Yes! If you carry run over by someone and they run (called a hit and run), then they can achieve charged for the crime, but if they stayed at the crime site, then they would not procure charged.

and if you were jay walking, or running when the neutral changed, then the charge would be on you.

To be honest, at first I thought this be a stupid question, but next I rephrased it like so: "If I run over a pedestrian within New York City and nobody (including the pedestrian) would press charges, would it really be a crime?" Yeah, that seems to be a more interesting grill. I would suppose it would still be a crime since wreckless driving is illegal.

Do i have to jump to a deposition when the case is against me?

My exhusband missed a couple months visitation near our daughter because defacs put a protective order until he agreed to a drug experiment. But he didnt show for the drug test and after missed a court date, so the judge signed away his visitation. Then he get a lawyer and finally passed a drug audition after a few months and said that I made up the drug alligations and was taking me to court truism that I was within conpempt for witholding his visitation and that I made false alligations. But I never witheld the visitation, the judge did when he didnt show. But when he found out what witnesses against him I have coming to court, he cancelled the court date but called for a deposition. He also have a dispute going with a former employer at this time and plans to sue them. He think that they influenced me but they didnt. Do i have to jump to the deposition? Is it about me or the adjectives lawsuit with employer perchance? can they deposition me and then pinch me to court?
Answers: why wouldn't you want to be deposed? do you not want your side on the record? surrounded by some cases a summary judgment can be asked for and if you don't enjoy your side of the story on the record it could possibly stir against you. it is not worth the risk to not show up.

Father being difficult?

Am contained by new relationship next to partner who is going thru divorce/seperation, and custody etc. Every time he has the kids, (2nd weekend), he constantly abuses(verbal,) her surrounded by front of kids, and this is making the kids lives a mess emotionally. He wont respond to n e lawyers correspondence for settlement, custody or n e thing.. I know we hold to take alot of this to court to find it settled, but is thier any other way we can capture immediate dealing to resolve this???? Emotional blackmail, and constant bettering of mind games are his forte'. Some times he takes one child and not the other, other times he go holidaying for 5 weeks straight and then think he is entitiled to that loss of custody.. She is trying to be as accomodating as possible, so it's favourable surrounded by court, is this the way to travel??? Any advice would be greatful. Thanks
Answers: Document, document, document. Maybe she could even go and get someone to videotape her drop-offs -- he might be kinder if he knows he's man taped. ALSO, any requests to alter custody arrangements should be written and signed.

Really, you call for to talk to a advocate about this. And possibly a psychologist. It's one entity to be accomodating -- it's another to let the kids be battered and bruised emotionally. It's tough adequate of a time. She should write him a letter asking him to tone down the treat roughly, and work with her for the sake of the kids. She should show it to at lowest possible two friends before sending it (they can inform her if it's too unbalanced), and keep a copy for herself. Also, preserve any responses. Ask him to put those responses in writing, too. Slowing down to write something may breed him more thoughtful about what he's really doing.

I disagree with the above. The point isn't to trick him -- it's to bring in him behave better. If he knows he's man documented, maybe he will exploit better. But, he's the father, and he does have some rights surrounded by this situation. It's not some sort of stupid game to BEAT him, but an shot to make time better for everyone involved. Including him, much as it may stick in your craw. Try and be handsome -- but do draw some boundaries and stick to them.
Tell her to document everything.. including times, dates and reaction from the kids. Submit that in court but do not explain to him what you're doing. You don't want him to be prepared with excuses.

my mom is addicted to gabling and smoking cigarettes. She shows no sign of changing. Answers: Yes it is possible I would do additional research on how to do it. It is a long epic process but it will be worth it in the extremity. You need to show that you are competent to support yourself on your own so I would get a situation if I was you.

My ex-husband's divorce with his ending wife isn't even final yet, and in a minute he's moving another woman and her three kids into his home (her divorce isn't final yet, either). He have primary residence of our 13 year-old son. Suddenly, our son is flunking 2 classes and has an "I don't care" attitude just about everything, especially school. He have told me that he does not like the relationship his Dad is surrounded by with this woman, nor does he want the woman and her three daughters to move within, yet that's exactly what's going on. Is this lawyer lying to my mom something like her bankruptcy?

this is the situation...i received toll violation that equal 470 dollars from the state of Illinois and the violations be under mine and my moms given name because she owns my car. she is file bankruptcy and my mom's liquidation lawyer told me not to recompense the violations because he will include them contained by the bankruptcy.
