In states that allow it would a police officer be able to use medical marijauan?

In a state similar to California that has medical marijuana would a police officer know how to use medical marijuana since it's technically legal? I wonder because I expect police get a great deal of funding from the federal lever as well as state and marijuana, even medical marijuana is wrong according to federal laws. Also, within a state without medical marijuana if a cop be involved in a shooting or crash or something he would be drug tested and probably contained by a lot of trouble if he have pot in his system, even if he be not high at the time, so surrounded by a state where a cop be legally using medical marijuana for medical purposes would he also be contained by trouble for having it surrounded by his system. Because of the discrepencies between federal and state laws I thought this would be an interesting put somebody through the mill.
Answers: The federal government have declared that marijuana has no medical use, and and so its possession, sale, or use is wicked in the U.S. (except for severely limited exemptions resembling genuine medical carrying out tests with a license). It doesn't concern what the state's law is--the federal directive preempts. California took that to the Supreme Court and lost two terms ago.

Now, that cop would not be prosecuted underneath California's laws surrounded by California courts by California police or prosecutors, but he could be prosecuted in FEDERAL courts within california by the FBI and US Attorneys.

Whether the cop would be disciplined because he failed to follow a federal, to some extent than a state, law, probably would be handle case-by-case.

Finally, because use of pot at all is improper under the federal system, someone who be harmed by the THC-Postitive cop (say, in a saloon accident) could attempt to use that as "negligence per se" -- because the violation of a society-protecting decree can be used as proof (sometimes rebuttable) that the person who violated the statute acted negligently.

Interesting question.
No..because federal statute trumps state law. Second, employer like the police department can own rules and regulations that are more strict than penal law. So, yes the officer can and will be fired, or not hired, because of this.

Edit: I'm not exactly sure where on earth Bruce J gets his facts from, but even simple possession can be prosecuted lower than federal law. I'm a NYC cop, but I can due the research and find the exact code if you or he would close to.

Also, it really doesnt matter what the areas law are, internal regulations can get a cop fired or not hired, withour reguard to whether or not its officially recognized. In some departments, the use of tobacco is reason to not bring back hired, and even fired (although that rarely happens)
This is a completely interesting question, star.
I yearning I had a legitimate answer for you, but I'm not sure how that would work.

I think though that an officer would not be allowed to use mary-jane regardless of the authenticity.
Pay no attention to that answer by 'zeb25'. There is no federal law that outlaws pot. Federal imperative outlaws the TRANSPORTATION of pot from state to state.

As for the legality of a cop's useage, if it's lawful in the state, a cop can do it. They enjoy all of one and the same rights as a normal citizen.
I cogitate marijuana should be off the lawbooks intuitively...Any naturally growing plant should be.

If a officer is using medical marijuana on duty, he should be punished matching as someone drunk who harms someone similar.

Using any medication should require the user to be at home or a designated usage area for the duration of the effects of that drug.

Psychotropic and numbing medications are surrounded by the exact same boat. People should be tested for those when they are in accident or harm others, be it the drug is decriminalized or not.

Being impared by a substance is being impared.

In your opinion, what public policy or prevention strategy nuance makes the most sense?

law-wise.
Answers: Probably the one where on earth asking others to do your homework is considered cheating. That makes the most sense to me. :-)

Why are these internet sex sting operations not considered entrapment surrounded by a court of law?

Can you explain the parameter of how these types of operations evade the definition of entrapment?
Answers: Lectlaw.com give a good explanation of it (I've regularly wondered the same thing). The push button seems to be whose hypothesis commiting the crime is: http://www.lectlaw.com/def/e024.htm
The officer posing as the juvenile isn't able to suggest any against the law actions. The pervert have to be the one to do so. And has to be the one to turn to the agreed upon place to meet.
And besides, within this instance..Who Cares? lock them up. Even if they were entrapped. They be going to have sex near children. Thats good satisfactory for me.
That depends on the jurisdiction mostly. Not all states enjoy the same standards for entrapment. In undercover anti prostitution operation, the officer cannot offer sex for money. The officer have to let the target brand all the requests. That prevents entrapment.

I would speculate that the Internet sting operation work the same route. The "teen" is careful not to ask for any point. Then when the pervert shows up, he gets arrested.

This works indistinguishable way for any undercover operation. Each armour is different. It may be entrapment if the police go too far. The simply way to experiment it is to take a casing to trial.
All the legalese, no--but here's the generalidea:

Lets take a related example, to start. An undercover officer can apporach a prostitute and proposition her. However, mostly speaking, she has to ask for money--"namea price." If she does not--no matterwhat she agrees to do--it's not prostitution.

The point--the target of the sting must voluntarily and short duress take the initive to commit the evil act.

Now, indistinguishable general conception applies to the Internet. On-line chat--generally speaking, is not prosecutable. However, if a man, having made a "date" near what he belives to be an underage girl, then follows through by coming to bump into her (remember--he is acting voluntarily and without self underany kind of duress)--then his intent is clear. If (this is how it typically is set u) he then proceeds to again agreeto/ask to enjoy sex with a (supposed) minor, that is to say a prosecutable offense.

All of this has to follow specific protocols too complicated to review here. But I hope you capture the point: stings--on the Internet or elsewhere--have to be conducted within a attentively drawn set of rules in orter to avoid "entrapping" the suspect--or any other infringement of the suspect's civil rights.

This sort of thing is other a bit controversial--and I hope it stays that way. Stings are a costly law-enforcement tool. But they should remain suspect--and challenged from time to time--because they are also a tool that can efficiently be misused or abused. So--keep on questioning them--that's the best safeguardwe hold that they wil continue to be used properly--and to stop instances where on earth they are not.
It mainly have to do with the appointments of Scali and Thomas to the Supreme court, in a minute we have Scali Lite and Roberts... It sure meet my understanding of entrapment.. If an officer is the subsequent stall playing footsies with you consequently he should be arrested for whatever that crime is.. If an officer is trying to market you drugs or solicit you as a prostitute. They are the ones breaking the law contained by a country that I thought was America...

As far as the Chris Hansen predator item, my only cross-question is where is the minor? The girl that meet them is over 21. The people that are lying are the ones on the computer... It would be a perfect thing if a report station set up and exposed child predators but when the police get involved, its a setup and entrapment and close to I said in this overnight case there is no minor..
It could efficiently be entrapment. It's up to experienced law enforcement to totally withhold from bringing up subjects like sex and jamboree in being. The perp needs to bring it up and force the issue.

Frustrated..?

My b/f and i have be together a while. well since we got together he be with another girl. she is claiming to be pregnant by him but told him she didn't want him within her life. He is surrounded by a band and i don't trust her. i estimate she is sneaky and vindictive. She is is saying she doesn't necessitate his help immediately but if he starts getting money coming in than i.e. when she is going to want or need him within their life. He said that he's not sure if the newborn is his because she was dating someone a year after they broke up. i told him to get a DNA theory test he has talk to a lawyer and they told him they would glibly grant him one considering the situation. He requests to be apart of the baby's life. He even said he would repay child support. I think his ex is single after money.
Answers: If the DNA test is positive, you'll inevitability to work on your patience near this woman, because if you stay with this guy, after the baby--and thus the baby's mother--will be part of his duration from now on. No issue how you feel give or take a few it.

If it's negative, problem over.
The first item is toget a DNA test first & afterwards If it is his child he is doing the RIGHT thing by wanting to be quantity of this childs life, & it is for the courts to settle on on how much money the child support will be.

Good Luck!

sorry I can`t help more. Good luck.
Although this may do trouble for the family who are have to live with this individual, it is still correct that your grandad should be the one who is getting the carers allowance.

Unfortunately, its a terribly sticky subject.

Being a 'carer' will mean that the 'uncle' is automatically exempt from have to look for, or obtain, a employment. This could be the reason why he is doing it. But you own to know that seeing as he is still living with your gran&pop he may grounds them lots of grief, if this situation comes to light.
The dwp do not embezzle kindly to this, and dont approaching people defraudiong them, which within this case is exactly what your uncle is doing by letting your grandad do everything.

What you should also double, and even treble check, is that your grandad is not 'preventing' your uncle from looking after your nan. Because that can sometimes start too.
Your grandad may feel that cos he married your gran, its HIS brief and no-one elses to look after her. (Its an independance thing, to do near the generation they come from)
So it may be that your uncle is NOT sherking away from his responsibilities after all.
This adjectives needs checking in the past you do anything as 'oldies', bless them, can be real stubborn!!

I also infer that rather than 'putting a spoke within the wheels' as it were, it may be a devout idea, if you do find grandad is NOT the one putting his foot down and stopping your uncle fulfilling the duty, that you mention to uncle that it hasn't gone unnoticed that he isnt doing what he's supposed to be doing, and that 'the family', are as a element (make it known gran&pop arent involved/have nil to do with it, thereby stopping any adjectives hassles to them) are taking steps to inform the authorities concerned.

They will still be capable of get comfort in, singular it will be from a different department. And the money for this will go directly to them and not your uncle. And depending on their income and outgoings, they may not hold to pay for this 'caution package', or may pay a small percentage / ammount.
You can also receive an Attendence allowance so that your gran can get give a hand in as much as she requirements. Even a nurse for overnight so many times a week, adjectives dependant on what she wants and wishes. You sort it all thru social services.

You can catch a home visit from someone at the Pension Credit ethnic group to sort out the financial side of it, as well as your local social services to sort the rest of it. Age Concern are also apt and helpful within that respect too , , as are the Help the Aged.
Hope this helps... but tread wisely, cos your uncle will be put on the jobseekers money, and will notice the financial implication of doing so... any monies that your gran&pop need will be compensated straight to them. UNLESS there is in a minute a system where it can be compensated straight to the SSocial Services or care providers...again something for you to look into.

Make sure to state that you are doing so 'because of the exquisite situation with your uncle & any retaliatory incidents.'
be aware that if you report your uncle he will be prosecuted and will probably be made to settle that money back to the establishment. and get a criminal transcript. sorry! i'm not trying to put you off. it sounds to me similar to he deserves it frankly.BUT!! i'd hate you to progress headlong into a possible family circle nightmare with out you one prepared for it. personaly i think your doing the right piece. i hope every thing turns out ok for you . ((((good luck.))))

Is it illegal for a politician to slouch while he is in organization or campaining?

Answers: no, as a voter you need to be smart satisfactory to figure out when some one is lying and not vote for them.
if beneath oath it is illegal but Clinton get away with it when the dem's said they did not guardianship and would not look at any evidence. just vote to hold their man.
No. It is also legal for a politician to be on psychotropic medication.

They also do not take drug test.
Sure. People lie adjectives the time. There's no law against lying-- of late a law against lying contained by certain circumstances (like surrounded by teh sale of securities, while below oath, while making factual misstatements more or less a product to sell a product, etc...)

Now, even if the runner could be liable for "false advertising" (although he's not selling a good or service; he's asking for votes), liability would almost never be found because most of the statements are statements of "opinion" or of "adjectives possibility" rather than "present fact" or "mere puffery..." adjectives buzz-words the law have created to exempt out certain classes of speech from liability for false hype, deceptive trade practices, etc.

And unsurprisingly, if a politician is TESTIFYING at a hearing (although tremendously few do) they have to be underneath oath, and can be convicted for perjury if, once again, they intentionally make a mistatement of present reality.

There is a remedy, though. Simply vote him out next time.
In Office :
Yes. Paying rotten a Judge with a adjectives commitment of a place in a Higher Court...hmmm unless you take caught it is not illegal but . The cream always rises to the top and close to OJ some just can not serve themselves. Expect numerous Clinton outings this time around. They set the bar and will trip on it. Of that I am spot on. Many do not like self fooled more than once. Being disbarred did not stop WJ from making millions on speaking tours, books and PR. Blowing his own horn if you forgive the pun. "Giving" to his bank accounts & stock portfolios. When he go nuts with the finger on the Chris Wallace Sunday show weeks ago you only knew he be up to his old echo. He is transparent that way.

To embellish on the truth as a Candidate is a time honored tradition within politics. A "lie" is rarely confirmed. And after the reality, hard to prove it. So, off the record here? Good luck.

Thank you.
obviously not.end in most of them do it..and they do it soooo goooood!

In what states is it illegal to be on the cell phone while you are driving?

Answers: New Jersey and New York are 2
I merely read in the quality newspaper over the weekend, California just passed a similar directive.
In PA, if you are in an disaster, the police routinely ask,"were you on a cell phone."
connecticut, thats the merely one i know for sure
Its not illegal to be using a cell phone while driving surrounded by any state that I am aware; it is illegal to use one w/o an hands-free headset surrounded by many states.

NY is one
I regard Conn as well
DC is is unsanctioned.

Its hard to enforce though, so alot of family still do it in DC (drives me nuts when my wife does it within general).
I found myself quite comfortably speaking on my brother-in-laws cell phone soon last summer while driving. As I enter the busy intersection it dawned on me, "wow, I antipathy cell phones! I wonder who saw me talking and thought ,' There go one of those aloof cell phone talkers' ". I don't even own a cell phone, but heck, honestly if the overall perception is that people look stupid when they are driving, all right then put a cell phone within their hands and they'll REALLY look dumb... economically that's the rap I think.
Bottom procession, I delivered pizza for 10 years, I can do give or take a few anything and drive, but some people I in recent times don't trust-at least adequate to make such a imperative worthy.
NOT IN OHIO YET.
virginia and south carolina you have to use a hand free device while driving on the phone.

and when on any military base you cant be on it length

Schools IT Technitions are rubbish, I Wanna Teach Them A Lesson?

Hey,

At my school we own 1 network head and 1 technition.

But they cant do their jobs.

Since my time at subsidiary school (3 years)

I've be able to find minor errors and loopholes, but only just i've been competent to access the 'reports manager' programme which stores your grades, detentions, its basically your permenent register. And its possible to edit/delete stuff in their.

Also today I found a report stored on the "private" server which has the passwords to the school email accounts. And now I can access any of the 800+ accounts the conservatory has (every student have an account, staff, contacts for university etc).

So what should I do? I telll them EVERY time I find something like this, but they DONT DO ANYTHING in the region of it. Also, nearly all their passwords are detault!

What punishment could they distribute me?
Could I be excluded?
Would I go to one of them infantile offenders places?

I merely wanna teach them a lesson, so perchance there do something. Because this time its to deferred.
Answers: I would contact the administration of the academy. Send them an e-mail, and attempt to contact them. If you don't hear back from them inside 24 hours, you might try changing their password on something. Then turn to the office, and explain that you be unable to carry their attention. Also explain you would be glad to assist them with correcting the problem that you created and what you can do.

While here is no way to maintain out the best and brightest, it sounds like they are pretty lax on what they do.

If that fail to get anywhere, indicate to your instructor what you can do -- and if they ask, prove it by giving yourself an A or F contained by their course. Hopefully someone will start to take you seriously.

If you enjoy contact in writing back you begin, and enjoy made attempts to communicate, they should go pretty straightforward on you -- but I can make no guarantees. Be sure to hamper what you do to one individual and follow up with it now -- so they can see the problem and have the solution right near.

But no matter what, try to communicate first. If you attempt to cause appointment after appointment and they don't respond, you have purpose behind what you are doing and no criminal intent.
