BAD PAINT JOB ON HOUSE? CONTRACTOR full of excuses!!?
HE WAS CONTRACTED MID JULY TO PAINT OUSTIDE OF OUR HOUSE AND STILL HASN'T FINISHED BY THE BEGINNING OF SEPTEMBER!!!!!We paid him partially up front, with the stability to be paid on completion. The contract we signed said he would be finished no subsequent than August 9th.
The job he have done so far is patchy in places, dribbles of different color of paint runnning down side, out exposed wood in parts etc, etc, .
He other has excuses , turns up when he like ! Rarely has done a full days work.
HELP...Legally can he come after us for be a foil for if we find someone else to finish this botched job..
This is becoming impressively exspensive. !!!!!!!
Answers: file a complaint against him beside the contractors licensing board. Then notify him he's done and you will be finding a different painter to finish the undertaking and that HE will be billed any difference above and beyond what it should have cost you to originate with within total. If he gives you any grief, or does not compensate the backcharge to him, sue his ***.
the simple answer is no, he cannot come after you, not after being that remiss and unprofessional, a judge or arbitraitorwould see him in the shorts
he cant come after you if his work is so horrendous... embezzle lots of pictures. You may even be able to sue him for the deposit you give him. he already breached the contract by not having it completed within the time frame he said he would. He broke contract. I would say speak about him "look, you arent getting this done in a timely mode, and your work is below par. Fix your mistakes and finish my house in x weeks or I will nick it to another contractor"
And then rob him to the peoples court!!
But seriously, he breached contract. Just make sure you own YOUR copy of the contract, and take pictures of the work he have done so far
As for the money up front thing, it really isnt extraordinary for contractors to ask for a certain percentage up front, especially if they are buying supplies etc. lately dont give him any MORE money, doesn`t matter what you do. that shows that you are satisfied near what he has done so far. walk get estimates from other contractors and their opinion as well. try asking friends/family/neighbors for contractors they hold used and reccomend.

My suggestion would be to embezzle pictures of the job he's done so far (you can also include within the picture the day's paper next to the date legible). If he does decide to cart you to court for the balance due, you'll enjoy both the contract stating completion date and pictures proving the job wasn't completed in good time nor in a professional manor.
I would turn ahead and hire another painter to do my house. And if the original painter sues you, countersue for the partially you paid him.

Now that DSS is involved she have to live with constant scrunitity from DSS and doesn`t matter what comes of it, with some parents choosing to verbs their children out of her care, and such. She is self employed and could potentially lose her errand over a bogus allegation. Once they find her innocent, which they will, can she file any vilification law suit? If she so chose?Answers: That does seem to be more like retaliation than an actual claim, but that doesn't propose that DSS won't investigate it. You should tell your daycare provider to gain a lawyer or find legal recommend from someone who works in the industry (I'm thinking an association of daycare providers or something).
