How can you be found innocent of a crime, but still held liable in a civil suit?
My request for information stems from O.J.'s murder trial, where he be found not guilty of the crime, but now owes $30M contained by the civil suit. Isn't that hippocritical?Answers: in a CRIMINAL proceeding, in attendance has to be PROOF of guilt BEYOND A REASONABLE DOUBT---in a civil casing, there does NOT own to be such proof... just the gift to be held liable.
The different court systems have different burdens of proof. To be found guilty contained by a criminal proceeding, the state must show beyond a reasonable doubt that you are guilty of the crime charged. Beyond a defensible doubt is a difficult burden to meet. In a civil baggage the plaintiff must show by a preponderance of the evidence that the defendant is responsible for any damages. Numerically, a preponderance of the evidence is a showing of a 51% certainty that the defendant is responsible. Beyond a fine doubt requires a showing of guilt closer to 100%.
This has already be asked and answered.
OJ's case is not hippocritical. In criminal, you own to be found guilty beyond a reasonable doubt. In civil, the pronouncement goes contained by the direction of preponderance of the evidence. Did you never take a civics class?
Because he be guilty as hell, but the jury blew it big time!
It's not that he was found "innocent" - It is that the jury could not find him guilty "beyond a all right doubt" - which is why he is held civilly liable. I think it is species of like "this is the best we can do because we know he is guilty but we don't be aware of it was proven beyond a fine doubt" -
Because OJs trial was a crime contained by and of itself. Puniative damages means that he be found guilty by evidence and actions even though a jury couldnt verbs their head out.
Nope. Criminal cases are base on "beyond a reasonable doubt" or close to 100%
Civil litigation's are base on a "preponderance of evidence."
Which means if the jury or referee is more than 50% certain that something happen one way or the other, he can rule within that way's favor.
In criminal proceedings, proof of guilt must be established "beyond a reasonable doubt"; which is 100% resolve. All 12 jurors must be unanimous with the judgment, whether it be for conviction or acquittal; or a hung jury may result, which my consequently result in a retrial or the defence being dropped.
In civil proceedings, proof of culpability is base on a "preponderance of the evidence"; which basically is a adjectives sense assessment of responsibility. Only 9 out of 12 jurors need to agree on a judgment. If a defendant is found responsible, a judgment is enter against the defendant. Failure to pay the decision may result in criminal prosecution.

Can someone help me please. I have a court date on 9/18, the complaintaint didnt show up for court. Now when i went up in that the arresting officer said that there be more warrants that they considered necessary to serve. My question is is that lawful? Someone help me.Answers: They can do anything they want. They do not have a time agenda other that the statute for which the law be broken.
You were surrounded by court for the original charge (or charges), the court date applies solely to that charge (or charges) which were timetabled in your papers. Additional charges can be brought, depending on the severity of the alleged situation.
Sounds close to you are in a great deal of trouble, get a legal representative. Yahoo answers is not the place to get solid official information.
You need to grasp an attorney. Usually the complainant doesn't have to be at hand if the case have already been proven, or if it's a criminal armour, the person who complained usually isn't within because the prosecutor has taken over on behalf of the race. Tell the judge at your subsequent hearing that you obligation to be assigned a public defender, or phone the public defender's office surrounded by your area.
Discussion question?
Meyer, Nap, and Cavanna establish a partnership to operate a glass washing service. Meyer contributes $10,000 to the partnership, and Nap and Cavanna contribute $1000 respectively. The partnership agreement is silent as to how profits and losses will be shared. One month after the partnership begins operation, Nap and Cavanna vote, over Meyer's objection, to purchase another truck for the firm. Meyer believes that because he contributed $10,000, the partnership cannot cause any major commitment to purchase over his objection. In enhancement, Meyer claims that in non-attendance of any provision in the agreement, profits must be divided within the same ratio as means contributionsAnswers: if they are 50 - 50 partners after they can do what they want even if they didnt put in as much money.
Meyer's right.
Now start fascinated in arts school.
If they are a "partnership" then things must be devided equally, and if voted against, regardless of the contributions, the one can be established against or even done away with.
When you dispense your money to something then that's a risk you are feeling like to take; losing it.
Next time write up a specific contract that you are feeling like to live with and also not ready to budge from and see if the others are willing to sign and date it and return with it notarized, otherwise, no matter the money put within, you're on the same stratum as the other partners.
Try the Homework sector of Yahoo Answers. If you do your own homework, you will learn how to write a contract contained by business partnerships.
Why do people procure upset when I check African-American on forms?
Since they claim that all hum,ans started contained by Africa, I fail to see the problem, or is science lying to us?Answers: If you don’t fit the definition consequently you are messing up the stats.
Its not about origins, it's almost color.
You can't have affirmitive endeavour without racism.
Well, riddle me this-
What do they phone call a Caucasian African that becomes an American citizen. They can't be an African American- we already own those.
Now, if we have Italian Americans,Mexican Americans, Greek Americans- adjectives having family unit ties to the former of their titles- then you enjoy African Americans who may or may not have ties to Africa-they gain their former title with the sole purpose because of the color of their skin.
Did you know that Hispanics don't have boxes on most forms until tangible recently- that they were considered Caucasian for lots of statistical information collections.
aren't black and white relative?
i mean if i stand subsequent to another alien- a white one- if i am darker- does that make me black?
If i stand subsequent to another alien- a black one- if i am lighter, does that make me white?
I am african. we adjectives are. I am just an alien gentle.
If you aren't a black American, you aren't an African-American. African-American means black American.
Certain law in the United States be meant to benefit black Americans. It confuses things too much if a white guy claims to be an African-American. Don't be a trouble inventor and don't try to seek an profit to which you are not entitled.
What kind of idiot is Ernie Chambers He is have filed a lawsuit against God. What are the citizens of Lincoln th?
thinking?Answers: I think if you read the in one piece story about why he did this, it will engender sense. I just have an idea that it will not stop the flood of frivolous lawsuits.
You obviously missed the point of the lawsuit. Did you hear what Ernie said? He is making a point in the order of frivolous lawsuits. He said that not all injustices enjoy a legal remedy.
Our sprite system is being abused and it's get to stop.
In my opinion, no situation what Chambers says is his reasoning, his definite reason is to find his 15 minutes of standing. It is a desperate bid for attention on his part.
Don't know what the relations of Lincoln are thinking but I can tell you how I touch..STUPID !! What's he suing for, the power to go to Hell.
he's not really suing. if you be to read the entire story you will see he's only making a point that at hand are so many frivolous lawsuits out nearby and that anyone can file for anything.
Is it me or are the Goldmans acting like weasles when it comes to O.J.?
I'm not here to argue wither O.J. is innocent or guilty - mute point, also, mute point on the civil overnight case too. But when are you respecting the lost of a loved one or when do you cross the line and are using the lost of a loved one to benefit yourself? At this point the Goldman's hounding O.J. is crossing the file (of course this is my opinion and yes, I own experience in a rebellious crime happening to my clan and I and changing our lives forever - so, the Goldmans are not alone within that department)Of course this is my opinion - and I enjoy found that forgiveness and moving forward with my natural life is the greatest respect I can pay to my loved ones...that me brewing over it and constantly hash it up - does not do anyone good, nor would hounding the individual who committed the crime do anything.
But besides that - the intact book deal and the public statements in the region of O.J.s current status is sounding a little weasely...approaching its all be about them and what they can gain from it.
Answers: It's only just you
I am with the Goldmans. Murder my son, obtain off and after gloat about it (which is how it would appear to me if I was Fred Goldman) and I would be ticked too. They own a judgment against him because they want him to be punished by have no money. When he breaks into that room and yells "You get my stuff" what is he talking almost, he isn't suppose to have any "stuff" (memoriabilia).
I would be blissful as could be if I was Fred Goldman and hoping the man get lots of prison time since I would see that he got stale for killing my son.
I agree near you about forgiveness but you slaughter my son (if I had one) and forgiveness from me would be pretty concrete to come by.
OJ seems close to an arrogant sociopathic jerk and it is strong not to gloat about it.
are you kid me?
the goldmans are doing exactly what they should be doing. you say that they should should respect a loss of a loved one? they are doing lately that. oj walked. the man kill their family extremity. how can one possibly get closure from that, i'll transmit you how to make him as miserable as possible. what they are doing to oj constantly getting surrounded by his face making his go, a life of hell.he's not nearby yet so they are making enthusiasm on earth a living hell for him.
it's not roughly gain off his book (that i cant believe that he wrote to trademark money off of the individual he murdered), dispicable. they just want partly of his money off the book that he have every right to write. remember he wasnt convicted so he get's to write that book, bad bite or not. i'm sure if they could take adjectives that money they wouild. they feel that if they cant stop him from writing the book consequently do what they can do not allow him to get rich bad of it.
you say theres such a item as crossing the line? your undeniably right. i know that statement was towards the goldmans. but, i am my self putting that toward's oj. he crossed the splash when he murdered his wife and that other guy. he's a MURDERER and your worried about the victim's crossing the procession? by hounding him? did you read your statement here before you posted it?
if someone kill one of my baby's and he got bad scotch free. he used my childs death to seize rich off of by writing a book, at hand is no way surrounded by hell would i allow oj to have one solitary afternoon in his natural life go by beside out me causing him to one hell of a light of day. he might not be in lock up but, he will most definetly wish that he be in send down or dead!
how can one verbs if every time you turn around your hearing in the order of oj's wonderful accomplishments. their family member' limp in the grave and he's throwing a celebration making money off her loss by his hands.
the man evil.
now he's contained by more trouble? robbery, gun's. the guy is no good. cant you see that. or are you so numb from adjectives the horrible things that happen contained by this world.
i think going against the goldmans is insensitive and wrong
Forgiveness my *** . Goldman should excess the guy if he ever gets the hit and miss.

If I had a work, a license, and I was 16 could I emancipate myself lacking my parents signature or approval?
This will be in almost a year when I have a duty that will pay almost 300 a week. I plan on living in a 400 dollar monthly appartment, if that matter in any track.Answers: No, you definitely entail parental approval to do that. I was surrounded by your shoes when I was 17. I never asked for deliverance. I simply told my father that I was departure. He looked at me and said, "I love you. If you need anything I'm here". I never go home. I can't say I regret departing, I grew up very like lightning. It was difficult though. I could own never done it by myself. I lived with my elder brother who was 18. Our apartment sucked, it be dirty, and small, and we had nought. I slept on my mattress on the floor cause I couldn't afford a bed frame. I go through 3 jobs that year. My father visit once. I wasn't home at the time, he cried when he saw what I was sleeping on. I get my break when I moved 20 miles north of the city. I had a better work, making a little more than minimum wage. 70-80 hours a week. I be burnt. I have the smallest studio apartment money could buy. I sold my things to stay afloat and ate dinners at my parents to stay full. My biggest mistake? Not going to my own graduation and continuing to school. I made mistakes as an oblivious teenager that I know immediately make adjectives the difference. I'm 25 years old immediately, I have a 45k a year situation and am struggling to go rear legs to school. Like I articulate, I don't regret anything because I love who I am, but if I could change a moment ago one thing...Good luck to you. Education is number one. You'll realize this following. I know it hurts to be in your shoes right immediately. Take advantage of not have any bills, or serious rules. Save your money.
In most states, emancipation requires you to prove:
1. that you own adequate financial resources to support yourself (rent, food, condition insurance, transportation, etc.)
2. parental consent and/or evidence of abuse by parents.
In broad, the only population that get emancipated are member of the military or those who are married and supporting a family. If neither of those apply to you, I would say-so your odds are highly slim.
just take off
