Employee to pay restitution for giving discounts??
My fiance be fired by Wilson's Leather after they claimed an audit revealed that he was giving to plentiful discounts to customers. Upon being fired, $400 be taken out of his paycheck after he admitted he give discounts. Now, three months later, he get a call from someone saw he owes Wilson's Leather restitution in the amount of $12,000 and they give him a file number and said they would dispatch him the paperwork. I don't understand why this is occurring, he didn't steal anything and it's not like he be standing at the door giving leather jackets away for free. He be a manager and he give discounts for damaged merchandise and to run into competitor's prices. They told him when he started that he as the manager have the right to give discounts where on earth he saw it fit. Apparently they have evidence of multiple transactions for smaller number than the ticket price-but why didn't they step in right away and hand over him a warning? Why examine it all attach up and then constraint restitution? Advice? Can we fight this??Answers: Absolutely argument it. If he didn't steal and he was given discretion to allow discounts, afterwards they can't demand restitution. Also, they can't prove beyond a acceptable doubt that he was the one giving the discounts.
