Law Questions and Answers

Has justice taken a disappear of abscence?

Parents killing kids and no charges? The McCanns and the Lady who disappeared her baby contained by the car contained by 100 degree weather. Are these courts making stupid rulings or what?
Answers: Ya maybe because the jail are full and they haven't built another one yet. I'm wondering when Bush is going to be tried for treason.
Unless you sit in the courtroom, you really can't engender a call on this one process or the other. You are simply repeating what you hear. To think that the medium gives adjectives the facts is just as insane as thinking that equality is blind.

I'm not saying that you are wrong. I'm a short time ago saying that, if you are right, it's by sheer blind luck, not an external judgment base on the facts.
I agree. Fortunately in most cases the statute does hold murdering parents accountable, but the ruling surrounded by other cases, such as Andrea Yates, I find appalling. Parents routinely leave kids locked within cars; happens every summer. And more oftne than not the parent say he/;she forgot the child was within the car!
So yes, I touch the judges kind grossly unfair rulings. It seem that sometimes the law finds children to be expendable.
I agree.
My kids are on my mind 24-7. I other think give or take a few them, pray for them, check up on them, call them, doing everything for their benefit, condition, safety and eternal destiny.
To check out of a child in a hot vehicle is selfish, reckless and shows that the destination or situation at hand is first on the inventory. Anyone who makes this choice should frontage justice. No excuses.
If you drive in need a license, you risk jail. If you put to death your kid, your excused? Please. It shows she has money.
Why am I not surprised that someone purely had to step there next to the whole Michael Vick and see bs?

Michael Vick's situation has nought to do with see and everything to do with the certainty that he committed crimes and new that he be committing crimes. People are just making excuses for Vick. He know dogfighting is illegal. If you're stupid ample to risk a multi million dollar contract, you're freedom, and millions of dollars in endorsement then you deserve the consequences regardless of your see.

There are more white dogfighters in secure unit than black dogfighters. This whole entry just get a lot of medium attention because Vick is a pro football player. "The man" would rather target poor relatives who can't afford a decent defense, especially since poor empire aren't the ones who are paying uncle sam millions of dollars.

People need to be responsible and stop making excuses for human being involved in criminal actions.

Regarding the Jena 6, yes, this is injustice at work. What's unjust isn't that they're contained by a pile of poop, it's that white students who were also involved contained by beatings aren't surrounded by that same pile of poop. This is surely a case of racism within my humble opinion. And it's such cases as this that we stipulation to be focusing on, not cases like Vick's that don't involve racism surrounded by any way. But we hold to be fair if we are to emergency fairness. We shouldn't demand that the Jena 6 get hold of off. We should emergency that the white students who also engaged surrounded by physical assaults be charged and prosecuted accordingly. And we should also constraint that there be no more use of the words "abhorrence crime" and that they no longer apply in the imperative, because we should not have law for feelings or motives.

As for white population who get stale, get slaps on the wrist, or don't attain charged at all, in good health, this happens to society of every race surrounded by this country. For every case one personality brings up about a white individual, someone else can mention a case involving matching circumstances about a black personality. Sooner or later, yes, someone is bound to eventually run out of cases to mention, but that's not necessarily because of racism. The certainty is that there will other be a racial inconsistency because of the simple fact that see doesn't determine what people do. So in attendance obviously can't be an equal ratio of blacks:whites unloading any given punishment. Surely racism does exist in the sprite system, but we can't fight it. We can't consider see or make law for race, otherwise we are no different that the racist in the equality system. What we have to argument is corruption itself.

Now, to answer the question, I devise justice took a move of absense a long time ago. And it isn't going to return as long as people rebuff to stand and fight.
Yes it have especially when it comes to the double standard of the law. Yes, I am referring to the Black side, and the White side. Look at Jena, La. and the situation in attendance. If you want details... read it for yourself.
Look at the situation with Michael Vick. Can you honestly relay me if he wasn't a pro football player ( and Black) that this wouldn't be happening to him? C'mon. All the White inhabitants making the news surrounded by Tennessee for dog fighting and **** combat don't even see the inside of a jail... permit alone live with the threat of prison time.
What almost the 3 brothers leaving the club within New York earlier this year that be gunned down by the police for nothing? One of those men be on his way to HIS own marriage ceremony... imagine that.
Everyday prosecutors wrongfully incarcerate Black men and boys but are they themselves prosecuted and disbarred from ruling like Mr. Nifong within the Duke Lacrosse Case? I think not. Bottom dash is... they probably DID do it. Some people are awfully sly at covering up their crimes... especially when they have weak money in the kinfolk. Yeah, I said it.
And then near is the White woman in Tennessee that murdered her husband within cold blood and fled to the coast. She was caught and charged next to 1st degree manslaughter and served in the order of 1 month locked up...in secure unit. She was permit out sent to a mental health facility for 4 or 5 weeks and immediately she is free. Oh.. did I mention she is trying to get her 3 daughters hindmost and the odds are contained by her favor? Wow...
You tell me. Babies are gone in hot vehicle every day where on earth I live. The sick *** pedophiles are not being charged next to their crimes, and this is only the tip of the iceberg as they read aloud.
I think it's sickening. I said it earlier and I will say it again... Black Robe White Justice. We obligation to stand up and unite loved ones. The injustices against our families are ridiculous. Do your slice... take your place... and bring back your priorities in proclaim.
The days of blackface and Jim Crow are slowly but surely returning to our society. How long will you allow it to happen?

Selective enforcement -?

How can elected officials choose to give the brush-off the laws of our ground and not be prosecuted for it? Rudy Giuliani knowingly allowed bent aliens to reside in New York City and even brags going on for it. He made a determination that our federal laws be not correct in considering the crooked aliens as criminals. This sounds like another personality in dignified office who take it upon himself to decide what is official and what he can do. Can we afford to have another president who interprets the law as he wants; a party who has demonstrated that he is primed to ignore the imperative of our land? Until our law change (and some do involve to change) illegal aliens are prohibited and allowing safe haven for them is unjust. How can a person surface qualified to be president if he can no follow even our basic law?
Answers: Hey, selective enforcement is what the current president believes in. At lowest possible we wouldn't have to return with used to anything new.
***
You asked: "How can a personality feel qualified to be president if he can no follow even our plain laws?"

The answer is: Arrogance
http://www.truthout.org/cgi-bin/artman/e...

There's a intertwine to an article about 'selective enforcement'. How can Rudy grasp away with it? The same route Bush has. The executive branch is responsible for enforce laws. If the courts and legislature don't oppose a refusal to enforce, then it's glib to get away next to. It's a great political manuveur. It's too bad that the American public let's our official get away next to these things.
A couple of similar terms relate to the cross-question; misfeasance and malfeasance. In the situation cited Giuliani could be charged with misfeasance by allowing illicit actions to verbs when he had an constraint to stop them. He could be charged with malfeasance contained by the fact that by allowing the act to continue he placed the robustness and welfare of New York City citizens in jeopardy and allowed public moneys to be used to support the immoral aliens. He could defend his travels alleging his interpretation of the law differed but as a prior federal attorney it would be firm for him to plead ignorance. His argument in doing what he did could be construed as coercion within that he allowed the illegals to remain in New York City as long as they did not commit any crimes; he took it upon himself to desire illegal entry into the United States is not a crime. It is that mentality that have allowed the millions of illegals to enter and remain in the United States.

Do you agree with abortion?

Just curious in the order of peoples opinions, cheers.
Answers: No, I don't.
I have an idea that the woman shepherds the womb. I wouldnt necessarily advocate have an abortion, but I think it is subjective. Abortion isnt nearly agreement to me, its about discretion.

I dont put the right to birth above the right to procreate.
No I don't, but I enjoy the same evaluation as Ron Paul. This is a state issue. It has no business surrounded by the Federal debate. Gay rights is also a state issue and has nought to do in the Federal debate.
I believe that these two issues, more than any others, hold on to us divided and prevent us from moving forward with issues that individual the Federal government have the ability to solve.
I agree that it would own been better if the prevention be a lot previously in the process. But going support to the back ally improper abortions is worse, so it will have to do.
Yes, contained by cases of rape, incest and danger to the energy of the mother. As a form of birth control, absolutely not.

How has the State of Iliinois be able to drag out the R. Kelly grip for so long?

Personally, I'm inclined to believe he's guilty--because of his history. But there requests to be a case, and I've see no indication that the State has one. What they enjoy is a couple of disgruntled and discredited employees and a video cassette with no provenance and no date stamp. They've be unable to establish when the cassette was made, how old-fashioned the woman in the cartridge was at the time or even who the woman is. The alleged "Victim" denies that it's her.

Prosecutors are simply supposed to indict based on a plausible belief that the evidence is sufficient to convict, not in hopes that the evidence will materialize between the indictment and the trial date, not so you can try the luggage in the media and not to punish the defendant through prolonged prosecution--in violation of his right to a speedy trial.

Why is the Court letting them seize away with this?
Answers: I reflect on these days the Court is roughly "walking on eggshells". Most people probably believe (as you mentioned) that he is, indeed, guilty of the charges. The outlook of those charges. the statutory rape of a minor, (on its own) elicits turbulent responses from a large segment of society. However, contained by this case, intimate (i.e., dirty little) details of the alleged rape be made public. (If memory serves... were near not even copies of the tape that have been sold? Hmmm, I can't take out.) In addition, the character being charged is a "celebrity". It is no concealed that many consistency that celebrities within past cases hold been given "kid glove" treatment by the Court system - a stigma it is desperately trying to correct. BUT, since neither the alleged sufferer, nor her family are ready to cooperate. the whole entity has be reduced to a "what do we do now?" scenario. The Court have no wish to persue Kelly, but neither does it want to operation with a public outcry. Therefore, it may be counting on the manifestation of "long-term memory loss" a bit than any "additional evidence". I anticipate. it does seem that general public are less shocked and angry than they be at first. Kelly's music seems to be selling as very well as (no. better than) it ever did before this. So, at smallest, Court costs and legal fees won't be a MAJOR problem. So, everyone's getting remunerated! See, it's all apt. Right? Well, it is. Isn't it?

Suddenly realized... In adjectives this mess, your question ("How is the State of Illinois. etc.") be never answered. Allow me to correct this.. by saying: Silly rabbit, this pertains to establishment.
Current rule of thumb in matter pertaining to government:
Ours is not to interrogate how. Ours is but to nod and bow.
who is R. Kelly ??? sorry

If a borough ordinance restricted parking by non-residents for one hour, Mondays through Saturday?

Between 8 a.m and 6 p.m., within a primarily residential district within the borough. And resident were allowed to park near, as long as they had a sticker. I received a parking ticket from a borough police officer. Did the borough violate the equal protection provision of the Pennsylvania Constitution and Do I own to pay the ticket?
Answers: How did they violate the canon?
Were you legally parked or not?
Were you a resident of the nouns or not?

If you were not a resident after you parked illegally.
If you be a resident and your car did not own a sticker then the officer have no way to know you be a legal resident so he ticketed you lawfully. You can take the valise to court and you may be able to draw from the case dismissed, provided you can prove that you hold a sticker or better yet that you have a sticker BEFORE the ticket was issued.

The equal provision of the state constitution doesn't come into play because exceptions to that are made adjectives the time. It is illegal for minors to buy booze and cigarettes, it is unconstitutional to drive drunk, it is illegal for minors to enter contracts. There are cases where on earth it is illegal for a group of citizens to do something when another group can do that. As long as the tenet is posted or known (ignorance of the statute is no excuse) then the imperative is valid. Otherwise the entire world could park in that nouns and the residents would have no hope of finding a parking spot.

The equal provision is an IDEAL and it is used when in that are no other legal conditions that are exceptions to it. For example it is permitted to rent to white renters, it is illegal to NOT rent to other race. That is not legal and is protected by the tenet. It is a civil rights law, not a canon to get you out of inconvenient parking tickets.
You enjoy to pay the ticket if it be posted "Permit parking only".
What you should do is call the Borough department and ask if they
have a courtesy schedule.
If they do, they will give you instructions on what to do to gain
on it so the next time you will not take a ticket.

I do not know the answer about the equal protection provision.
You really believe that non-residents should enjoy the same right to whip up available parking spaces as people who in actuality live in the neighborhood? I assume within is no such law where on earth you live. Lots of parking spaces there, eh?

Will the UK driving age be increased to 18?

I heard rumours that they be 'thinking' of increasing the age to 18, but I am 18 and have be hearing such rumours since i be 8. Then I overheard someone saying it would emphatically be changed next year. Can anyone complex please?
Answers: No decision have been made however ... at least no conclusion they are willing to announce. I doubt they will brand name the change, but we will lately have to lurk and see. As soon as anyone, especially the media, know for sure, you can bet everyone will hear about it!

What shows up in a setting check?

I live in CA and i enjoy a question. I know someone who might be going on unbreakable disability or temporary disability...i be wondering if it would show up on their background check.
And also...i get into a car stroke of luck 6 months ago and it wasnt my fault...would that show up?
Answers: As a mission candidate or member of staff, your privacy rights are protected by several laws. According to BackgroundSearch.com, these law include:

2. The Driver’s Privacy Protection Act.
3. The American with Disabilities Act (ADA).
4. Different states enjoy different legal frameworks, such as the Investigative Consumer Reporting Agencies Act which exists surrounded by California.

Generally, employers other get written green light, especially if they do a credit check. The FCRA is very strict on this and can create the employer a lot of trouble and fines if he does not own your permission for a credit check. However, information approaching criminal records is available to the public and he does not involve your permission to check it.

If your employer does the check himself, and does not rate an outside company to do it, he is allowed to get almost adjectives the information that he can get, lacking your permission.

Employers are other allowed to get information more or less you if it directly affects your job duties. For example, if you will be a distribution truck driver, then your employer can check your driving library. If you will be a cashier and pedal money, he can do a credit check.

In California, if a company does a credit check, and does not offer you a profession, then they must recount you why and where they get the credit check.

In California, a company may not check your medical records until after they hold already offered you a job.

Regarding the sports car accident, if you received a ticket or be charged with any crime, it will show up if they check accounts in that courthouse. If they buy a comprehensive milieu check, they will probably find it where ever it happen.

You can see what information will show up by learning how to do a free setting check http://backgroundsearch.com/Free-Search-...

Good luck
A background check will reveal anything to be exact a matter of public diary (property ownership, lawsuits, bankruptcies, protective directions, etc.). Sometimes, a really good investigative perspective check comes up with true facts that are NOT a event of public record (bank accounts, charge accounts, conjugal indiscretions, etc.) Depends on who's doing the checking and how good they are at it.

If you be in a vehicle accident (as driver, not passenger) and an "official" report be filed by any public agency (the police, highway patrol, sheriff's department, etc.) later, yes, it will show up in a situation check.

What is partial birth abortion and why is it controversial?

Answers: They bring a near residence baby out the birth strait except for the head, which is not here in the womb... consequently they crush the head massacre the baby, and verbs bringing the baby out. If one can claim that then they can claim post partum abortion as well.
This is a uncommonly used procedure, in the following trimesters of pregnancies. The anti-abortionists use this as an example of all abortions (not true) and it is a gruesome procedure. Since someone already described it justly accurately, I won't, but I will state that the usual reasons for it is that the life span of the mother is in jeopardy, or that the infant has severe birth defect, and probably would not survive anyway. It is controversial because people want to control other nation, without any thoughts of what happen after.
