Is my Durable Power of Attorney legal if it have nickname instead of birth describe?

My friend signed over Durable Power of Attorney to me because he is in prison. Is it still legitimate if it stated his name as "Jim" & be signed and noterized as "Jim". Yet his birth given name is "James" I didn't realize this until after it be returned to me. It was a mistake on the creature who made up & printed out the POA, because "Jim" is the only mark he has ever gone by. I stipulation to know if it is still binding in court if his brother wishes to fight me on trying to fiddle with money & property matters at foot.
Answers: I am not an attorney but I believe that it is still legally binding near Jim instead of James but to be on the safe side I would return with 1 that said James
Basically it's like this - if "Jim's" brother doesn't bring in this the first thing he argues more or less in court - the wrong identity - and get into the actual subject matter inside the DPOA (usu health or finances), the court will proceed beside the debate.proceed with the debate because it is ASSUMED by process of ruling that the identity is not at dispute.

Once the argument on the subject matter is at paw, Jim's brother can't go put a bet on to the argument about the identity, because he have already waived his right to argue in the order of it.

This approach keeps the court from chasing its own tail. So in attendance is an order of precedence. this is approximate, don't quote me:

Identities
Citizenship (where identity live)
Jurisdiction of court
Type of trial
Right courtroom for type of trial
THEN the subject matter

My boss keeps taking food out of my cubicle. Even after I told him not to. Is he breaking the imperative?

Answers: No, no real law have be broken, but you can, If you are indeed allowed to have food here,
1: lock it up,
2: carry it posterior & fourth from home with you, or
3: be paid some laxative laced brownies for him to find.
did he relate you that your Not supposed to have food within your cubicle ?
are you the one breaking the rules ?
Well first you need to find out if you can own food in your cubical? afterwards if yes if you can why don't you just see it way more than you are presently or LOCK IT UP and put your name on it or lately put your name on it and see if that help . Maybe you should see if it is some sort of harrasment for him to be doing this kind of entry and go along those lines or walk higher than him to his boss and complain to him!!unsurprisingly that is if it is okay for you to hold food at work cuz I know that I can not have food at my work station!!
No. What directive would he be breaking? And don't follow the advice of anyone advocate poisoning the food he takes, because that DEFINATELY is against the statute and you can go to prison for that.
Seems to me that when a party takes something in need permission that would be call stealing.
If you go by the statute from my state which states that Theft is: "the taking and holding the property of another short the owner's consent" then it sounds similar to, from what you've written, a theft.

However, are you permitted to own food in your cubicle? If not, you are contained by possession of contraband and that is allowed to be removed from the premises.

Now for the practical side of the argument. It would be a greatly foolish idea to report this embezzlement if you want to keep your employment.
Depends.

If you are NOT permitted to hold food in your cubicle, after he can remove it.

Contractor, Owner Feud Over Hidden Cash?

http://ap.google.com/article/ALeqM5j3pn0...

A contractor who helped discover bundles of Depression-era U.S. currency totaling $182,000 unnoticed behind bathroom walls said the homeowner should turn the money over to him or at lowest possible share it. Kitts asserts he found lost money, and court rulings in Ohio establish that a "finders keepers" canon applies if there's no reason to believe any owner will reappear to claim it.

Do you consider she should share the money if so why if no why?
Answers: I assume the contractor was self paid by the owner to do work on the property. The property and everything on the property belonged to the owner. To me, it would be approaching if a contractor hired to build an addition found gold ingots while digging the foundation. He couldn't stake a claim to the gold deposit, it would belong to the property owner.
"Finders Keepers" with the sole purpose applies if the find is not in the primary residence of a homeowner.

In this grip, the owner's private property rights (and the fact that the contractor be hired to be on her property) trump the Finders Keepers law.

If it be me, I'd share, but it isn't my call.
Its the homeowners and not the contractors but I would share it ot would hold. Since the contractor is throwing a fit I would probably not give him anything.

Am I married by common decree in Texas??

I own lived with my boyfriend contained by Texas for 2 and a half years. We be on an apartment lease together and now he bought a house and we both live here. I am not on the morgage of the house and don't reward the morgage, but did pay rent surrounded by the apartment. What makes you adjectives law married? Everyone keep teasing us that we are married within the state of Texas, is this true?

To own a common imperative marriage you must agree to be married, hold yourself out as married, and live together as married. The reality that you live together, in and of itself, is not sufficient to establish a adjectives law wedding ceremony, unless you both agreed to be married. This is true even if you lived together 100 years.

For more information, I suggest you consult the Texas Family Code, which describes common ruling marriage as "informal conjugal." A link to the Texas Family code is below.

You could be (smile).

Texas call it an "informal marriage," to some extent than a common-law marriage. Under § 2.401 of the Texas Family Code, an informal marriage ceremony can be established either by account (registering at the county courthouse without have a ceremony), or by meeting a 3-prong interview showing evidence of (1) an agreement to be married; (2) cohabitation in Texas; and (3) representation to others that the party are married. A 1995 update adds an evidentiary presumption that here was no wedding ceremony if no suit for proof of marriage is file within two years of the date the party separated and ceased living together.

Hope this help

What does committing a crime imply?

If you have no choice in committing the crime, are you in consequence guilty of it?

Example: Policemen in your neighborhood are extremely careless and hurt relations to get what they want; sometime they accidentally shoot your father and take no responsibility for it. You're parents are speeding not enough to get to the emergency hospital contained by time, but break the law by doing so. You are surrounded by the car and are 11 years outdated and have no influence in the situation. Your parents are held by the police within the way to the hospital.

Are you consequently guilty of the crime and should therefore be arrested? Are your parents guilty of a crime considering their circumstances? Are the cops (and their behavior) completely irrelevant to the situation?
Answers: The cops behavior is irrelevant.

The driver of the vehicle is the only one liable for the speeding charge.

The defense to the speeding charge is "justification"--the necessity to break a second-rate law to set free a life.

Whether the defense works or not depends on what other alternatives be available--calling an ambulance, etc.
Actually a bona fide emergency can be an excuse for speeding. The court will take into side all aspects - road conditions, the type of emergency, traffic pattern - to determine if the amount of wanton conduct exceeded any true need to mitigate the emergency.

Can a common statute marriage from Texas be reasonably recognized contained by Louisiana?

My fiance and I just get a declaration of informal conjugal from the county clerks office here within Texas. His job is base out of Louisiana and they are telling us that because they don't certificate common ruling marriages they can't append me to his insurance. I read up on Texas common ruling and found out it's as legal as a definite marriage, if we split we'd enjoy to go through a divorce and everything. So shouldn't it be customary as legally binding surrounded by other states?
Answers: If you follow the procedures in Texas for an informal matrimonial, it is just as binding as any other wedding and is recognized surrounded by other states, including LA.

Your problem is in recitation the employer that it is a "common imperative marriage". It is not. It is an actual marriage.

You might obligation a Texas lawyer to write a memorandum to the employer to clarify this for you. Good luck.
As for "common law" that might depend on the state. As for "allowed marriage," the Full, Faith, and Credit Clause surrounded by the Constitution provides that marriages from state to state are 'usually' celebrated. The issue with this right in a minute is gay marriage. Almost 20(?) states own amended their Constitution making gay marriage iffy, preventing recognition.

To create it binding, why not just budge through the civil procedure and get married?
I don't agree beside this, but all states verbs to recognise common-law marriages with permission contracted in those U.S. jurisdiction that still permit this irregular contract of a conjugal

Why not just run through with a civil ceremony at the courthouse? If you want to reap the benefits of a legalized marriage later you should be willing to stir through with the actual article.
