Can a Civil Judgement be Upheld in a State Case?

I have a contractor rip me off for $54,000.00 I file a civil suit which he did not respond to, and I was awarded a judgement for the amount.

The contractor be tried and found guilty by the state since he ripped off several those. He was ordered to fashion full restitution to the victims and had to reimburse a fine. However, he is contesting the amount he owes me and the judge will be have a restitution trial tommorow. I don't understand how the contractor can contest the amount he owes me when he didn't even respond to the civil overnight case (yes, he did know about my valise - he was served the papers by the sherriff's department and signed for them).

So my question, can the arbiter uphold my civil judgement for restitution in the state suitcase?

I appreciate your help, gratefulness.
Answers: Civil and criminal courts are different. The criminal judge does not enjoy jurisdiction to enforce a civil judgment, but he can cart into consideration the evidence and the judgment beforehand awarding restitution. Your civil attorney would have to follow through next to the process of collecting on a civil judgment, which would be compensate by any restitution paid and collected by you from the criminal situation. Discuss this matter beside your civil attorney.
Such is the way contained by our litigious society. The judge can uphold your ruling or vacate it or reduce it, depending on what considerate of day he/she's have or whether they think you look or smell funny.

How can i copyright my work in a agency that will stand up in court?

Answers: Once you own the work in a fixed prevailing conditions (i.e. written down), it has acquire copyright protection. For additional legitimate protection, that is, to engineer sure nobody can copy it without your consent, you will have to register it beside the United States Copyright Office. There will be a fee for this, but it will rightfully establish your copyright with no press.

Oh, yeah. I forgot to mention to ignore adjectives of those who talk give or take a few what is known as "the poor man's copyright." In the US, at hand is no such thing. Mailing a copy to yourself and consequently keeping the sealed, postmarked envelope offer you absolutely no new legal protection. All you've done is shrunken money on postage. I was especially amused to see someone influence this after telling you to give the brush-off someone else.
Send a copy of your work to yourself in the post ! I know how daft it sounds, but if you hang on to the package hermetic when you get it, it will enjoy the date on the post mark, and you cant forged that !!
Good luck X
Well ignore 'Grips' for a start.

If you write something YOU AUTO - MATICALLY OWN THE COPYRIGHT.

The issue is proving it.

Make a copy and transport it to yourself RECORDED mail. Then hang on to all documentation (receipts etc) and maintain the envelope sealed. formulate sure that the post mark is readable too.

If the issue arises you will hold to go to a advocate and officially break open the envelope in front of them, they will verify it and the tabloid work and go from nearby.
Make the copyright mark on the newspaper. Automatically your work is your own (UK) However ... to be 100% sure drop a copy into an envelope and address it to yourself and post. Do not open when you receive it and store for adjectives reference. The post blemish will serve as a date.

Can my laywer stop me from borrowing a percentage from my lawsuit claim?

Answers: Perhaps, but it would probably depend on the contract that you signed with your attorney and/or the rules contained by your state.
A good contract would want to limit your cleverness to assign any future award so that the attorneys and their fees (if base on a contingent fee arrangement) would be protected, and you would be protected to. Some companies contribute to loan you money based on adjectives awards, but the interest is high and the language are against you.
Yes, if your lawyer is entitled to a portion of it.

Can a person Claim Social Security Spouse Benefits if Common Law Married?

I hold a friend that has be living with her longtime boyfriend for more than 2 yrs, thoroughly committed to each other and they do jump around and say husband and wife. The Boyfriend requirements her to receive some benefits from Social Security. (Texas does common ruling Marriage) but they never signed a paper stating that they are married or not. What can she do.
Answers: why don't they in recent times get married. I close-fisted they are not husband and wife they are just boyfriend and girlfriend living together, besides that would be a type of fraud..
Two years is not exactly a long permanent status relationship. However, I guess it is longer than some marriages. But, although Texas does certify common statute marriages, the federal affairs of state does not. What sort of spouse benefits is he talking give or take a few? If she is disabled, she draws disability. That comes out of another part of the kitty from social protection. But common tenet marriages hold no federal recognition.

Did my GF commit a crime by unauthorized opening and reading and forwarding my email?

My computer be down or I was travelling. I be talking to my girlfriend on the phone. She be at her computer. I asked her to log in to my email and check to see if a specific email I be waiting for had arrived. I give her the password and she logged in. I asked her to read the name of senders of new emails. She did. The one I be waiting for was not in that. I asked her to open a different email from a friend and read it to me. She did. That be the end of the assistence she provided me on that. She consequently went into separate email folders streaked 2005, 2005, etc. to see what I had be up to. She is extremey suspicious (I am not, or I never would have given her my password). She open folders and individual emails that she was not authorized to (just because you are given the switch to your neighbor's house, you do not have sanction to go over at hand and go thru the drawers). She forwarded something like 100 emails to herself to read later at her frivolous. She did not like what she saw.
Answers: Technically, yes. She access things she wasn't authorized to see.

Practically, no prosecutor has satisfactory free time to waste resources on it.

You've literary some valuable course:

1) You can't trust your girlfriend.
2) Once you give up a password, everything protected by that password is no longer protected.
3) Discretion is a wonderful item.
I seriously doubt that she would be held criminally liable. Chalk this up to lesson learned, don't confer out your password. If you are given the key to your neighbors house I chew over you basically enjoy given access to your things. If someone does go through a drawer I can't see that as a crime.

And as far as US Mail ruling against tampering beside or opening another person's messages, I do not think that system that once said mail have been open that a person who is not you can't read it.
What you want to achieve her arrested, give it up! Unless the email are terribly sensitive material, resembling your a secret agent, or cooperate secret etc.. But she obviously have trust issues that need to be resolved. Or newly say goodbye!
