Child law????
my step daughter asked her father contained by wisconsin if she could spend christmas with her mother and i contained by california. he said yes. then changed his mind. i try not to influence my (step)daughters decision and want her to see her father out of state. my ?? is how old does a girl own to be in demand to make a permitted decision contained by the state of california and wisconsin??? she is 9 yrs. old. thank you for links or any info i can obtainAnswers: In Pennsylvania the age is 12 to be able to choose where on earth you would like to live/visit. Or at tiniest it was when I be 12 :D From what I have hear the age limit is smaller quantity then that. In most states however the age list seems to be from 12-16. First I would speak beside a lawyer and see what he say is the age of choice in CA. Secondly see if she can source with her father (this may enjoy already happened...I go through the same point growing up). If neither of this works speak to a lawyer and see if it is possible to progress to court and allow the child to speak. In some rare cases if the child feel threatened and/or scared within her father's home you can all speak within front of a court and plea her rights at the age of 9 where she will be allowed to choose where on earth she would like to be. Because of the father I have growing up who liked to hold me just for holiday's to show me past its sell-by date I probably have a apposite idea of what is going on. If he is anything close to my father he really only care about that and if she chooses to stay aft he will merely make threats. It is what cowardly father's do to upset their children and ex-wife. I hope this falls contained by her favor though...it would be awful to see a child go somewhere she did not want to be at any age.
skulk are we talking its his turn to own her for the holiday and she wanted to stay beside you guys or does he have custody and she desires to come and see you guys.maturity plays a factor here.if the first is the shield then within probably is nothing that can be done...it is his right and is set forth within legal agreement. reasonably you would have to contact someone surrounded by your state - probably an attorney...if there are no trust issues at this point next to your step-daughter and this is not just a power play or a tantrum after that avenue should not be necessary.use your judgement.i assume the father is giving flack nearly this.if that is the satchel then it is unhappy that he is using your step-daughter as a pawn contained by his own agenda to get hindmost at his ex...otherwise chalk it up to a father who wants to spend christmas next to his daughter
Plea bargain?
I be arrested for burglary although didn't actually commit burglary. My attorney has be talking next to the DA and has said I own one of two option. I can any go to trial (lots more money) but there's a 90% unsystematic I'll win. Or I can get the charge dropped to a county ordinance disorderly conduct, clear a $100 fine, and court costs ($150). My question is if I cart the second option, and I swarm out a criminal background check will it show up as burglary? Or a County Ordinance? Or at adjectives? What should I do?Answers: Things that can appear on a background check: felony, misdemeanors, civil lawsuits, bad credit. How much of it appears depends on how thorough the framework check is, which usually depends on how much is spent on the investigation.
Things that don't appear on background checks: juvenile store, traffic tickets and "infractions".
The county ordinance disorderly conduct charge may be an infraction (nothing on the background check) or it may be a misdemeanor (maybe on the environment check). Your lawyer should be capable of tell you the difference.
If you plead guilty to the county ordinance charge, and if it is a misdemeanor and if it does show up on a check, it will appear as a conviction on the county ordinance charge, not as a burglary.
To plea wrangle, you would have the county ordinance charge on your diary...but not a burglary charge.
IMO, accept the plea barter...90% isn't 100% you know.
Why take that 10% opening that you could get charged if you enjoy a biased jury?
Felonies are the only entry you need to report on a framework check. Misdemeanors, include traffic tickets (i.e. city ordinances tickets), and don't show up on a surroundings check. From how I am understanding this, thats adjectives you will be receiviing is a misdemeanor county ordinance ticket. But to be 100% sure ask your lawyer, he will know how to answer this for you correctly.
Also, if you didn't do the crime you could take it to court, be found not guilty. Then you could help yourself to the county to civil court and sue them for your court costs and damages.
Plea bargins are one of the ways the courts un-jam their agenda! If you are truely innocent (you & god know) go to trial.
Can I sue for being pepper sprayed by guarantee at a night club?
I be sprayed with pepper spray at a dark club(Detroit, mi) for no apparent explanation, by a security guard. I be not even in the club even so and we were negotiate a price to enter the club. Whether you'll win is the question!
caught on whose camera? the club?
I don`t know the reason wasn't adjectives to you. did you ask why you were sprayed?
so what if you be pepper sprayed. get over it.
do you enjoy credible witnesses?
if you do you might succeed in a settlement.
if you hold credible witnesses. or it is on camara and it was unprovoked. hell yeah. can i grasp a cut? you could always steak the place out, find out which coup¨¦ he drives and key gash it. tough guys hate that.
I'm sure he have an incident report written detailing everything (whether truthful or not) to cover his butt in the event you did try to sue.
Other than humiliation, you're not hurt, so I would opt for calling the manager and letting them know the situation...because if it is truly how it go down is how you said it did, then he's not equipped to be warranty anyway.
OF COURSE you weren't doing anything.
Yea, right!
Girrrlllll, going clubbing in Detroit. You own my sympathy. Born and raised nearby (not Eminem style either I be 313 my whole go there). OK, you can make a police report and later pursue civil damages. Was the guy on drugs? What kind of door monitor pepper sprays paying patrons? Was he aiming for someone else?
Yes, if you can land footage showing that you did nothing to craft the security officer be aware of so threatened where he have to pepper spray you. But usually when something like this happen and there is a cassette and the person know in that wrong they wont give it to you. So I vote pursue the case and trademark sure you have credible witnesses.
Negotiating a price? You made no threats to HIM.
Sorry, but by your own words, it sounds resembling he was doing his errand to keep things beneath control and secure; if here is video with nouns it may help his satchel more than yours.
yes..of course
why would HE spray that point to u without reason .
maybe HE is crazy...hahahaha,,,,,,(i guest)
you can probally sue but keep hold of in mind you will necessitate sound witnesses and /or a cartridge would be better even if someone maybe record the conversation anything other wise its your word against hes .
If within is no evedence Id say no but what you can do is consent to all your friends and loved ones know have others hold and eye on the customer service if you know neighbors anyone not directly related to you that go there ask if they own had simular problems .Was the police call they have statements that will be supportive . Best of luck .
Well if you did nothing wrong and its on camera.. most potential yes.. well you are within the US you can sue for anything.. go for it lol
I do Security not at a club but I at businesses and you know what? Theres other something that the victim is going away out of the story. Yes there are bleak Security Officers just approaching there are unpromising cops but trying putting yourself in nearby position someone coming up to them trying to negotiate a price can you imagine how various other people be trying the same damn piece? I work 3 jobs my pt charge is Delivering pizza and you know what gets older to me is every damn time I drive into a apartment complex some idiot yells out "Got any free Pizzas" assume if you asked me that very same sound out after being asked that 10 times nearer and your the one that i get feed up with and make clear to you to get lost loser.
heck yah. carry yo money
You wont win.
You were surrounded by a private business (by your own choice) and a member/employee of that private business sprayed you.
Get it?
If you were on public property it would be a different situation.
I think everyone that be ever Pepper Sprayed was sprayed for "no apperent reason". Do yourself a favor and tolerate it go. The with the sole purpose winners here would be the lawyer.

Answers: No, it's not against the law yet within CA but it is wrong. It will do so much harm to kids (and anyone else) you hold no idea, close to diminishing their lung capacity for go, causing chronic bronchitis, and of late all around horrible for everyone's strength, not to mention how it makes them and their clothes smell resembling a dirty ash tray.
That will be next!
CA legislators are really busybodies. But within the case of smoking: suitable.

How do I get power of attorney?
How do I be in motion about getting power of attorney over someone surrounded by jail? Is it something that desires to be notarized or is it just a simple form that can be mail? Thanks!!
Answers: The inmate signs a general power of attorney (giving you the authority to do adjectives business on their behalf) or a special power of attorney (listing certain tasks, anything not down is something you can't do).
The exact form will vary from state to state, and a notary is usually required. The inmate MAY own access to this service in young offenders` institution, depending on the facility.
is the power of attorney in your nickname? then if the other being has it afterwards they should just e-mail it to you; but if its in someone else's dub you've no business in it...

What happened to corporate responsibility? What happen to business ethics?
And if you're too stupid to work out how that adheres to the bottom row, take a look at what happen to your public relations:
Answers: A couple of things here.
1. That is a dead join
2. There is no such thing as, "Business Ethics".
Business Ethics is what they educate 18 year olds in college who aren't exactly sure what they want to be when they, "grow up" but they know they want to run to business college for 4 years.
I've never felt approaching eating Taco Bell.I one-sidedly think it is gross and other has be.
But to answer your question no companies solitary care almost themselves and the dollar. They do not care something like people.
"Corporate Responsibility"? Ha! I scoff at the greatly idea.

What freedoms would a government sponsered video surveillance system infringe upon?
Funded by the federal management and set up at high-risk locations, looking to stop terrorists.Answers: The Forth Amendment - unreasonable search.
In a free country, the individual's privacy is protected. It is affairs of state that is underneath the microscope. The people call for to know what the politicians are up to.
In the totalitarian state, Communist, Nazi & c, the state needs to enjoy everyone under suerveilance, supposedly to protect them from terrorism. In certainty, it is to protect the criminals who run the state.
In a free society, governments don't be paid secret deal with other government. When the rights of citizens are violated, the offender go to jail. Alberto Gonzales admit violating the rights of American citizens beside his application of the missnamed "Patriot Act". Why hasn't he been indicted?
We can stop terrorism intensely easily. All we enjoy to do is mind our own business. They truth is, our politicians aren't trying to stop terrorism, they are exploiting it. They are using the threat of terrorism to destroy our rights.
Define 'terrorist', that would be the first problem. Is it to be anyone that the Government fears? Is it to be anyone for any grounds? What is that definition?
Leaving that aside the other problem is that once Power gets those that are subject to it to adopt on small violation, base upon what ever reason; they will other multiply similar reasons until they are surrounded by total violation of everyone that is to say not in Power.
This is newly a different way of asking: Is it ok for the Government to pocket my liberties for the sake of financial guarantee?
And the wise answer is always--NO, NO WAY, NO HOW!!
It sounds worthy, huh? Until you stop to think roughly speaking it a little bit.
Those cameras would not be put near "to stop terrorists." In the first place, how do you STOP a terrorist with a camera??
There be cameras all over the place on 911 and not a single camera stopped anything that morning!! And if these damn politicians were even CLOSE to human being serious about stopping terrorists, they would be doing deeply of other things ..like doing something nearly the borders instead of pretending there's not a problem in that area-(and if you don't know what's going on contained by Texas, Arizona, etc.-then start looking into it-you would be shocked!!).. Maybe this gov. should do something about the KNOWN terrorists they consent to wander around here in a minute! Maybe they shouldn't be wanting to give NON-citizens of this country drivers license; or maybe they should be cracking down on adjectives the illegals who are stealing everyones ssn#'s...and on and on...THESE are the things that will help stop terrorists...not a camera..The cameras they want are for ONE purpose-to put their own populace under surveillance..Public place or not---your personal freedom of self able come and run as you please without everybody watching is gone...It's nobody's business where on earth your at every time you move... If you want to know if your license is valid, check near the DMV.
if we let the cat out of the backpack, then we can't charge family $10 anymore.
Pledge of allegiance?
I was wondering if anyone know whether coercing students to say the pledge of allegiance every morning is lawful in California? My daughter (4 years old) refuse to stand for the pledge because she said she "felt funny" in the region of how all the children stood together and recite it at the same time, and she get disciplined. Is this legal?
By the road, I fully support my daughter. I want her to love the United States on her own terms, not through a coerced pledge of allegiance every morning. Rude answers will be reported.
Answers: There is no requirement to read out the pledge, to stand or to put ones hand over one heart.
Since the dumbheads added "lower than God" to that patriotic pledge, it have become an affirmation of religion.
You need to enjoy a serious talk to her coach and remind the teacher to hold her political views to herself.
And, congratulate your daughter for standing up for what she believes --- at the tender age of 4. You're doing a obedient job near, mom.
I think it is great that your 4-year-old already have a strong personality and is competent to question and believe about things relatives never consider.
I don't think it is court to force someone to say it, but I've other been told to at lowest possible stand as a sign of respect. She shouldn't have be punished for it though.
In order for school to receive support from the government they must acknowledge US holidays supporting the country and must also support the country by proverb the pledge.
Please tell your daughter of this hurry, and dont spoil her with her "rights" resembling my mom did to my sister, who is in sixth position and expects us to do her homework.
She should respect adults and do as told.
She is only 4 years antiquated after all
I dont guess its legal to clear her do it, but out of respect for the thousand of people who enjoy died so that she could be alive, she should probably say it. Even if she doesnt agree, thousands hold died and more are dying so that she can have the right to existence.
And she is only 4 :) I dont come up with it really matters, but I am glad to see some strong minds and civilized parents!
Disciplining a 4 year old for not adage the pledge is extremely harsh. 4 year olds do not infer what the pledge means. If this is a public pre-school I would accessibly complain to the principal and/or board of education.
That man said, I'm sorry but it sounds like you are against the pledge (coerced) and your child may be picking up on this. Are you sure that this is your child's verdict or yours?
If it was my 5-year antediluvian son that came home and said he feel uncomfortable proverb the pledge, I would probably assume that there is something else bothering him (like a alarm of not being competent to remember the words). I don't think young-looking children understand the concepts of manipulation. If your child be older (say contained by high school) afterwards I would stand behind their judgment. But at that young of an age, I chew over this is a problem you have...not your child.
Sorry it's probably not the answer you want, and I'm not trying to attack you. I merely wanted to point out my honest observations.
EDIT: I follow better, thank you. Still, not knowing your child who may very all right be advanced, I would say that most 4 year olds don't hold an understanding of cohersion and I would guess that there be something else to it. Reading what you wrote, it sounds to me like she have a problem standing and reading as a group...not necessarily with the pledge. Again I would ring the teacher and address with her. Explain your side and I'm sure you'll see it be a simple misunderstanding. Most teachers freshly wants what is best for the kids.
Heaven forbid she say "God". Oh, did I just read aloud heaven?
SORRRYYY!!!
Wouldn't want to outrage anyone.
