How is NCLB a violation of the Constitution?

From my previous give somebody the third degree, I noticed that TyranusXX posted that the NCLB be a violation of the Constitution. I own never heard that previously. Can someone please explain to me why NCLB can and/is a violation of the constitution? Sources please!!!!

Answers: Probably because tuition is not listed as a power of the federal organization. Traditionally it is a state government issue. The modern federal political affairs has gotten around this, by tying rearing bills to other powers, so say, if a state doesn't want to follow NCLB, the federal system will withhold highway funds (or something similar).
NCLB is an attempt of the Federal Government to regulate education, a power not described contained by the Constitution, and therefore below the jurisdiction of the States or "the people," not the Federal Government, according to the Tenth Amendment.

Answers: 1) That's an interesting question. Why is anything so to hand on the internet? Since it takes time, go, and money to put something up on the internet...I am guessing that there is some sort of financial benefit for those who put up porn sites. IE, it is up at hand because the demand is in that. Like anything which you perceive to be a problem...the solution is usually one of two things: cut of the demand, or cut bad the supply. In my mind, demand drives supply.however, I know tons who disagree with that position.
2) Who regulates "this"? Well, the internet is not regulated...except within places like China. Are you proposing someone regulate adjectives content on the internet? Perhaps you are proposing someone regulate only the OBJECTIONABLE content on the internet. Hmmm. Give me your roll of what is objectionable. I am guessing it might be quite different than the subsequent 10 people that I would ask. But again, you would be attacking the supply...not the emergency. 2a) Why is teen porn advertised on the internet when it is in truth illegal to judgment teen porn? Well, actually, it is not unfair. Why is porn considered filthy? So long as it is permissible it is a good point. Think how many more rapist etc at hand would be if there be not an avenue for release of desire's? Why should gay marriage be outlawed?

Answers: The just legitimate object is that the government wishes to promote child making so that there are more taxpayers. I intuitively believe that until we outlaw more than 1 divorce per person, we shouldn't outlaw gay union. I do not believe churches that are against gay marriage should act one, but I see no reason that churches that approve and civil union should not be allowed.

Blockbuster claims I returned an empty crust, but.?

I didn't! I returned the movie, DVD and the case. They call upon me two weeks after I returned it to tell me this and that I will enjoy to pay for a unsullied DVD. I positively, seriously returned the DVD and they don't believe me cause they don't hold it in the shield and say "in attendance is no way" it is somewhere else in the store. What can I do?
Answers: First bad the idiots at blockbuster dont listen to reason. Secondly they are supposed to check the cases PRIOR to restocking them. If they wait two weeks odds are it be rented out after you returned it. I would chat to the store manager and explain that you know that when you took the dvd into the store or put it within their dropbox the movie was surrounded by there, and that you will not recompense for it. For all they know, a store hand could have pulled the movie out and said you returned an pointless case. If they still insist on charging you for the movie, only just dont go near anymore. They will bill you for the dvd and if you dont pay it, eventually they will distribute it to collections. Blockbuster sent my ex's late fees to collections, which must cost them in the order of $10-20 to pay a collections agency to toy with.he owed $3 in behind schedule fees! So it cost them more to send it to collections than he even owed.
I would also contact the corporate bureau for Blockbuster if the manager wont believe you. I am sure they must own a special department for this exact situation.
I don't know your situation or the type of people who work at that Blockbuster, but if you really consistency that you returned it with the movie inside, you may contact the store negotiator and Customer Service and take it up beside them from there.

Can someone tell me if at hand is a statute of limitations in Indiana for class D felony mugging?

someone I know got caught stealing something from a store (a CD). I be told any theft contained by Indiana is a felony. They have charges on them contained by my town. Answers: Theft is a Class "D" Felony in Indiana. It doesn't event if it's a candy bar that's stolen, or if a $5,000 ring is stolen. It's considered a felony. I enjoy a client who tried to steal $300 in clothes from Kohl's. She have the same felony charge as the client who be caught stealing a snickers bar.

The statute of limitations is the time between when the crime occur and when the alleged perpetrator is charged. If your friend has already be charged, he can't just continue out the statute of limitations since it doesn't apply anymore.

If he doesn't appear in court, a warrant will be issued for him, and he will facade additional charges for flop to appear. These charges will make it more plausible that he will NOT get probation.

If this is a first time offense, he will most probable get probation, as long as he doesn't return with a failure to appear. He'll probably draw from a little bit of community service, also.

It's also possible that when he go to court, he might get offered a diversion program. With that, as long as he completes the community service and any other language, the charges will be dropped.

If your "friend" has already be charged, I would recommend owning up to the charges and accepting responsibility and whatever punishment is meted out. And HOPEFULLY your "friends" fingers won't be so sticky subsequent time they walk former a CD rack within a store.

Depending on where on earth the judgement was rendered, it will be devout for up to 20 years with 10% on any unpaid amounts.

Shop lifting detectors fool proof?

Just wondering not going to do it or anything but one of the kids down the street from where i live her sister say it works, if you line you purse of rucksack with aluminum foil the nouns detectors will not go stale, is it true or not, again not going to do it just wondering.
Answers: That might be true. Also, some stores hold dummy detectors that don't do anything, which is why some shoplifters will bring their merchandise near the detector to see if it sets past its sell-by date, before they try to steal it.

Keep within mind that even if you get previous the detector, many stores also own cameras.
