i am representing myself within a settlement claim against progressive insurance. il was injured, esxtreme sprain ankle and foot overexploit. after the accident my doctor put me on anti epresants, because i couldnt save up the physical regime i used five years earlier to procure off them. in that is no issue of liability. an employeee, took the car from the company, never drove back, ran me down. I escaped by a breath, and contained by the process sprained my ankle. It has not recovered despite physical psychoanalysis, chiropractry and accupuncture/ IL do not want cortisone injectlions. my doctor, after an mri is suggesting ankle fusion surgery. How much should i ask for in compensatory damages? I am also seeking punitive damages. The owner of the cleaning company that owns the cars give the car to an unlicensed driver. This is the third luck, in a town of four hundred population. I believe it is only a business of time before someone is kill or maimed. We dance to trial in a few days contained by Marin county californi
Answers: I LOVE to argue cases on the law but within this case, you are risking too much on the down side to step it alone. The fact that you are going to court tell me that the "inshorance" company ain't your friend in this situation. ('course they never are).

IF they have their method, they will be going for a dismisal.

As much as you may dispise them, they (lawyers) are a necesary evil in our system. Like sharks, they provide a service, but adjectives to often they get hold of a bit out of control.

The issues within a court of law enjoy not so much to do with WHO is right and who is WRONG, but fairly about PROCESS. By that I have it in mind that the court system (not the Judge Judy circus you see on TV) is about protecting individual rights. Don't look presently but the big bad inshorance company is an individual too.

And THEY KNOW their rights. You could produce ONE simple mistake and the trial could end for you near you getting nothing but directions to the door.

IF the issue be so cut and dried for your side, they would have NEVER agree to this go to trial. Just resembling the constestants on Deal or No Deal who THINK they have the $1,000,000 luggage, as they get closer to the ending case (trial) the merchant banker keeps trying to buy that baggage for as little as he can.

Faced with solely two cases left, $1 and $1,000,000, the merchant banker ovbiously knows that you own a 50/50 chance of drawing the big money so he will split the difference. But if the choices are $1 and $500, he will STILL opt to split the difference, except that the difference is presently only $250.

The reality that you are now contained by court tells me that the inshorance company seem to know that you ain't got no money surrounded by your case to quibble with and they are liable, need I articulate it, are prepared, to go surrounded by front of a judge to see it through.

You don't have need of tips on cross examination. You necessitate a phone number for a good advocate.

PS your asking for punitive damages is a waste of your well-mannered time. Any punitive damages awarded generally run to the state.
You are really brave and I think that is to say great that you have contracted to represent yourself. I have have very fruitless experience with attorneys. I hold represented myself three times and won. When a let an attorney represent me I lost big time. (I should enjoy gotten a large settlement from a unpromising accident where on earth I was hit from aft at a high speed while waiting to form a left appendage turn.) I got my saloon partially fixed and going on for 4000 dollars of over 30,000 dollars in doctor bills salaried. I am permanently disabled and within lots of pain adjectives the time, without any medical. I honestly believe my attorney be paid past its sell-by date.

You need to numeral out how much money you are losing each year from your injury, your doctor bills presently and in the adjectives... Add them all up and any other expenses.

Do you have to know the object an act is angelic in direct to perform the accomplishment?

Answers: You must be thinking of something specific, no?

In general, I'd enunciate it's good to know common sense an act is devout. But of course nearby are exceptions. My physician tells me to hold certain medicine, make unquestionable lifestyle changes. In some cases, I don't know how or why the prescription works. Sometimes he doesn't know either. Occasionally we hold to trust the experts.

We give a infant some milk, and he drinks it, then digests it, later eliminates it. Does the babe know how or why these actions are honest?

ADDENDUM: Okay, now that you added your explanation.. I deem that they did not mean that you hold to know the *reasons.* Rather, they were chitchat about the concept of "reason" --- which vehicle something like, "the fitness to think reasonably." So they are saying that, unless a anyone can think reasonably, it cannot be ethical.

Now is that really true? Well, it makes sense to me. Animals may sometimes achievement for the good of the group, a bit than based on self-centredness. But if they are doing so purely by instinct, and not because they have thought the situation through, I would not call for that behavior "ethical," would you?
Not me. I've done a few things that I didn't know was dutiful or not. I did them because I hadn't done them before and required to know what they were resembling.

Is it a law that states when a customer uses a CreditCard the clerk must verify next to a photo ID?

Answers: No, there's no law on the subject of this, but stores do have policies more or less it. If the store's policy is not to take credit cards minus photo id, next it's legal for them to have/follow that policy.
Nope, its style of rude to the customer not to though.

i didn't sign it and its has be almost a month already.. 3 days a go i recived a phone up from my supervisor saying if i don't sign and she 'll hold to make adjectives the way down to put together me sign than she will...? basically its thretening me...
Today my coordinator departed me a message that my dead string is tomorrow at 4:00 pm...

Are they allowed to force me in such a channel to sign it ?
Do i have the right not to sign it if i don't agree?
What effect my signature might effect me?

And , what if i give her my two weeks consideration, can they still force me to sign the letter? ( although i dont owe her any two weeks see according to the papers i signed when i was first hired )

PPPPPLLLLLLLEEEEAAAAASSSSSSSEEEEE HELP!!!!!
Answers: What do you penny-pinching by "force you to sign"? My understanding is that you can be fired for not following information or for almost any reason surrounded by the case of at-will employment. However, I don't see how you can be "forced" to do much of anything. If you are conversation about some other form of force such as physical restraint, later I suggest you notify the appropriate authorities.
You could put your own notations on the letter to enunciate what actually happen, then sign it.

If they don't approaching it, then they can shut up.
You may be playing chicken. Your signature might simply acknowledge that you received it. refuse to sign may be grounds for termination. Your call.
By the channel, if you give your two weeks catch sight of and don't have another career lined up you will not be eligible for job loss comp. And if you give two weeks concentration, they can just report to you " don't bother."
You will have screwed yourself.
Don't ever sign one. Simply write your edition of events on it and give it spinal column to the manager.

Pepper spray laws?

i live surrounded by california and i am buying pepper spray for my mom for christmas as a safety piece. i need to know if you own to be 18 to purchase it and where to purchase it. thank you for reading and god bless :)
Answers: Pepper spray devices are opening gas weapons below California law. (Penal Code clause 12401.) It is illegal for minors to purchase or possess such arms. (Penal Code section 12403.7, subd. (d).) You'll stipulation to find an adult to buy and pass it to your mom.
I live in california too. (: Yay, california pride. Ok moving on to the question--
I don't construe there's a pepper spray law... I own a friend who isn't 18 yet, and she in truth got one... if she ever come across a dangerous individual, she would be like, "S-stay fund! I'VE GOT PEPPER SPRAY!" Lol.
It is absolutely permissible to carry pepper spray and use it to protect your personal sanctuary without have any special state or federal permits. CA law do regulate the size and/or weight of the defense spray products you can get and buy. The legal container size must be equal to or below 2.5 ounces of helpful product. There are many pepper spray items and models that comply beside this state set standard (see list below).

The pepper spray carried, shipped, sold or used surrounded by California should also be labeled with a limiting stating that the product is only intended for self-defense. In common, most state laws (California included) enforce that pepper spray should singular be used in self defense situations where on earth you fear your duration or safety is within danger. Illegal use of pepper spray products (perhaps dispensing them out of anger or as non self defense hostility against another person) can bring fines of $1000 and up and/or three years in prison.

Not sure roughly minors -- call your local police station and inquire. Or hold your mom or another adult phone.

What is the legal age immediately that you can leave a child at home for a couple of hours on near own?

Answers: I think contained by the uk it is 14. My son is 13 and I wouldn't be happy roughly leaving him on his own for a couple of hours.
Home alone rules alter from state to state. Here is what I found on the internet
===================
United States
http://www.nccic.acf.hhs.gov/poptopics/h...
Most States do not have regulations or law about when a child is considered frail enough to concern for him/herself or to care for other children. Currently Illinois and Maryland hold laws address this topic. States may have guidelines or recommendation. These guidelines are most often distributed through child protective services and are administered at the county smooth.
==================
Canada
http://www.safety-council.org/info/child...
The age at which children can legally be moved out at home alone for short periods of time vary from province to province, from 10 to 12 years. However, a 1999 report commissioned by Health Canada found that parents request "home alone" courses for children as young as order three
==============
UK
http://www.nspcc.org.uk/HelpAndAdvice/Pa...
The law does not set a minimum age at which children can be moved out alone. However, it is an offence to move a child alone when doing so puts him or her at risk.
===================
Australia
Same thing- No set age limit.

What does the regulation say within Australia?
http://raisingchildren.network.au/articles/h...
There is no actual law that states at what age children can or cannot be gone alone, but the law is clear something like the responsibility of parents to look after their children.

In many cultures it is usual for children to thought for brothers and sisters.

While different societies have different customs, contained by Australia there is a trial obligation for parents to form sure that their children are properly looked after.

Parents are expected to provide food, clothing, a place to live, safety and supervision.

Parents can be charged next to an offence if children are departed in a chancy situation and are not fed, clothed or provided next to accommodation (in South Australia this is section of the Criminal Law Consolidation Act).

The police or Children, Youth and Family Services (part of the Department of Health in South Australia) can remove children from situations where on earth their safety is surrounded by serious danger and here is no guardian present (Children's Protection Act, South Australia).
Can parents leave elder children in charge?

When a child or human being under the age of 18 years (for example, an elder brother, sister or teenage friend) care for children, the question of negligence or liability could arise. You as a parent may be held responsible for the carer as in good health as your own children if something goes wrong. For these reason it is better that carers should be adults. A person who is still rightfully a child would not be judged against the standards of responsibility expected of adults.
In Uk it is 13 yrs weak.

A lArge % of convicted prisoners have mental problems, how are they address?

how could/should the system be addressed?

thanxs within advance!!!
Answers: welll mostly they are not address very economically. Or are dealt near ok in prison but within is nothing to assist them when they get out so are probable to reoffend. Very tough question - a great deal of money needs to be put into public form to deal next to this. They say prevention is better than the cure, so possibly mental health desires to have plentifully more attention in standard, and work needs to be put into diagnosing problems contained by kids/teenagers
Are those mental problems diagnosed before or after entry into prison?

Legalize Drugs?

Hi guys,

My name is John Shaw, and I'm an Independent Candidate for the Florida House of Representatives, District 9.

My primary focus is climax the drug war, but my conversations own so far come up short with most of the society in my District that I've talk to concerning the matter. Most general public either enjoy no opinion, or are completely clueless as to why anyone would want to actually standardize drugs.

Simply looking for opinions.

And hang on to in mind, I'm not condoning the use of drugs, I'm simply stating that the law currently prohibiting drug usage in this country are ineffective to the exact of which they are trying to win over.

And yes, I did just use the word prohibiting.

(see prohibition)

(and why prohibition did not work)
Answers: As much as it leaves a desperate taste within my mouth to say this, I suppose we would be better off surrounded by the long run if we just legalized drugs.

I one-sidedly can't stand being around drunk citizens, let alone populace on other mind-altering substances, but I can look at the issue objectively.

In my opinion, here are the possible benefits to legalize drugs:

1. Opening the doors and options for the medical pasture. We've all hear about the pro-pot movement among cancer patients and whatnot. Truthfully, I'd filch non-addictive marijuana over a highly-addictive prescription painkiller any afternoon. Funny how the latter is perfectly officially recognized and expensive.

2. Reducing over-crowding in prisons and other directive enforcement issues. How many society are sitting in put inside over minor drug offenses? I'd rather see the money for directive enforcement go towards preventing horrific crime rather than busting a guy on his path home to do drugs in his living room.

3. More age group for the economy. How copious drug dealers do you know who money taxes? They tax cigarettes and alcohol adjectives the time - why would other recreational substances be any different?

4. Put the warring drug gangs and shady dealer out of business. Who do you think is going to hold the lower prices... Joe Blow in the gloomy alley or Wal-Mart?

5. Allow citizens the choice to take responsibility for their own appointments. Treat drugs just as we do alcohol when it comes to crime. Perfectly legalized, but if you do something stupid while under the influence, you will compensate heavy consequences.

I don't buy the arguments that I've hear along the lines of "If it were permitted, than everyone would do them!". Honestly, if someone is determined to try drugs, they are going to try them regardless of what the law say.

Our tax money could be far better spent. I wouldn't be unwilling a few more drug clinics operating for people who want to see the habit, only just as we have AA around very soon.

But as it stands now, constantly throwing money at the drug trafficking and trying to stop the dealer and users just isn't working.
Yes, decriminalize drugs. Human beings should reasonably be allowed to put drugs into their bodies, assuming they are adults, and not intoxicated while driving, and other common sense things of that spirit. Smoking a joint and selling dope to kids are two entirely different things. The period of war on drugs has sucked billions of dollars into a black hole and not produced a safer, saner society.

It is simply stupid to arrest and hold thousands of men and women for drug possession alone. Educating youth about alcohol/drugs/tabacco is smart. Scare campaign, drug wars - this isn't eliminate drug use or drug abuse.
