Looking for "Legal Proof" on SOL in NY?

Hi All,
I appreciate everyone who have answered my questions so far! I recognize now that SOL contained by NY is 6 years, and a lot of you enjoy agreed to that. I was competent to find the proof for the SOL found in: N. Y. Civil Practice Law and Rules: Chapter Eight of the Consolidated Laws, Article 2 - Limitations of Time-
213. Actions to be commenced in six years: where not otherwise provided for; on contract; on hermetic instrument; on bond or note, and mortgage upon valid property; by state based on misappropriation of public property; base on mistake; by corporation against director, officer or stockholder; based on fraud.
But I can not come across to find "Legal Proof" where it states that making a clearing will "restart" the clock. I have found this following tenet:
N. Y. Civil Practice Law and Rules: Chapter Eight of the Consolidated Laws, Article 2-Limitations of time-
206d. http://public.leginfo.state.ny.us/menuge... If someone can help me work out all these official terms
Answers: Ok the problem is that you are assuming everyone reading this have read your previous questions. I enjoy no clue what SOL is to even begin a prod to try to help you.

I can speak this though. In times that I get flat stuck when trying to find a decree, I email my state Lt governor's office and lately ask. You would be surprised how helpful they are.

I enjoy also just open up the yellow page and started calling attorney offices and of late ask.

I started a temp job ultimate week, worked one day for the company?

I be having problems getting home due to the belated finish times, I explained this to the temp company who were not outstandingly happy, I explained I could,nt do the commission due to the near impossible mode to get home on public transport, they are refuse to pay me for the 7 hours worked that morning, what can I do, I am in the uk
Answers: If you are working for a company (I will call upon them 'A') on behalf of your Temping Agency then you should enjoy been given a worksheet. As long as you have that worksheet signed by the
someone in authority at Company 'A', after your temping agency must pay you for the time you worked. (A tip would be to keep a photocopy when you appendage your worksheet in). They can refuse to wage you if you broke any company rules. They must pay you even if Company 'A' doesn't payment them because the temp contract is between the Agency and you.
Was it through an Agency that you got the temping role - if so
find them to follow it up as you are entitled to the payment.

If not speak to the HR being at the company and explain situation and ask them to put in writing to you why you are not anyone paid -and afterwards take the issue to ACAS or Citizens Advice Bureau appropriate luck
They have to repay you. Contact your employment commission office and directory a complaint.

Would this be Illegal for a bank to do?

My friend(21) and his girlfriend(22) enjoy been living together for 2 years. But anyways, her mom works at a mound and was concerned roughly speaking her spending habits. So her mom run a report on her checking account and next ran a report on my friends checking sketch without any persons consent. So is that illegal? If so, should something be done almost it? Oh, this is also the second time it has be done.
Answers: It is completely illegal and if the wall knows the mother would be fired. If she be not disiplined in some method, lawsuits could be filed for invasion of privacy. I worked at a reserves and loan in Philadelphia where on earth we had a mother spying on her mothers accout to be sure she be not wasting her money. The mother complained to the bank, they did nought, she closed her account, file suit against them for failing to protect her personal information. They settled out of court for an undisclosed sum, and the bank fired the banker. Of course, this kills household relations.
Your friend or his girlfriend need to wallet a complaint about this near the bank within question.

The mom used her professional access for personal use.
if you wallet a formal complaint w/the bank, your gf's mother will most potential be fired or disciplined.

i think you should inform her that 3 strikes and she's out.
This is a violation of privacy, and if outright illegal, unquestionably unethical.

But, since it is a family circle member, your wisest choice of movement would be to simply move your accounts to another bank. This process you avoid any domestic issues which would certainly manifest themselves if you file a suit.

what's ur question exactly?

Rep: to ngc6205 on the FED.?

To ngc6205 :
The Federal Reserve Board is the biggest fraudulant institution in the United States. (along next to the twelve privately owned Federal Reserve Banks. They are non government bank.
Here is how it is done;
When the US Treasury needs more money they ask the FED.
The FED writes an uncashable check, authorizeing the printing of fiat tabloid dollars "federal reserve notes". (not backed by silver or gold)
The treasury prints the dollars to cover (make good) the uncashable check. Then the FED collects the prime rate of interest (fixed by them, not us) for the use of our own currency.
(without investing a single solitary penny of their own)
The FED should be remunerated "management fees" singular.
They are unconstitutional and have no right to confiscate our property ( our domains ) the method they do.
Thank you for your answer.

Am I entitled to compensation for NHS breaking confidentiality?

I recently took my son to see a peaditrician as we where on earth having concerns over a few issues that where impede on his everyday life. After seeing my GP he said he thought our son be showing signs of aspergers syndrome so refered us on to the peaditrician. He confirmed that this was most really aspergers syndrome, but needed some more information from other professionals who had deal with our son over the years. The consultant asked for information from the speech consultant from a medical point of view.
She later took it upon herself to then transport many CC to other agencies one one the LEA.This was not a teaching matter and be sent to the ed phychcologist and access and inclusion team short telling us .We are home educating due to his difficulties so we're not funded by our LEA so would hold prfered my sons medical details not being discussed next to anyone else as this was a private and confidential medical issue.
Answers: I don't see why you should get compensation, money learned as to be fair, you've not lost out on any money, approaching another user said.

Maybe a formal apology or something..

In all fairness, she may own been acting within good intentions, and yes it's breaching your confidentiality, but is it really nasty? Do you really need to take that stressed over it? was anyone really hurt surrounded by this situation? I mean honestly.

Personally, I ponder you'll find it difficult getting comp from the NHS, I don't mean to be offencive, but do you not expect that the money they have should be going to good lives which are in a critical condition?
If any compensation is due, it is to your son, and not to you, since it is his medical confidentiality which have been high and dry.

Maybe an apology would be more in decree than money.
Surely the point is whether your childs future have been harmed not whether you should be compensated.
I would dispatch a letter to the speech psychiatric therapist and her line superior asking for an explanation. You can then prefer the next course of doings.
Make a complaint to your health authority. Any agency wishes your consent to pass information on, they want pulling up on this. What a cheek, at least complain and see what happen.
No. Professionals can discuss the medical matters of citizens under their caution with respectively other, and as long as they do not divulge the matter to non-professionals, near is no breech of confidentiality.
Well, sometimes they have to run to far reaches to find all the information together to find a clear picture. And these "professional" treat any part of a valise as confidential and can not submit information to the finance department of LEA minus your say so.
The point is you would be suing a hospital, so that money cannot be used to save a life span.
what have you lost that have financial value.

I'm not sure if I need a profession permit..please read details?

See, I'm 16 beside a car and I be hoping to go to an interview at Chick-fil-a on Wednesday. However, I purely thought about if I would involve a job licence? I am filling out my application right in a minute and it says "Are you eligible to work surrounded by the U.S.? Check yes or no (Proof of eligibility is required upon employment). Is this talking almost a work permit? If so, how do I travel about getting one and how long should it steal?
Answers: You do not need a work grant at 16. That was referring to proof of eligibility to work if you are 14 or 15 and not a US citizen.
yea..you are..it have nothing to do next to a work permit..if they want one they will tell you when you get hold of the job
GOOD LUCK!
You don't necessitate a work permit because you're over 15. I cogitate elibility to work in the U.S. simply means that you're a US citizen over 15 (15 and younger stipulation a work permit).

If you end up need one it will take around 2 weeks.
In my state, those 17 or lower than need a work permission under the child labor law. A minor's hours are regulated as to certain times past its sell-by date the day and the total number of hours per daylight and per week. He or she also may need parental and academy permission. The number of hours depends on the type of brief and your age. A birth certificate is proof of citizenship. Sometimes baptismal certificate are accepted, but the birth pass is best. These are usually on file at the county court house where on earth you were born. If you are not a citizen you may have need of a green card. If you are born in a foreign country to an American citizen, your parents may own registered you with the US embassy. Then the State Department would enjoy your birth certificate. Take the interview first. They will communicate you what you need.

Water/sewer connection charges?

I am building a house and not long applied for a permit to connect to my town's marine and sewer lines. I understand that I am required to compensate the cost of constructing the connection to my house, which I'm fine next to. However, they have told me that I will also hold to pay to own connections constructed for two nearby lots owned by the town, as all right as a connection to a neighbor down the street if I want the security. Is that legal? If not, what "legal" rights of mine are one violated?
Answers: I've heard of this crap up to that time. Contact the city manager just about this. My county has what they phone up an impact fee to be precise literally 10 grand a short time ago to connect... its robbery.
I don't think they can force you to connect for lots not owned by you - but if they enjoy to go former the lots to get to you they might own a case for it.

You should really consult the town attorney and an attorney of your own.
What town do you live surrounded by ???
This sounds strange.
I never heard of this back.
This is why we pay taxes and the several fees on our utilities bills.

get an attorney.

Advice On How To Present A Case In Small Claims Court?

My Construction Co did some work at a new restrauant (Greek) that simply opened surrounded by our community. When we was done the owner said he did not hold the money to pay us. Agreed to a money plan and now the owner wishes us to more work for him in directive to receive the remaining balance on previous work. I refuse and now he refuse to pay for the work done. Filed small claim contained by court - Now I have to prove my armour - I have never done this until that time. Open to suggestions. Thanks
Answers: The most important evidence you own is written records or contracts.

Did the restaurant owner sign a contract next to you for an agreed-upon price? If not, your case will be harder to prove.

Is the restaurant owner insisting on more work because he considers it "remedial work"? In other words, is he dissatisfied near something, and wants you to correct it?

Without precise, written contracts it is tricky to prove what was promised, and what price be agreed upon.

If you had business associates present during the initial negotiation for substance and labor charges, make sure they come to court. Otherwise, it will be your word against his.

The problem is, the burden of proof is really upon you. Even if you show some preponderance of evidence, unless it is moderately conclusive, the judge may simply articulate you didn't prove your case. It's aggravating, but unless you can show that the defendent is contained by material breach of contract, the intercede may not consider it prudent to award you anything, ESPECIALLY IF the defendent claims your work was substandard. Now comes the unyielding part. You are put on the caring, having to prove that you suitably performed the work as agreed to.

Make sure you enjoy all your contracts, invoices, and sundry documents. Did the restaurant owner own to sign off as successive stages of the post were completed? Did he sign anything that indicated he acknowledge the job is finished, and he is unworried with the work? This is crucial.

I don't want to overly concern you, but I own seen law lords who were manifestly in the pocket of the defendent because his legal representative was some friend or colleague of the mediate.

If you are allowed to direct questions at the defendent, my proposal is to use the tag strip, "isn't that true?" For example, you could ask him, "We finished the construction on October 22, and you signed a note of acknowledgement that the work have been properly completed. Isn't that true?"

He will have a harder time lying because, if he say no, he will have to explain his position. If he did indeed sign bad on the work, you can then force him to prove that the work be somehow deficient surrounded by some way.

Remember these steps:

1) Be thoroughly organized. Have all the papers in place, and note the CHRONOLOGICAL charge of what happened. Judges catch impatient if you are a disorganized mess, and he may abruptly ruin the questioning and render a prison term. They can be quite autocratic.

2) Make sure than any hand who was witness to the events is surrounded by court to provide substantiation of what you claim is true.

3) Appeal to common sense. If the owner say the work is bad, why would he agree to you leave? Wouldn't he enjoy confronted you while you were still on the post site? Make his arguments look like attempts to distort the truth.
I'm sure the referee will be very polite - in my experience, they do their best to get sure pro se litigants (people without attorneys) hold access to full justice. I'd enunciate the best thing you can do is to enjoy EVERYTHING documented. Perhaps even a time line summarizing the date of work, documents, amounts due, etc.

Have you filed a mechanics lien?
