Do I need a advocate for a DUI case surrounded by Califonia? What are the fines/penalties of DUI in CA?

i crashed my vehicle while driving under the influence. i did not hit anyone or hurt myself (thank God). As i be about to christen a tow truck to tow my car , nearby comes the police. They asked me few questions which lead to sobriety and breathelizer test. I score 0.11 BAC above the legal restrict, arrested and jailed for DUI. I will be going to court soon. My lawyer requests $2500 to represent me in court? should i use my advocate or just be in motion with a public protector? what kind of fines/penalties am i gonna be expecting? what preparations should i get before the court date? this is my first dui shield so any advice will be appreciated. trust me i've learn DONT DRINK & DRIVE.
Answers: You might not get a public supporter appointed. The Court will look at your income and assets, and might determine that you can afford one, even if you think you can't. If you've get a job, I'll bet the Court will deny the public supporter, or expect you to repay the Court for his/her service.

The breathalyzer reading is prima facie evidence that you were intoxicated, so it might be rock-hard to beat as your .11 is above the .08 boundary for prima facie evidence of DUI.

An attorney might be able to go and get you into some sort of diversion program or reduce your sentence. In my experience, $2500 is cheap for a devout DUI attorney.
If you admit you are guilty, and it absolutely looks like you are, after tell the prosecutor/DA/County Attorney that you a moment ago want to plead guilty. Ask them to dismiss any simple misdemeanor companion cases in exchange for you pleading guilty and getting the minimum punishment.

Google the penalty for OWI 1st in Cali.
Glad you "learnt" that, if how to spell.

Yes - pay the 2500 for an attorney - otherwise the courts will of late chew you up and spit you out and it will cost you far more in the long run.
Ok, I lately got a dui. Here is what I received:

$1648 fine
First time DUI Class (3 Month) $545
MADD class $35
HAMM Programm $100
You must very soon get a SR22 beside insurance

if this is your first DUI, you do not need a attorney.
$2500 is about right for an attorney. and you want one. Here's the deal. A DUI is serious and even though you didn't hit anybody the certainty that you were contained by an accident make it more serious.

If you show without an attorney the consider will feel that you are not taking this seriously and will throw the book at you. An attorney may be capable of cut you a deal of some sort. And if you factor surrounded by how much this will effect insurance 2500 is worth it.
Don't plead GUILTY! That is the absolute worst direction you can get, and it's irresponsible.

You can probably procure a plea deal surrounded by which you would get a minor charger in exchange for a No Contest plea.

Get an attorney. Don't steal advice from strangers on the Internet!

Good luck to you.

Is it illegal for your boss to snoop through your laptop at work?

Answers: No.
If it belongs to the company you work for, yes.

If not, yes. He can see what you've be doing on the clock.
Your personal laptop? In general yes. If it is the companies laptop, later no.

If it is personal but you are doing company work on it.I'm not sure. I think it is still unendorsed, but they could argue they had a right to the information contained therein.
If the computer belongs to the company consequently no - they have full rights to the computer and anything you do on it.

ALSO - if it is your personal laptop and you are using the Company net on it - then they still own a right to know what you are accessing.

If you use ANY company assets - including their internet access point (wired or wireless) - afterwards you are using their property.
If it is a personal laptop, then your boss have committed a civil trespass to chattels if you didn't grant her any authority to use the laptop, EVEN if it's connected to the company net. "Company policy" does not grant them consent unless you SIGNED OR AGREED TO SOMETHING to that effect SPECIFICALLY.

Your boss would own a privilege to unplug it from the wall at work, or unplug it from the company network, but not to snoop, and clearly not to take it.

Laws in China?

Does anybody know if nearby are any laws surrounded by china that limit the amount of children the Chinese can own? I know that there used to be a rule where on earth they could only hold 2 to 3 children, but is it still around?
Answers: I live in the crucial part of China as an ex pat from the USA. I enjoy spoken to people something like this issue, plus looked into the way the senate administers it and why it be done.

If China had not instituted the one child rule, in attendance would be 400 million more people. That is more after the USA population. The landmass of China is slightly more then the USA near less arable landscape. Before the one child rule was put contained by place, it was adjectives for families to own 5 to 10 children.

The one child rule is for the urban and city area's. Two and sometimes three children are allowed in the countryside. Some religions are exempt from it adjectives together.

Twins are highly prized contained by China. Children are not put to death contained by China. That is a rumor put out by China haters.

The rich circumvent the one child rule by paying the huge fines. Beijing recently started a electioneer to ostracize the rich for doing this.

The people get the message the one child rule, and while many don't approaching it, they all agree China is too crowded and as a result support the rule.

Gender selection is a problem, but not nearly as much as tons people focus in the west. According to the CIA world facts book (viewable at http://www.cia.gov ) if I remember the facts correctly, instinctive selection world wide open is about 1.05 males born for every womanly. The USA stands at 1.06. China stands at 1.11. Therefore, gender test in China represents .05 to .06% more respectively. China have recognized the problem and made sexual category selection against the regulation, plus curtailed the use of sonograms to help enforce that.

The country to really see out for is India. They have a population to be precise only 200 million smaller quantity then China near over twice the birthrate of the USA. They have ethnic group planning and obviously it is failing.

Peace

Look at their world facts book, verbs up India, the USA and China, compare them side by side. You'll find the problem does not really rest with China, and clearly not the way most within the west think, but more next to India who's population is growing rapidly and income disparity and poverty are increasing, while they verbs to build up their military. (China's military is going through modernization which is badly needed and presently they can afford it. They also reduced their military by 1 million a year ago)

I think the statute is that a couple can only own one child..

I got charged beside a DUI in California, it be reduced to a Reskless Driving. Can I get this expunged?

If I can obtain it expunged, how much does it cost and how long does it take? Also, if expunged from my criminal story will it ne removed from from my DMV printout?
Answers: Getting a reckless driving charge expunged is a really well brought-up idea. You really call for to talk to an attorney, though, or I don`t know a few, to find out what the fees would be. The attorney would also know about the DMV issues.

The best source for DUI information on the Internet is

http://www.totaldui.com

They enjoy state by state information on DUI laws, lots of DUI articles, and a form you can overrun out to find an attorney.

By the way, a friend of mine hired an attorney to find different (non-driving related) charges expunged from his record surrounded by Illinois. It was smaller number than $1k total. If I remember correctly, the charges and outcome are no longer public but I believe police still have a dictation of the arrest.

Anyway, good luck to you. Definitely gain the expungement.

What is wrong with making this video public if nearby is no sexual content nor porn or any child endagement?

http://video4people.blogspot.com is a video of a phone message from a mother to a daughter and you see the daughter's reaction and the video go on quite clearly but it's a mixed bag as to what the ramification of posting this are if there is no money or libel involved, a short time ago to show people at hand are worse phone messages than Dog Chapman and Alec Baldwin!
Answers: http://video4people.blogspot.com can only be destructive to the girl in the video crying as her mother scream into the answering machine unhampered so I guess purely as though no one know the name of http://video4people.blogspot ' s daughter's mother than it is fine. The daughter that videotape it already consented to her name as in good health as her friend who the mother mentions quite clearly and who the daughter mentions too, so it seem okay just something to revise from and know that there are even worse voice mail to family member from their mothers and fathers than merely Dog Chapman to his son and Alec Baldwin to his daughter! Listen for yourself and make the determination, it's intensely interesting to hear this!
The legal issues depend on within what state the recording be made. Without that, there is not a soul who can tell you the consequences.

I would also necessitate to know the context of the message: was it live or a recording/voice e-mail.
As it appears this was a voice communication or answering machine message she should not own an expectation the message is not being record. The courts have held that a individual leaving a message is by their activities consenting to being record. Since both parties consented to the demo it should be legal surrounded by all 50 states.

She have no basis for claiming slander as you are using her words unaltered.

I can see no issue beside displaying the video or sharing an audio file of the message.
the just problem i can see is - perhaps - making something private public --

if she be to sue her lawyer would probably look at invasion of privacy - but not entirely sure that's a in the lead argument - (depends on the state, court, etc)

as a general rule of thumb, i'd say-so, if you're not sure something like this is trial then newly don't do it -

Good luck

Can I get a restraining decree to make sure someone never call me again?

I am a business owner and there is this insane individual I used to buy product from. I cut ties specifically because she was so rugged to work with and would bawl and be really mean (even though we be making up something like 10% of her business - duh). So today she call and I don't even know what she was clich¨¦ because she was yell so loud and using such profanity. She eventually hung up and I'm still not exactly sure what she said. Is there any course I can make it banned for her to call here anymore?
Answers: You can achieve a restraining order to block someone from contacting you, but I don't believe you gather round the standards (yet) in this bag. You must be in physical threat -- consult an attorney.

You can simply block her number, there is a handset service option for doing that.

Having said that, you may contained by fact be contained by personal danger--how crazy is this person? Start documenting everything, especially if you see her slack around your store, your home, or following you.

If you see her, you may be able to hold her charged with stalking. Consult the police once you hold a few incidents documented, including telephone call (phone calls count as stalking behavior underneath the right circumstances.)

Be careful!
Called Harassment

You can if you can prove it.

Why cant people get up their minds???

Have ever known some one that other says how much they disgust cops but then at the first sign of trouble they pick up the phone and give the name the very individuals they claim to hate so they can facilitate them?
I know a few people similar to this. DO you?
Answers: Yes, these are the same family who are against war, but support period of war mongers, and judge others. They are small minded those that need to be cleansed and sterilized.
Unfortunately, almost everyone is approaching this. Most of my friends hate the cops but will turn to them within a second if they need minister to. I actually similar to cops. Unlike most people, I realize that most cops are not the jackasses that you see on television tasering race. Most are good honest citizens who are trying to keep the communities not detrimental.

Tasers and death and my condition?

So i am going to put my self through a college police academy in So Cal and required to know if anyone can help me out next to this question. I am 33 and enjoy border line high-ranking blood pressure "heredity" and in correct over all vigour, taking two pills a day low Mg's and below doctor's care and required to know if a person get tased in the academy could this be desperate or even deadly if they hold high or border smudge blood presaure?
Answers: First, in response to the IDIOT above, VERY FEW family who are tased die. Between 2001 and 2005, there be only 103 taser/stun-gun related departure in both the U.S. and Canada combined. Think of the thousands of the police officer in acadamies across the nation and how oodles times they are tased, and how many hundreds of time respectively day criminals are tased for non-compliance. You enjoy a better chance of dying surrounded by a car chance or from a lightning strike than from the shock of a taser.

The taser should not have any adverse or long-lasting effects. Contrary to what you hear on T.V., the electrical current does NOT leave behind through your body. There is no way that it can arc across your heart or any other essential organs unless you place one electrode on each side of your body cavity.

The "spark" or current pass the shortest distance between the two electrodes, using only the small nouns of skin between the two as a conductor. The electricity itself does not incapacitate the body, that effect comes from the pain and "overloading" of the over-sensitive system. And again, contrary to what you hear, you are NOT incapacitated for two minutes or whatever the claims may be. The second the electricity is removed, your jumpy system returns to normal; repossession time however varies from soul to person (heart rate take time to slow as well). If your heart can withstand the stress it endures when doing the running event of the physical fitness examination, it can withstand the rate it will go to when tased.

Tasers work by utilizing dignified voltage but low amperage. In an electrical current, the amperage is the aspect which is most harmful.

Also, at the acadamy, medical staff will more than credible be present and with the standards most departments preserve for health of their officer, you probably would not have be permitted to go to the acadamy if you weren't nutritious enough.
Are you going to ask suspects that you're almost to taser to fill out a medical questionnaire first?
To answer your examine high blood pressure could be considered a contributing risk factor because giant blood pressure can affect the heart. The heart is the organ that undergoes the most stress during a tasering because the electricity from the taser can interfere near the electrical impulses surrounded by the heart, causing it to hiccup.
It doesn't sound similar to your pressure condition is severe enough to hold affected your heart. Normally it take several years of persistent elevated blood pressure to enlarge the heart, so within your case the risk factor is little or none.

College application costs/racism?

Okay. I'm applying to a new college for the plummet 2008 semester. I'm pretty low income and really don't have the money right immediately for application fees because they are like $50 and I enjoy bills. I e-mailed this particular college and asked if here was some agency to waive the fee of the application. The response I recieved be "Black students are eligible for an application fee waiver."

Is this racist? Is this private?
Why does race determine application payment waivers?
Shouldn't it go by income?
What can I do contained by this situation?
Answers: There should be a signature at the bottom of your letter. Yes it be rascist. Go to www.scholarships.com
The human being who told you that should be reported to the U.S. Department of Education and your State Attorney General's office- Consumer affairs Division.
It's racist. It's not illegal.

Welcome to America.
whats the nickname of the college please?
i suppose you can call and write them and ask for a waiver of charge based on your income and see what happen.
how old are you? cant your parents comfort with college app fees? and of late apply to the two or three you really want to go too.

Name of college please!!
Certain minorities enjoy proven financial hardship for a roomy sector of their population and have a break because of it.
It is permitted. Yes it should go by income, but if u really want to be in motion to college, saving 50 bucks is not too complex to do, even if it means delay application for a semester.
Please do not get discouraged, do what it take and move on.
I agree that nouns comes in financial form and this seem like reverse nouns, but it is a small hurtle and if u want it, do it, even if it takes an extra few months, to be precise a small amount of time for something so important to u and ur adjectives family for evermore.
Congratulations and accurate luck!

Is there a regulation stating that a parent is not liable for their child's actions?

I lately was wanting to download a p2p music service, but my dad is wise saying that he doesn't want to be held liable if we end up getting sued. So he told me if i can convince him that i can download it.please give a hand.
Answers: No, quite the divergent. He can be held civilly liable for your actions. Your dad is right, and you shouldn't break the decree regardless.
Well in some states your parents are liable. Let me supply you a good example... you are messing around sometime, and you decide to dance break a car skylight. The person finds out it be you, but guess what, the people suing, are going to sue your parents because they are over 18. You will be the one surrounded by trouble, but they get sued, and enjoy to pay for it. See my point here? The same item could apply to your parents. In this situation

Although why don't you check the website and see if it has sure rules or restrictions, and check the state laws and punishments.
For things such as this, he in reality IS liable, despite what you want to hear. They are responsible for repairing any damage you've done, including copyright infringement.

In any skin, your parents can always be held liable for anything you do if you obtain sued, whether or not the thing surrounded by question is even iffy. Law does not always win. It will other be a hassle if you get caught.

When good quality DRM-free tracks can be purchased for just a dollar respectively at many places, why don't you stir for those instead? Or, if you seek to rescue even further, why not buy from Russian distributors for only $0.10 per piece?
No, near isn't. If you're under 18, your legalized guardians are responsible for your actions.
