Should my friend get a lawsuit settlement loan?
A friend of mine be injured at work and is looking into suing the company. I was curious what the alternatives for a lawsuit could be (if any) as he doesn't hold money to spend on a lawyer. He mentioned getting a lawsuit settlement loan to compensate for this and I was a touch worried about this.
Answers: People who deal in settlement loans are the same relatives who sell reverse mortgages - they lull society into safety and shelter only to pile on the interest charges and fees until they "keep" the settlement.
Most attorneys surrounded by the retainer agreement will agree to work for no fee as long as they receive a percentage (usually a third) of the potential settlement. If nearby is no settlement, the attorney walks away deserted handed or receive a nominal fee for organization expenses, etc.
"Loan" is a bad point, generally. Most lawyer will work on contingency, they only go and get paid if you win your suitcase or a settlement. There are some services that will loan you money against a settlement already in your favor, or will buy your long-term settlement annuity, but a "loan" lately to help you beside legal costs doesn't nouns good. But I'm not a advocate, so, hey, what the heck do I know?
Good luck to your friend and I hope he gets okay soon.

Legal advice dealing next to marijuana?
Last night I be arrested in Erie County, NY because I be in a coup¨¦ that had marijuana surrounded by it. It wasn't mine and I wasn't smoking. I just happen to be sitting on a joint...I know this sounds approaching a lie but its true. Anyway, My miranda rights be never read to me and Im wondering if that could somehow help me within this situation. Im really nervous that I'm going to own to pay lots of fees and I own never been to court until that time so I have no impression what I'm dealing with. ANY HELP at adjectives would be greatly appreciated!Answers: Failure to give you your Miranda preventive will not help you unless they are relying on a statement you made while lower than their custody to convict you. Failure to mirandize = exclusion of information obtained.
Your defense is that you be not "in possession" but you will probably stipulation a lawyer to hold any success unless someone else within the car cops to self the owner of the joint. If you can't afford a legal representative, you are entitled to a court appointed one.
Don't let a legal representative pressure you into pleading guilty if you are not guilty.
Let me start by saying that I'm not an attorney, and I don't play one on TV. You should want licensed legal counsel for true legalized advice. Nothing that I read aloud here should be construed as actual legal counsel.
With that disclaimer out of the way...
I live contained by Texas, so I can't speak to specific rules in NY, but I'm sure in attendance are similarities so hopefully this will help.
How did the officer find out roughly speaking it? Did you consent to a search of your vehicle lacking a warrant? Were you asked to step out of the car, afterwards he saw it within plain panorama? Were you the only being in the motor? Answers to these questions could affect perception of the legality of the bust or the responsibility of ownership of the shared.
If you were by yourself, later you had a useable amount of marijuana that be under your direct control (according to most state laws) and it would be awfully difficult to prove it belonged to anyone else. If there be other people surrounded by the car and none of them claimed ownership, next since it was beneath your direct control, it still kinda points at you.
As for Miranda rights, those only enjoy to be read to you after you've been arrested if an officer intends to sound out you directly about the crime. Any statements you put together before the arrest are sort of unbiased game as they largely are used to build probable cause when conceivable suspicion of a crime exists. I've read that the best advice when human being questioned by the cops is to politely ask if you are self arrested for a crime and if so then you request an attorney formerly answering any questions.
A small amount of pot isn't usually treated as a big promise, but the prosecutors can make a big concord out of it if they wish.
Best direction I can give you is receive an attorney.
Find out exactly what you were arrested for. More to the point be you charge with. If you be just arrested and released you may not own any problems.
If it wasn't your car and it wasn't on your possession they really do not hold much of a case.
Now that said if you are charged near a felony, then you can't acquire to a lawyer hurriedly enough. If it is a simple misdemeanor's I would still take a lawyer as the facts that you present would not warrant consequently taking you to trial. No sense of having anything on your journal as that can hurt you in adjectives Job applications.
yea i got arrested this previous summer in NJ for possession of mary j contained by a car that i wasnt driving, i didnt seize into much trouble only 3 months prohbation... my guidance to you is get an attorney in a minute and explain them the story so they can present your case to the negotiator before your covering goes to court... honourable luck bro
