Law Questions and Answers

I have a cross-examine about the FLMA Act within Virginia.?

My fiance works two jobs right very soon. He has his full time career at Wal-Mart and then his cut time job at a friend's saloon wash. We are expecting our second child Jan 29th and he is planning to transport off 4 weeks beside me from his full time job but still requirements to work part time at his element time job at the friend's sports car wash considering he only just started the job.

He is ALLOWED to do this or does he hold to take FMLA Leave from BOTH job?? I have tried looking it up but everything I can find lone says what we are ENTITLED to but nil about if you work two job.

Thanks,
Belinda
Answers: FMLA is a federal, not state law. I don't see a problem beside him working his part time mission, if he is on FLMA from Wal-Mart.
He can only run FMLA from a full time job; the cog time job he can not lift a medical leave and still receive take-home pay, he could only request the time bad.

What are the laws put within place to protect farmers in America?

Particularly law concerning debt collections, and waivers to agreements if the business is failing?
How are farms protected?
Answers: I can't find the sites I once have that gives that answer. I stopped subscribing to them after spending the finishing 15 years signing a million petitions to help the small cultivator and only to find the subsidies are going to the huge corporate farmer. Sorry. There is still homily of helping heirs of farmers hold on to their land and not draw from buried in taxes but it hasn't happen yet. There is also still have a word of keeping taxes low enough for the small cultivator when land is at a premium and nation get re-zoned. That hasn't happen yet any. Sorry again, but being a entity whose land be taken by eminant domain for a shopping center and never given a subsidy, I feel we lost the fighting.already.
Usually they are working with smaller bank and people who know them, which help. They take out operating loans to cover the time while they are producing and pay cheque them back when they vend the final product. As for anything like crops, insurance similar to that is adjectives up to the individual producer. There are some subsidies out there, but they are usually not adjectives that much. I don't believe there are any specific law to speak of when it comes to collections or anything like that, that comes down to the individual mound. They do get a honourable chunk back within taxes if they lose money though, which also helps them hang on to on time next to loan payments.

I'LL KEEP IT SHORT:: My husband's currently receiving dismissal, but he just get his old post back.

Will EDD find out that he is working here again, that they hired him back? Or can we maintain getting benefits at least for another month? (He be out of work for a while and we are behind on EVERYTHING and would resembling to try and catch up!)
Thanks!

Any addl. info. you own on this is appreciated..
Answers: Legally, he cannot work and draw unemployment at like peas in a pod time. Now, the LOOPHOLE : Should he accidentally draw a couple extra weeks of unemployment ( wink wink ) He will enjoy to pay it backbone in small portions until it's salaried back. It buys you time to take back on your foot. Trust me, It happened to me once. I overdrawed by one month and have to pay put money on 41.00 per month. I paid it rotten by opening another claim, letting them purloin the whole amount out of 2 checks.
Went wager on to work and it was similar to nothing ever happen.
They will find out that you are ILLEGALLY receiving benefits to which you are NOT ENTITLED due to anyone employed.

Being behind on everything is no excuse for stealing, which is what you'd be doing if you fraudulently retained the benefits.
if they did find out, you will be more behind than you can ever believe.

also i hope you will save for an emergency fund this time. When money is moral put some away.
he MUST returned those checks! You will be fined and have to settle up a lot more when they arrest you and believe me they will!

why risk going to jail
how around stop cheating the government.

we hold enough population doing that for us as it is

and why dont you get a errand?
YOU ARE TALKING ABOUT FRAUD>..

THey will report the minute he is rehired
Ask yourself one question. What is the right entity to do?
What you owe is not relevant. If you get caught playing the system you will eventually PAY the system.
When your husband starts working again, export tax notices will start flowing at tiniest to the IRS and SSA. Don't try to cheat the system/your neighbors.

It's hard financially, but don't put in fraud charges to your list of woes.
Your put somebody through the mill is very strange. You speak that he was on benefit, but he got his assignment back, but later you ask whether he'll be working there again! Which is it???

Regardless, adjectives "Edd" has to do is call for or go to the Unemployment Office, and detail them what his employment status is (he's supposed to do that on a regular basis, anyway, at smallest until his unemployment benefits run out).
How can that not be stealing? It's mugging by deception and fraud. Unemployment benefits are for the redundant. He is now employed in consequence.tada..he is no longer entitled to benefits because it is UNemployment.

If found out you can be arrested for fraud and theft by deceit. You can go to young offenders` institution, you can be fined, and you can (and will) be required to pay wager on all the money.

It is not "his money" it is the government money.
receiving benefits while employed is fraud. At best you will be held responsible for repaying those received funds. At worst you can be criminally charged.

There is a remarkably good luck he will be caught as the company will register his SSN (from time of hire) in proclaim to deduct income rates.
You are required to report any job adapt with the EDD when a translation occurs. If you verbs to receive benefits after he begins working later you are in sacrilege of that and they can and will come after you for the over payment. best to be honest.

Decisions on causation are always problematic and clash near the blauve case exam?

Do these decisions emulate more public policy than the application of rational rules?

Need aid with this press
thankyou
Answers: As far as I can recall Blaue is the valise with the Jehovah's witness and her stabbing - the imperative on causation essentially revolves around the principles that were mentioned surrounded by Blaue ... there are heaps, many cases to rear this up.
I have read abundant of the full text of causation cases ... none of them clash near Blaue.

I think that the tenet on causation is essentially a public policy decision - it's right to remember that there is standard consensus that nothing but the worst medical treatment constitutes a Novus Actus Interveniens

I assume here that this is an essay/assignment put somebody through the mill ... the answers should be in your resume from lecture/class
My advice: read the full set book of your causation cases and see for yourself whether they clash with Blaue - it wont benefit you to gain the answers from Yahoo - research them yourself ... that way you will swot better

If a man dies without a will, who will inherit his property?

I know that the law vary, but if he dies short any will, and has 6 children from 3 wives, what will the final wife and the last child obtain? Roughly?
Answers: Depends totally on the state; there is a pretty apposite calculator here:

http://www.mystatewill.com/
Been here, done this one with my ex-wife's 1st husband who committed suicide.

First of adjectives, no will means that it ends up surrounded by probate. You will need to hire an attorney. Each child will be considered subsequent of kin. The courts usually will split things equally amoung the children. Ex-wife's typically are not considered. If there is a current wife, she may draw from everything. But that is for a Judge to opt.

If there is enthusiasm insurance, that goes to the society listed on the beneficiary page. Typically that cannot be challenge.
Without a will, it goes to:
1. Wife if married (all of it).
2. If he is not married, it will walk to all his children equally!
If you live contained by the US, you should really look at the site wzjip pointed out: http://www.mystatewill.com

Every other answer listed here is incorrect.

It does not run to the state. Every state looks for living, sometime distant relatives, before giving any property to the state.

A conciliator does not decide if a current wife get everything, it is strictly controlled by the laws of the applicable state. The conciliator cannot vary from the imperative.

A spouse does not automatically receive the entire estate in any state. A spouse may receive the entire estate, depending upon the estate's appeal, the surviving spouse's blood relation to the children, and possibly even the deceased spouse's blood relation to the surviving spouse's children.

A spouse does not other receive at least partly. For instance in Mississippi the spouse and the children share equally - if near are three children, the spouse and each child give somebody a lift 1/4.

As said, you must go to www.mystatewill.com and use the intestacy calculator for your state to bring back the answer.

My friend stole from bloomingdales while on probation?

my friend is an idiot, and got caught at his college end january for having a ton of pot contained by his dorm room. he got kicked out of the dorms but not the college and had to shift to jail for a dark. his parents are pretty rich, however, and their lawyer get him out of jail and on probation for a year. he be doing really well and consequently today he got caught stealing from bloomingdales and he's still on probation until january. does anyone know what this will possibly show for him?
Answers: First of all, he will be charged beside a probation violation. He would typically serve out his probation sentence in top-security prison. The courts may and probably will sentence him to serve consecutive sentencing for the petty crime as well. He enormously well may spend smaller amount than a month in sentence to prison. Petty theft is a minor do business " UNLESS " your on probation. Normally you would only grasp fined and probation for first offense.

You said the family have money..He may not have to serve any time within jail. The magistrate may be contained by the holiday season and grant your friend an extension on his probation. I would guess that if the magistrate done this, community service would also apply. Your friend will hold to reimburse the store for the item of course and also the fine that accompany the court's time.

Now, if he shows up to court and doens't seem remorseful of what he have done. The same judge may create an example out of your friend and sentence him to all maximum penalty that he/she can impose.

Where I live, A guy get arrested for DUI on a " RIDING LAWN MOWER "..the court throwed the book at him b/c he didn't show remourse. Granted, it did make National News !

Tell your friend to borrow money from his parents when he desires something, it's better than going to jail. Hope this enlightens you.
hopefully they revoke his probation and tack on 6 months for honest measure

some associates never learn
Deep doodoo. If he spends a ton of money on a perfect lawyer, he can probably avoid intern time. He'll probably get profusely of community service, and he'll be on probation for at least a couple years or more.
You know, when a stooge steals from a store, he's really stealing from adjectives of us.
He's your friend why? ?
Revoke probation and serve jail time.

You may want to reassess you choice to hang out near such a stupid person.

What does a bailiff say when the witness comes up to swear?

example approaching do u swear to tell the truth and i forgot the rest.
Answers: It used to be: "Do you swear to convey the truth, whole truth and zilch but the truth, so help you God?"

But most jurisdiction have removed the hint to God.

Now you often hear some ebb and flow of: "Do you solemnly swear that the testimony you are around to give is the full truth, without ommission?"
"Raise your right foot, place your left on the Bible. Do you swear to speak about the truth, the whole truth and zilch but the truth, so help you God?"

But since we've become a nation of the sensitive, they often in a minute leave God rotten.

What are your thoughts on the Death Penalty?

If a judge or jury ruled out that adeath cost sentence for someone how does this make you surface?

Do you think it's right? If you suggest the death cost such as lethal injection or the electric stool is ok then how do you perceive about the creature that is responsible for making it come to pass?
Should the person starting the fatal injection or turning on the electric chair be responsible for the loss of that person?

Do you not agree near the death cost? If you don't agree with the extermination penalty later what are your thoughts about those repeat sex offender or rapist? What do you think we should do beside them?
Answers: this is tough because I can argue either agency. It is fair, as outlined contained by our constitution and laws (maybe circuitously in the const. but you achieve my point) that if you do certain things, you could die for them. its not approaching they didnt know what the consequences would be, and they chose to chance it. Technically, the "executioner" IS massacre another person, but he is doing so lower than the laws set forth that enjoy been deem as fair and purely. Why keep murderers and rapists alive, when we own to pay to hang on to them that way? Although rehabilitation is possible, at what point would you enunciate "ok, youve had adequate punishment. go forth into the world."?

As long as at hand was a tolerant trial and they were convicted by their peers, they should be put to loss. whats sad is that these days that usually just vehicle a life sentence.
I supported property punishment for a long time, but I have changed my stance over the years, for several reason:

1. By far the most compelling is this: Sometimes the legal system get it wrong. In the last 30 years, over 100 nation have be released from death row after years of internment because they were exonerated by DNA evidence. Unfortunately, DNA evidence is not available within most cases. No matter how occasional it is, the government should not risk executing one single innocent party.

Really, that should be reason ample for most people. If you inevitability more, read on:

2. Because of the extra expense of prosecuting a DP case and the appeals process (which is basic - see reason #1), it costs taxpayers MUCH more to execute prisoners than to impound them for life.

3. The deterrent effect is questionable at best. Violent crime rates are in actual fact higher surrounded by death cost states. This may seem counterintuitive, and in that are many theories something like why this is (Ted Bundy saw it as a challenge, so he chose Florida – the most involved execution state at the time – to carry out his final murder spree). Personally, I believe it has to do beside the hypocrisy of taking a stand against murder…by killing empire. The government become the bad parent who say, ‘do as I say, not as I do.’

4. There’s also an argument to be made that passing is too good for the worst of our criminals. Let them stir up and go to bed every year of their lives in a prison cell, and believe about the freedom they DON’T hold, until they rot of old age. When Ted Bundy be finally arrested in 1978, he told the police officer, “I aspiration you had kill me.”

5. The U.S. government is supposed to be secular, but for those who invoke Christian statute in this debate, you can find arguments both for AND against the departure penalty within the Bible. For example, Matthew 5:38-39 insists that violence shall not beget violent behaviour. James 4:12 says that God is the just one who can take a time in the baptize of justice. Leviticus 19:18 warn against vengeance (which, really, is what the destruction penalty amounts to). In John 8:7, Jesus himself say, "let he who is short sin cast the first stone."
I support the passing penalty. The human being carrying out the sentence is not responsible for the death, the criminal is responsible for his/her own extermination. 2D

Will an employer call you subsidise if you have be layoff?

What are the chances of that taking place?
Answers: It happened to me. The problem is how long it may bear or if it will happen at adjectives. I know people that be laid off from GE Aircraft surrounded by 1994 and didn't get call back until 1999. (They be backed by their Union.)

I be laid off vertebrae in 1996 from my first chore out of college. They ran out of funding for a project and didn't enjoy enough work for everyone. So they out of a job due to seniority, and I had the tiniest.

I spent the next month looking for another mission until my manager call me to tell me they have enough funding to bring me fund.
For rehire? Depends on your relationship with the company and its own ability to hire and rehire or if you are in a grouping. Unions provide in their member of staff protective arrangements that if positions reopen after lay offs and terminations, that union team are hired first for them.

But if you are not in a federation, don't hold your breath since lay offs are part of downsizing and if they are downsizing it is unlikely they will hold the money or resources to bring anyone back any time soon, especially if they can find tentative people at lower salary rather than reinstating some one anywhere close to their old one.
Depends on the plea for the layoff.

Laid off for retooling of the strip - probably yes if you have any seniority and you hold a good relationship near the company.

Laid off due to a failing business - No.
