In Utah, can an employer fire you for no reason, and near no explanation?
Answers: An employer can fire you for any reason or for no common sense at all contained by an "employment at will" state. However, if the firing was base on discrimination base on national origin, masculinity, religion, creed, age (over 40), etc., then the employer might own violated federal law. If you dream up that your situation fits any of the above, you should contact your local EEOC or see an attorney.
Yes.
Utah is an "employment at will" State. You can be fired for no reason, and can quit for no common sense. If the lack of a apology is a pretext for an illegal idea, though, that's different.
Obviously there IS a pretext - the boss isn't obliged, though, to make clear to you what it is.
(To the other answerer - "Right to work" is a different thing altogether, have to do with forced Union political leanings.)
Richard
Yes, as long as it's not a prohibited reason similar to race or femininity.
What can i do to waive a 90 day waiting extent to get my license? I inevitability this done for a job i be hired at.?
I recently get hired and needed to fix my suspended licence. I called the licence branch & salaried all my tickets. When i go to get them re-instated, They said a 90 light of day waiting period is within effect from the time i paid my ticket. My contemporary job cant continue that long for me to get my licence. I be told the only channel to get this resolved is to hold the judge convey a court order to the BMV waive the 90 days..but this will take a attorney & money i dont have..I requirement the job to hire a attorney...Even if i request a temporary licence, or hard times licence, I still need a attorney to plead my case. Does anyone know any permissible advice for me??PLEASE HELP!
Answers: The 90 days is a punishment for the crime you committed. Apply for another undertaking in 90 days.
If the profession does not involve driving and you only have need of ID, get a state issued ID card instead.
I devise that if you want to get specific court advice you would first disclose the state or country contained by which this occurred. Some law may allow hardship cases to catch a license sooner. Others may not.
If it is a driving job getting the suspended license reinstated will most likely not assist as you are probably un-insurable for commercial driving. If it is identification issue, look contained by to the ID card solution I mentioned.
technically, you don't need to hire a attorney. For something like this you should be capable of go to court yourself.
Ask your tentative employer for a letter explaining why you necessitate the 90 days waived. Attach a copy to the poverty application and make sure you bring the inventive and several copies to court.
If there is a charge (that you can't afford), for waiving the 90 days or applying for hard times you might want to ask the new employer for a money advance. It's a long shot but if they hired you and didn't check your license status first, they are probably pretty desperate to get hold of someone in that position.
My guess is the situation will depend on why your license be suspended. Be honest and humble in court. It will seize you a long way.
Good luck
Go to court and procure their free blank motion form and file a Motion for Work Waiver Drivers License - explain your necessitate for the license, and ask for ONLY a work waiver driving license until the 90 days is up. Explain you need the license to drive on the undertaking and that you will only drive to and from work during specific hours. It may or may not be granted, depending on the reason for suspension in the first place. But it doesn't hurt to ask! Present it yourself near proof of your job volunteer and need to drive for work. This will just be if your job requires you to drive at work; but for, if you only requirement it to drive yourself to and from work then forget it, the court will right to be heard take the bus or bring back someone else to give you a ride. Good luck!
Is my city police department corrupt?
This is a new complaint of mine against a P.D. which as luck would have it I was not involved beside, but it still stinks. This California Beach town made a law requiring bicycle license on all bicycles surrounded by the city. The police went to the sand cut the locks off bicycles and impounded AKA (stealing) them. Regardless oodles were tourists and others from towns that don't require bicycle license.
Answers: Your problem seems to be more beside your town council then near the municipal police force.
Municipal police are hired to enforce among other things municipal bylaws.
If the town council passed a bylaw requiring all bikes to sport a licence plate next it's the municipal police force's duty to enforce this law. The police can't pick and choose the law they will or won't enfoce.
Your remedy is to research the problem, attend the next council engagement, and supported by reasonable and valid arguments steadily and politely tell the council that base on your research they must amend their bylaw because it discriminates against out of town folks and tourists.
By the way you might want to look into the reason why some municipal councils see a need for licence plates for bikes.
Let me be sure what you are wise saying:
1. The city (not the police, bu the city) passed a law that said adjectives bikes must be licensed (like most cities do) or they will be impounded.
2. The police enforced the law passed by the city.
3. You deem this indicates corruption.
My answer, no they are not.
CALIFORNIA CONSTITUTION
ARTICLE 1 DECLARATION OF RIGHTS
SECTION 1. All people are by spirit free and independent and have inalienable rights. Among these are enjoy and defending life and independence, acquiring, possessing, and protecting property, and pursuing and obtain safety, brightness, and privacy.
SEC. 7. (a) A person may not be deprived of life span, liberty, or
property in need due process of law…
Since David and company apparently seem to know of much more optional details than what you have given us within order to trade name the claim that the police are simply doing their required job to enforce but not break or look right through the laws, I must assume the police administered procedural requirements, later went to the sand, cut the locks off bicycles, and stole ..errrm.. impounded them to some extent. And therefore I could also vote for not corrupt.

How would I sue someone on ebay for not shipping an item?
I have lately purchased a cell phone from a guy on ebay. He sent me a tracking number from USPS but when I enter it it says near is no such item. If he doesn't ship the item how would I go more or less sueing him? This was similar to a $250 dollar phone for christmas and this is bull if he doesn't ship it. He has similar to 98.9% positive feedback though. I'm going to wait almost 2 days until I take commotion, I just want to know how to do it? Thank YouAnswers: Use the dispute/problem resolution procedure thru e-bay. If that doesn't work & you salaried with wage pal, you can engender a claim under their protection plan. If vendor is in another state a $250.00 suit isn't worth doing because you enjoy to sue
in its home state.
It will cost you plentifully more than $250 to sue the guy. Contact and lawyer and agree to them know what is going on. The lawyer will recount you how much you need to payment to sue the guy. The lawyer will probably also know exactly which agencies to report the guy to. Like I said, it will probably cost profusely to sue.
Also remember, there are ways to report the guy thru Ebay as resourcefully. Their livelihood depends on the sellers deliver what they promise. Report the guy to Ebay.
Uh..Dont jump to conclusions. Email the dealer and make sure he have sent it and make sure he correctly enter the tracking number. It may have be just a simply mistake.
My experience near ebay sellers have been, if they are scam artist, they wouldnt even bother sending you a tracking number. They would purely take your money and run.
Did you wage for it by paypal? If so, they have buyer protection and you can enter a claim. I did for an item that I hadn't received contained by a month and got it. Contact the street trader first though to see what's going on, he may just purloin a long time to ship. Another good entry to remember is 98.9% may sound apt but if its 500 negatives out of something that's a moral sign to stay away.
dont sue him find out where he lives and see his @$$
USPS ??? huh?
If you paid through Pay Pal they are amazingly good at putting pressure on seller. So is eBay. Turn him in. Have you emailed them?
How long ago did he ship it and from where on earth to where? USPS tracking is a kid. You are lucky if they get the tracking done a week after the item is deliver. Instead, contact the seller and ask him in the order of it if you are concerned. Most EBay sellers are honest and fulfill their commitments. If he doesn't respond, directory a dispute with EBay.
Go to Ebay's home page..near is a place to click on for "disputes".do that...they will assist you.
Never, ever buy anything on Ebay without purchasing the insurance.
I was charged near around $800.00 theft?
it is really my first offense ever at the through retailer i work for. i was charged next to a felony, the asset protection woman said she'll try to move it down to a misdemeanor since it was my first offense. i really have a reason to do what i be doing, i am scheduled to stir to the municipal court and find out whats going to happen?can anyone tender me advice, or know what might evolve to me, i scarred out of my mind, and dont know what to do??
oh and i live surrounded by ohio..thanks
Answers: Community service, probation (probably 3 - 5 years) and a big fine and a main scolding from the judge!
After you finish your probation, and retribution your fine - you can ask for an expungement, which removes the misdemeanor from your record, brand name sure you take carefulness of it!
Commit the crime, serve your time!!!!
Don't drop the soap!!
The reason doesn't really brand name a difference. Everyone who steals has a idea.
Once the case go to court, the AP people at your company own no say in the region of what level it is prosecuted at. If stealing something worth $800 is a felony, than it is, regardless of whether you enjoy ever been caught stealing back or not.
Get a lawyer, you'll obligation one.
The AP lied she has no power over the charges thats Police and DA. What you call for is a criminal defense Attorney. If you cannot afford one request one at your court date and either enter no plea or not guilty. Talk to your Attorney going on for reduction of charges and even possible diversion
Bill Collector Calling-Not Ours!!!! What to Do??
Here is the deal, beinging on Monday we've be getting calls from Lobel Financial. Problem? They are not our bill collector! They are looking for our neighbor, the first time they call they even said they are calling for a neighbor, that they can't get contained by contact with. They said they put the address contained by the computer, and our number came up as the closet address. How can they do that? Is it even lawful to call someone when you KNOW they hold nothing to do near it? I've filed a complaint next to the National Do Not Call Registry, spoke with the supervisor of the company and told them I file a complaint. The guy was so rude to me, and made me quality like I owe him money. I own a feeling I will be getting more call from them. What else can I possibly do?Answers: Along with following the suggestion given by other answerers, I highly suggest that you ask your neighbor to ring up them back. The quickest style to make the situation budge away is for the person who owes them money to get hold of in contact near them.
This is harassment. If he call again, get his mark, his telephone number and the first name of the company and file a complaint next to the police. They need to prove this is yours, anything else is stalking.
Or if you have some pent up anger you would resembling to vent, nail the ba$tard and he still can't touch you. It's not your debt.
Tell them they own the wrong number, ask they take you sour the cal list and never ring back, and droop up...
Also tell them its against the law for them to be talking to you over a bill that isnt yours...
Just suspend up the phone.
Better yet, if you enjoy an answering machine, monitor your call and don't even answer if they are on the phone.
They are harassing you...
Forget calling the police. You need to attain the company's name and a supervisor's label, tell them you are contacting your state attorney general's organization, then do it. Once the attorney general's organization contacts them, trust me, you will not get any more call.
Are you within your rights?
Answers: Mostly
Yes I am, clearly.
Is there any LEGAL phone tracing equipment out in attendance I could use for those telemarketers?
It would be kind of cool to bid them back at the number they are calling me from.Answers: Eh, if you're within the United States, why not put yourself on the do-not-call list? If they name after you've registered, it's a serious fine if they call. Also, Lisa make a good point next to Caller ID.
i agree. they can be frustrating. I don't think nearby is any thing permissible though.
Question about superior court settle.?
a superior court judge realeased a convicted felon from put inside one year early. he shot someone. the pass judgment was friends near the felons father.the felon be drinking in front of my house, pulled out his gun and shot at me, when i asked him to evacuate. he was arrested and maid bail. the trendsetter is now underneath investigation for favoritism among other things.can i take civil feat against the judge for his decree?Answers: Likely not. Under law, a arbiter is immune from such actions.
Your armour sounds justified if the facts are as you presented but can you suppose every criminal ever before a consider suing him because he/she didn't like the judge's outcome?
Sounds like the right course is self taken. Cooperate in this investigation. And if the mediator is elected in your state and is still contained by office at the ruin of his term, see if you can join in a cause to defeat him for reelection.
Good luck.
No.
ONLY the agency surrounded by your State that disciplines judges can do anything.
Judges own ABSOLUTE immunity from civil suit for the arrangements they take from the bench.
Even if he'd released the guy within exchange for a flat out bribe you couldn't sue him.
Even if he'd jailed you for no reason at adjectives other than that he needed you out of the way so he could seduce your 8 year dated daughter, you couldn't sue him. He could be removed from the bench, he could be disciplined and criminally prosecuted - but you couldn't sue him.
Richard
Yes, you can take civil commotion, but first you should file a complaint next to the State Bar Association. They MUST give you a declaration, and if its in your favor you next take your favorable declaration to civil court for civil action against the sort out. Without a Bar Decision in your favor your likelihood are very poor to win anything against a intermediary.
Hypothetically speaking..?
Say a high college teacher is caught purchasing banned drugs from a student. What would the punishment be?
Answers: They should lose their Job.
The incident should be reported to the police.
he/she should lose all learning rights forever and imprisonment.
Student should go and get punished also and lots of counseling!
It would depend on the jurisdiction, the type of drug, the teacher's criminal history and whether the teacher be hired on a part-time contract principle or full-time and permanently.
They'd probably be suspended until the outcome of the criminal valise. If the teacher be fired, and then the charges be discovered to be unfounded, next the school board could be sued for wrongful dismissal.
As far as the criminal charge go, punishments vary widely if the guy be found guilty. Obviously a guy with 5 historic criminal charges, who is trying to buy a kilo of cocaine, would be treated far differently than a guy who's caught trying to buy a joint of marijuana.
A Plus extra credit. the student become the teacher...he sell premium weed...probably Thai Stick...smoke that s-hit up
