If Oxycontin is prefered over heroin contained by abusers, why is this medication legal even though it is far more terrifying and addictive that marijuana? For Homicide, Negligence is only used beside Manslaughter, and never with Murder. Murder is a "stubborn & malicious act" traditionally. Therefore, it requires a Culpable Mental State of any Purposely (1st degree murder) or Knowingly (2nd scope murder). If you are Reckless or Negligent, then you go down into the Manslaughter category. (Some states call Reckless a 3rd level murder, but that is VERY scarce.)

It depends on how the gun was found.
If it be in plain verbs of the officer making the stop, or if he had probable explanation to search the vehicle (smelling marijuana smoke, driver appears intoxicated, driver has warrant out for arrest, etc.), or if the driver voluntarily consented to a go through of the car or told the officer any information that would grant probable cause, the gun is disinterested game as evidence.
If not, the go through was improper, the gun evidence will be suppressed, and there won't be any evidence of probation contravention and therefore any charges laid would be dropped.
