Law Questions and Answers

If 5 people be tried for a crime and you knew one be innocent, would you prosecute them all?

Or acquit them adjectives to protect the innocence of one who is truely innocent?
Answers: Nope I would find the innocent one not guilty. However todays prosecutors and law enforcement watchfulness for nothing except the advancement of thier carrers. They use creative imagination and deliberate up ways to convict innocent people.
If you consciously prosecute an innocent person, you are surrounded by effect a kidnapper, and deserve jail yourself

on the subject of additional details, your unlikely hypothetical situation would place a 'justifiable doubt' on each of their head.
I agree with Razor Jim.

Let the innocent one travel, because that is your undertaking as a prosecutor and then prosecute the remaining 4 who you honestly beleive are guilty.

(edit) Thank you for the more details.

If you know one is innocent but you do not know which one, you need to do more investigation.

I recommedn afford us a concrete example where you would know that one of 5 relations is not guilty but you do not know which one.

It seems to me that if you know that one is not guilty that you would be capable of determine which one is innocent with a more thorough investigation.
Actually -- if he have a good attorney -- respectively of them would be tried separately -- so that we wouldn't be faced near this decision. . . and, even if adjectives five of them are tried in indistinguishable case at one and the same time, we can rule independently as to the guilt of each of them.

It doesn't issue whether or not I know which man was "innocent" (which, by the opening, isn't legal, by any means) . . .

but, whether or not I know beyond a judicious doubt that each man, independent of the others, is guilty as charged.

If I find one that isn't guilty beyond a satisfactory doubt -- then, no -- I wouldn't find him guilty (but, I surely wouldn't exonerate the others -- since I can rule on them independently) . . . I would a moment ago find HIM not-guilty.

What do you think in the region of DUI checkpoints?

Since I don't drink and drive, I don't fear them.

But I get pulled over in Las Vegas, and I thought they be pretty rude, even though I was cooperative.

I thought the Constitution be supposed to protect us from this kind of entry?
Answers: I think DUI checkpoints are great. My town have so many of them. A lot of kids within my town have done stupid things and own killed themselves. If it's the simply way to hang on to people from drinking next I'm all for DUI checkpoints. I regard as we need to hold the drunks off the road. So abundant innocent people enjoy been kill by drunk drivers!!
It's either:
A-- own the checkpoint or
B-- die from a drunk-driver loser.

I choose plan A.

(That and we should super-glue a drunk driver's hands together...at the rear their back... ^_^)
I sure yearning there have been a checkpoint where on earth the drunk 16 yr old kill my sister-in-law and my 6 yr old neice. They didnt deserve to die similar to that.
Youre referring to the 4th amendment...and it says UNLAWFUL flush and seizures.a DUI checkpoint is not unlawful.
since I don't drunk and drive, I'm indifferent.

Skeletons in the closet?

Can you interpret working for a company that has rather more than 500 employees and have the following statistics:

* 21 are currently defendants surrounded by lawsuits
* 84 have be arrested for drunk driving in the second year

Can you guess which organization this is?

Give up however?

It's the 535 members of the United States Congress. The same group of Idiots that crank out hundreds of spanking new laws respectively year designed to keep the rest of us within line.
Answers: Makes you wonder, doesn't it?
- You forgot to include that they put the company within debt 2 trillion dollars and are giving contracts out to their friends which pay 2 or three times more than suspose to.

There requirements to be a change, and not basically a party modify.
Thank you for that information.

It does seem surprising.

Would you cite your source or sources.

Sometimes general public including newspaper reporters bring in up that stuff.

It is very compliant to have the unproved source.
You forgot the Massachusetts senior senator, who committed vehicular manslaughter, maybe even murder, within 1986, and pulled some strings to get the chronicles buried? Or, do we not speak of crimes committed by a Kennedy or a Clinton?

I need some assist regarding a drywall contract?

I drew up a contract for some drywall work I be going to do for a contractor. I signed it and dated it, then I faxed it to him. He emailed it support with some modifications. I didn't sign anything afterwards. I started the project, but midway be told that I have to use bigger screw or it wouldn't pass inspection. The contract say nothing roughly using bigger screws than the ones customarily used. I had to own the drywallers go spinal column and put them in, kill about a daytime of work. Also, the contractor wants ginger peel on the walls, but the contract say nothing something like texturing the walls, only the ceiling.

Can I charge extra for these modifications he's making?

If so, what if he say no?

If no, what can I do?
Answers: If he is making changes to the contract the answer if yes you can charge extra.

You can sue him surrounded by small claims court if he does not pay you.

The written contract that you hold would be the contract that he faxed back to you beside the changes.

Even though you did not sign to agree near those changes you go ahead which would be interpreted as your agreement to the changes that he made.

I am interpreting your query to be regarding the screw and the texturing as not being contained by the original contract or within the changes that he made and faxed hindmost to you.
By starting work you accepted the modified contract.
Any fixture to that contract is a bona fide "extra".
The matter of the screw is a bit more complicated.
If the ones you used were considered sub-standard
by the inspector, ( you might want to verify this),
the guiltiness is yours.
A construction contract assumes a code compliant job.

Charge for what you grain are legitimate extras.
Negotiate if there's a disagreement.
A lawsuit or mechanics lien is a final resort.
(Expensive, and a 'rep.` as a troublemaker can
hurt your chances for other work).

If marijuana is made legal, would these things ensue?

I think it would be poisoned next to additives and chemicals like tabacco is presently. The Corp. would want to make it addicting and poor grade, innexpensive to produce crap. Keep the bud as is I say.Make the fines impossible to tell apart or a little smaller number strict ,like no put inside time .
Answers: It would likely be tax more than cigarettes are even now. I mull over that people would still be set to what they could grow individually, however large-scale enterprises would be born, encompassing companies not unlike our Lucky Strike, or Marlboro, of today.

Also, like mad less relations would be in secure unit on marijuana-related charges. A LOT less.
Marijuana should be made legalized. It should be sold like cigarettes, contained by packs of 20, and treated approaching alcohol, sold to people 21 and over one and only.

If you're caught driving while high...the punishment should be exactly close to it is when you're caught driving under the influence of alcohol.

I would also variety it illegal to grow your own, and crooked to possess seeds. If you can buy it approaching cigarettes, why bother growing your own? Wouldn't that be like a cigarette smoker growing his own tobacco? Why bother???? I'd also allow marijuana to be sold resembling cigarette tobacco, for those who want to roll their own.

This could work.

EDIT: I also forgot to add that taxing the hell out of a pack of joint (say...$20 per pack), or legalized marijuana in standard, would bring so much money into the economy it's not even funny...we could almost exterminate our national debt. Marijuana is the greatest cash crop ever imagined.)
You can win pure tobacco, it's just not massively common. I'd speak they'd probably make plentifully of spliffs, of half tobacco partially marijuana.

They need to completely decriminalize it- that mode no one next to an ounce or less will go and get anything at all, on the other hand it will still not be "legal".

Legalizing it, yet making it against the law to grow your own is a dumb idea. You can grow your own tobacco...but not a soul bothers.

Then again, legalizing it will create a LOT of tariff money that can be used for good things.

Can she get me Fired?

my ex-bestfriend and I work within the same company. Her and her daugther get into argument and she kicked her out now she come to me and I took her in for 3 months now-she's 18. her mom get mad at me and spread rumors that i manipulate her daugther. Her daughter and I knew around her affair and bringing her men to her home. I sent her a letter calling her **** and a whore, in a minute she wants me grasp fired at my job for harassing her. I mail the letter to her home. And she also wishes to sue me for slander. She said my letter be her evidence. Also can she get me arrested for that memorandum?
Answers: This sonds more like dignified school than indisputable life.

Stop sending parcels like that and stop calling ancestors names and you won't enjoy problems like this surrounded by the future.
You mail the letter to her.
( A mistake, but no crime.)
Slander is defame her to others. No slander.
As to the firing, you should get a audible range.
If the daughter shows up on your side, she
might be the one fired, and she should be made
to understand this, ( lightly & calmly, short cursing).

Non-Custodial parent won't bring child back home!!?

My ex husband will pick up our child for his visit, but when it's time to bring her back he call and says he have no transportation. I have to find someone to walk get my child from everywhere he is!!

Shouldn't this be his responsibility?

Is this kidnapping if he won't bring my child posterior home after his hours are up?

What can I do?

I am supposed to have sole legally recognized and sole physical custody. This is a recently enter order for a visitation calendar and my child isn't being returned unless I retrieve them!
Answers: it is categorically his responsibility to provide transportation. i'd call the cops and at least possible get police reports to bring to a subsequently courtdate, which you are obviously going to own at some point. hopefully you will get a peacemaker who is unsympathetic to his procrastination and irresponsibility.
What do your divorce papers say? If it states that you enjoy sole placement, or sole custody, or PRIMARY custody, then yes, you can call upon the police and have it considered kidnap.

In my experience with dealing next to an Ex, the only process they can attempt to take the child away is if your divorce act states Joint Placement, Joint Custody. Unfortunately this is a tactic used by many cowardly mothers and father who use their child for financial gain (child support). They keep the child until the Courts want who should get whom. However, if you are the primary custodial parent, I would hail as law enforcement right away, own your papers handy. Most divorce decrees include documents or a Family Planner that specifies when respectively parent has the child.

From your concluding statement I would call the police and form a report. They will most likely phone up the father and tell him to return the children, otherwise you may enjoy to go pick them up, BUT next you could file a motion near the court to have his visitation suspended or at the lowest the judge will engineer sure he is aware of the custody agreement. By all funds files a report!

I'm sick and tired of one of the only Blue Laws vanished in the State of Arkansas. No Alcohol salses on Sunday.

..We enjoy no ACLU chapter here. Can the law even be challenge under The U.S. Constitution or any other State or Federal Statute?

Hell, I live within a "dry" county (no alcohol sales) and have to drive to a "wet" county 60 miles away lately to buy beer. I work Monday through Saturday and Sunday is the only afternoon off I enjoy to make a "beer run". This seem to me like dicrimination. Everyone know that the reason that sale are prohibited on Sunday is because that is what the "Prohibitionist Christians" that run this state want. Why else would in that be no sales on Sunday. I could move about to Texas and purchase 80 miles away. They allow sales between 12:00p.m.-7:00p.m. on Sundays. Still a blue regulation, just more lax. The big problem beside that is that consequently I'm breaking the law transporting the beer across state lines. It's discouraging enough that I can't shift to the local convenience store down the block. But I understand that this county is "dry". But i.e. 24/7, cut and dry, no discrimination within.
Answers: Someone's Concept of "Morality".

Sloan R, Many people Disguise their Self-Righteousness as Love.
dont they hold refrigerators down there?

ever hear of stocking up?
your state (along next to others) are controlled by the ABC (alcohol Beverage Control Division) which after research shows how crazy the whole wet-dry counties are outlined within your state. Pennsylvania (where i am from) is controlled by the liquor control board however recently they lift the ban on consumption of alcohol on sundays my direction would be to contact your congressman at best to try and turn over these laws here is the interconnect to all the information you necessitate to know

Get on your mule, ride to the general store contained by the next county, buy several cases, later go on your date near your cousin and get obedient and wasted.

If my state produced the Clintons, I guess I'd want to drink constantly too.
You told Dee B that you didn't live within Arkansas. So why do you care what the law are here? They were voted on by the standard public and thats how they got the law passed. I live in the "wettest, dry county" surrounded by Arkansas. They just relocate to private clubs and require a membership payment of $5 a year. By the way, Republicans hold been Governor here for moderately a while. (when the laws be passed)

What are my rights against harassment from a property organizer?

Im a working actor and I made the biggest mistake of mortal nice and befriending the property representative. When I finally descovered how much of a loathsome person he is I rapidly cut ties with him. Now he finds any excuse to try and disturb me about anything. I be late next to my rent a year and a half ago and he stopped me within the lobby of the apartment building to and voiced that I owe him $537 dollars in belated fees. He also took out my garbage disposal and never replaced it after I complained that it be broken. I was told that he is gay and like young men as economically. Also my car and several others be broken into and nothing be ever done about it. What can I do??
Answers: Geez. I a moment ago read the above answer. If the manager "likes" you, it is unlikely that he is against you because of see. That is just silly and say a lot more around the answerer than it does about your situation.

Your bureaucrat should not be discussing your financial status with the building within the lobby. The garbage disposal point might be harassment, but might in recent times be poor management. The sports car thing might not own anything to do with him at adjectives.

From a legal perspective, you enjoy a very withered case. Based on the information you enjoy provided, I would not suggest filing a lawsuit or complaint. Either put up near his nonsense or move. Not appropriate choices, but the best you seem to enjoy.
If you don't like the road a manager is managing things you own several options. intuitively, when I don't like the means of access my apartment is managed, I move to a fresh apartment. Other options include buying the building and firing the chief. By yourself or by banding together with other dis-satisfied tenant. You can also, individually or collectively, contact the owner of the building and let him know that his officer is about to cost him money within lost tenants and lawsuits. Other option are limited simply by your imagination. For instance, the manager might quit if every tenant started making continuation calls within the middle of the night. It adjectives depends on how important it is to you and how much spirit you wish to put into it.
