defending borders in the middle east, and starting to guard our own, that's icing on the cake. I would like to see the military fully functional, and arranged, but only achievement in retaliation, not agression and occupation.

Actually, surrounded by full circle, Eisenhower, in 1961, during his goodbye address - warned us of the Military Industrial Complex, and prophesied some of what is going on today beside mega-corps, oil industry, and military/news adjectives tied into one giant behemoth that even Ron would have trouble taming.

I will vacate you with an excerpt of that speech, and thankfulness for your question!

"A essential element contained by keeping the peace is our military establishment. Our arms must be mighty, ready for instant endeavour, so that no potential aggressor may be tempted to risk his own destruction.

Our military association today bears little relation to that prearranged by any of my predecessors in peacetime, or indeed by the combat men of World War II or Korea.

Until the latest of our world conflicts, the United States have no armaments industry. American makers of plowshares could, near time and as required, make swords as economically. But now we can no longer risk emergency improvisation of national defense; we own been compelled to create a irredeemable armaments industry of vast proportions. Added to this, three and a partly million men and women are directly engaged contained by the defense establishment. We annually spend on military security more than the network income of all United States corporations.

This conjunction of an immense military establishment and a massive arms industry is new surrounded by the American experience. The total influence -- economic, political, even spiritual -- is feel in every city, every State house, every department of the Federal government. We make out the imperative need for this nouns. Yet we must not fail to comprehend its grave implication. Our toil, resources and livelihood are all involved; so is the fundamentally structure of our society.

In the councils of government, we must guard against the achievement of unwarranted influence, whether sought or unsought, by the militaryindustrial complex. The potential for the disastrous rise of misplaced power exists and will persist.

We must never permit the weight of this combination endanger our liberty or democratic processes. We should take zilch for granted. Only an alert and knowledgeable citizenry can compel the proper meshing of the huge industrial and military machinery of defense next to our peaceful methods and goal, so that security and independence may prosper together."
Ron Paul believes in the constitution which mode his personal beliefs would not dictate what is legal and what is not. He would give up your job the abortion issue up to the 50 states and the people of our country.
I do agree beside his hope to scale wager on the military and his non-intervention policy (please be aware nouns is not the same as isolation) and his "extraordinarily, very small protective force" would only be small contained by comparison to the troops we have presently. He wishes to bring our troops home so as to have the dexterity to actually protect our borders from adjectives enemies.
I know it sounds cold-hearted not to intervene when other countries are having problems but it is really none of our business and our present parliament is way too picky give or take a few who they help and why anyhow. There is other an ulterior motive behind their interventions, so I deduce it is better to stay out of it. Thanks for the questions. Ron Paul 2008!
It's interesting that you bring up two issues, abortion and genocide. Abortion is genocide. It is the slaughter of a class of people, within this case, the unborn.

Ron Paul is individually opposed to abortion. He have delivered over 4000 babies. That said, he realize that it is a state issue, not federal. For example, murder is a state crime. It is covered in state statutes and prosecuted contained by state courts. He is correct according to the Constitution.

With regard to the US involvement to prevent genocide, how can this be sound? Exactly when do we intervene? As I said, abortion is genocide. Should we invade a nation that practices abortion? Who gave us the authority to be the world's policeman? Who give us the obligation? Who are we to wish what is correct?

We either follow the Constitution, or we continually dance to war against enemy that our politicians create for us. They fan the flames of indignation by demonizing another nation. It be ok to hate the Nazis, but the Communists be our allies. The Communists under Stalin in truth killed more general public than the Nazis.

This is called selective indignation. Our politicians desire that we need to stir to war against this nation or that. At matching time, another nation is practicing the same crime, but we don't appear to be concerned.

No, I think that we own to follow the Constitution and the advice of George Washington: "Beware of foreign entanglements".
First of adjectives, an unborn child is not a blob. An unborn child can feel dull pain by the time most abortions are done - within the first trimester. The baby's heart is battering and the mind is very moving. The baby know the mother's voice and becomes upset beside loud noises. The little one has coat, fingernails, eyebrows, tastebuds, can suck their thumb - all of these and so much more. These are little unborn children.

What should it be call when someone takes the vivacity of a child?

Ron Paul delivered over 4000 babies and never once saw the necessity for abortion. In today's society, women use abortion as birth control instead of getting their tubes tied. Men force women to seize abortions because they don't want the expense or responsibility of their actions - instead of getting themselves fixed so they don't incentive unwanted pregnancies. The responsibility is with the mother and father who are denying their child the right to energy. The greater responsibility is with the doctor who take an oath to save lives, not bear them.

Ron Paul wants to back federally funded abortions. It sickens me to know that my tax dollars are person used to end the lives of children - genocide next to my tax dollars! Of course Ron Paul requests to end this maltreat. The doctors who lie to their patients something like how babies suffer during abortions or tell their patients that it is not a concrete baby - these doctors are the ones who should be held adjectives for their actions. I find it complex to believe that mothers and fathers would decimate their own children if they understood more roughly their child and what they were doing.

So Ron Paul is following our U.S. Constitution and getting abortion out of federal funding where on earth it never should have be in the first place. It is not up to a President to dictate what the state can or cannot do within that regard. If a President is following our Constitution, consequently they will not force the U.S. citizens to pay for something i.e. unconstitutional - which clearly funding abortions with U.S. dollars emphatically is unconstitutional.

You speak of genocide but give no suggestion. Do you think the U.S. should police the world? The general public of the United States are the most generous of adjectives nations. We try to assist everyone everywhere, but we call for to do this in harmonize. Let us worry more or less genocide in our own country since reaching out to other countries to dictate policy. If our other Presidents were truly concerned almost the rest of the world instead of just their resources, the populace in Africa would not be adjectives to death. Why isn't our military in attendance protecting them from tyrants - or could it be they are not an oil rich country?

We cannot be a giving country if we bestow it all away. If we don't monitor the spending of our nation on foreign entanglements, we will become one of those countries seeking assistance from other countries. We obligation to strengthen our own nation so we can offer give a hand if needed - preferably peacefully first, but never to attack without Congressional approval and short just exact. We should not be the aggressor and attack countries unjustly.

If our military is spread adjectives over the world, how are they able to really shelter our nation? It stands to reason that bringing our soldiers home to assist within securing our own borders would be more important so we don't enjoy terrorists living among us who are waiting for the right time to attack from within our borders.

You can nick bits and pieces of anyone's campaign and turn it against them by taking it out of context - which is what you enjoy done. You seem to have a sneaking suspicion that Ron Paul should answer for the decisions other Presidents made since him. You can't compare Ron Paul to any other President or candidate. No other contender wants to restore our Constitutional system. Ron Paul is for the people of the United States first - formerly the people of any other nation! Ron Paul is the individual one who voted against the Iraq war and is unwavering surrounded by his decision.

Dont' give somebody a lift his statements out of context. Read the whole article and the reason for his decisions. He make perfect sense. He follows and defend our Constitution, something most other candidates don't get the drift. It goes against their purpose of a different world order.

How is the felony murder law honourable for our nation?

There's a lot of information that lead to immoral and inequitable concept of the felony murder law but what give or take a few the pros of it? and in what cases?
Answers: Because it is a deterrent to commit felony. You mean close to if someone dies during the course of a felony, i.e. a cop accidentally shoots another cop during a bank robbery, right?

The cons are resembling highly extraordinary death. There was a shield where a police helicopter be following a ground police chase and collided with another police hellicopter, they died, and the govt. tried to pin it on the fugitive. Where do we draw the queue? The fugitive wasn't found guilty in that casing though.

EDIT: Oh I see, well you are in truth referring to "conspiracy," where at hand is an agreement and there is what is call the "Pinkerton Rule" where if the party who they conspired with kill someone in furtherance of the crime (that be reasonably foreseeable) the other guy will be charged near the principal actor's crime as well.

I humane of think that sometimes Pinkerton liability is a moment ago and others not, but that is an issue of foreseeability and that would be determined by a jury. The best covering to illustrate that would be Pinkerton v. United States.
Because if there wasn't a felony murder imperative people would be popping respectively other on every street corner?

Richard
Its there for the purpose of "deterrence".

An armed robber know he will only bring back 2 years for getting popped in a hold up. Who care? Its 2 years and he needs the money for his strange Air Force Ones.

If he knows that he may be getting 25 years for those unknown Air Force Ones, he may think twice roughly it.

That 25 years, is expected to jar a selfish guy lose and force him to deem of the consequences of his actions for a moment more.

This all notion though. Lets not forget that our criminal pretty friggin dumb and his actions are base on things like floor instinct, drug addiction, and a predatory mind set and not logical thought.

The only agency to get numbers would be to interview those convicted and ask if it crossed their minds.
