How much time will one serve for these charges?
If one got out of prison four months ago (26yrs old) next two months later get caught being below the influence, spent four hours at the local police station and released but never made it to court. Then got arrested for august theft auto two months following...how much time would one serve? Including the time they would be given for violating parole? And they are a California resident.Serious answers merely
Answers: It is hard to enlighten for sure without knowing what the offense be that resulted in the prison commitment. Being beneath the influence of a drug is a misdemeanor with a 90 year minimum and a one year maximum. (Health and Safety Code section 11550.) Grand theft--auto can be charged as a misdemeanor next to a one year top, or as a felony with a selection of punishment of 16 months, 2 years, or 3 years. (Penal Code sections 487, 489.)
It is predictable with his copy that the charge would be filed as a felony, not a misdemeanor. He can go and get up to one year on a parole violation.
He could bring back an added one year for the prior prison term. (Penal Code article 667.5.) However, if the prior is serious or violent felony, making it a "strike," it would double the possible sentence on the investigational felony offense (but not on the misdemeanor or parole violation).
It is not at all unshakable that all of these different charges could or would result in consecutive sentences.
Well this stint probably won't be so long, but at 26 and someone is still have trouble staying out of prison they are probably going to be in and out for a while.
I'd be more worried just about what the rest of their life is going to be approaching.

My mother works in this private nursing home within Texas, the owner from the nursing home is someone who could careless roughly her employees or any of their concerns, this is a female who charges from the elderlies families more or less $3500 from each creature staying in the nursing home and she have about 12 of them contained by this home. My mother gets compensated bi-weekly and its always matching problem, she has to count her hours on the time card they punch contained by and out with on some weak school piece of equipment because she always get paid smaller number hours that what she works, this employer pays them pretty much whatever she feel like-an example: my mother will work 112 hrs in 2 weeks and she'll reward her 101 hrs regular time and 8 hrs overtime which is ridiculous, this is the same problem beside each hand, and whats worse is each time they transmit the lady who does the time sheets for them and payroll she say "I have 5 children and that she doesn't own time" which is bs, can anything be done? please help!!!!Answers: Report this worthless bastard to the department of labor. Also go and get a lawyer because your mom will necessitate his/her services real soon. I use to work for a local drugstore which I will not mention its term would pay me for 15 or 20 hours but I worked closer to 35 to 40 hours. Your mother should document every week exactly how many hours she worked, exactly what she did recieve wage for, and the instance in which she brought this to the employer attention w/ no result. She should then cart this information to the State Labor Board.

Answers: A simple question which yield a complex answer. Do i "feel" free? By reading your previous post I assume that you are citing freedom granted by a nation, but I feel more freedom is restrained by businesses, corporations, and study institutions. Consider this. In America, the right to bear arms (firearms) is a constitutional right guaranteed to most citizens. This method that if you wanted, you could transport a weapon down a busy city street without consequence. It is an extraordinarily generous freedom. Until you realize that any business, corporation, or any other place that has a toll id number, will not allow you to pilfer them on their premises. What are you supposed to do, leave it on the street? I believe as a country, America grant an extraordinary amount of freedom, but lesser bodies nick much of it away.

I've be having probelms next to my manager. He's a solid, lazy, sexist pig. The other mediator has notcied, but we've adjectives been complaining too much. Anyway, tonight I be washing the dishes and he come over to me. He looked around, I was working near two other guys one is my boyfriend, and he was holding a piece of butter. When he made sure no one be around, he told me we should have a butter time of war and spread it all over respectively other. I was shocked and he walk away. You will not lose your job, if you do you own grounds for a lawsuit and a fat settlement and you will never enjoy to work again. I think you did right to complain. And adjectives the complaints would actually work to your favor, not against it. But if you complain again (and if this or anything similar happen again), I would suggest avoiding calling the problem manager any name (like a fat, good-for-nothing, sexist pig).
Say what he did, say how it make you feel (uncomfortable, angry, depressed, etc.). But avoid the name-calling or it may come across similar to you are only doing it because you don't resembling his personality, and not because he make you uncomfortable.
And similar to the first one said, keep a log of the occurrence. Maintain a log of the date and time and what occurred (what be said or what he did). If you can convince others to do so it will help greatly. After you've gotten a few date it may help to permit the top management know you're keeping the log (it may get them afraid you are getting ready to sue). A lawsuit is among the scariest things a business can facade (especially if multiple employees are involved), and this should closing with the problem examiner being dismissed.
I would recommend that if he is fired, even after he is fired you should maintain that log. The management may settle on you get rid of the entire "problem" (which they may see as including you), and the log is evidence your advocate could use against the company if you choose to follow legal recourses if explicitly the route they choose to take.
You own to report sexual harassment. There is a casual based on your work history and experience that they could elect to permit you go. It is illegitimate for them to fire you based on the certainty that you alleged sexual harassment, but that doesn't denote that they can't find another reason. If you are a honest employee and they are qualified manager, they will investigate your claims and make a suitable decision in the order of future recourse. They should also cooperate to other people that be working that night and also look at previous incidents if they become relevant.
As far as the actual incident itself, it is really a tough bid. It really comes down to how it made the people around within feel. You enunciate that you don't really care for the administrator anyway. That could be construed as you trying to find the smallest thing to complain in the order of. I am sure that is what he would voice. Also, it comes down to the tone. I have worked within highly sensitive environments and also places that be more tolerant. In both places I have hear language abundantly stronger than what you have alleged.
Overall I say-so this, if you were honestly offended at the comment and the track it was said and not of late who said it, you did the right thing to report it.

I expect the manager know better than to fire anyone for complaining that they're being sexually tense. First, it would open them up to bearing more legal problems, because (hopefully) you would sue the crap out of them. I don't reckon that it was overreacting to share your manager and your boyfriend, overreacting would hold been if you attacked him or demanded that he be fired or something. I've see women sue for thousands of dollars over less -- THAT's overreaction. Just stick to your guns and emergency respect.

This used to be the travel case, but many States hold now adopt catch and release law. Depending on your State, you may be entitled to keep her for up to 3 hours, but afterwards she must be released into her natural habitat. Of course, if you treat her right during that time, she may be tempt to jump the balustrade again.

This is not your conventional war where on earth you have a set enemy, you seizure them, get info and after when the war is over , permit them go. This is a period of war where we don't know who the antagonist even is. It could be a small group of people or an entire religions worth of associates OR an entire ethnic areas worth of people. My cousin just now hit a car by calamity and caused body impairment to the quarter panel of his neighbor's car. Now, his neighbor requirements to take it to a saloon shop and get it fixed for $700 but my cousin's friend, who owns his own shop, can fix it for $650. The problem is his neighbor wishes to take it to the $700 shop and is asking my cousin to settle up for it - Keep in mind that both party didn't report the accident to their insurance company and no police report be written- but my cousin thinks they're ripping him sour soo my question is if my cousin have a right to get the sports car fixed to any shop he wants because he's the one paying for the wrong or does the neighbor have the right to pick the shop because it be their car that be hit.Answers: I would offer the neighbor $650.00 and tolerate him get it fixed any place he chose.

I am thinking about issuing a restraining writ against a family partaker in Ohio (I live within Idaho). If I do issue one, would she have to show up surrounded by court here? Provided yo uhave satisfactory evidence to get a restraining charge it jsut requirres the judges signature and that she is informed of the proclaim, usually by an officer of the court. Dont let the certainty that its state to state deter you if it is the right thing to do. If you are not sure, receive one and ere on the side of caution. I am a Criminal Justice student and hold heard adjectives too many stories in the order of people mortal lax with their restraining instructions.
