Hi I live in Connecticut and a single father raising three children 11,10,7 and i would like know if i can't find the mother, can i file with the a new paper where i known where she was last. And if so, can I file for child support and withholding wage if she don't show up at court. And i have sole custody of my children i try to go to the state for help and they sit on there hands. I find her, tell them, and they can't find her but i go online and find her quick some times it takes a 1 month. She tells me(the mother) don't send **** to my house meaning, when i do find her meaning don't send court papers and then she up on the move again like always . so can,someone tell me what papers to file and how to go about this. and would i go by min wage when i ask for child support and if so what state do i go with. nj or ct .

First off, I commend you for taking care of your children. You are a great man. Its sad that the children are without a mother but maybe its for the best.

What you need to do if file for child support in your state. What ever the state she lives in will be the responding state and yours will be the initiating state. Its called long arm jurisdiction. If you know her physical address don't keep it secret. TELL THE STATE! Go to your local social services building and file a petition for child support and get a court date. If she don't show up for court, a default order will be entered once they impute her income( they only impute if she isn't working). By imputing her income, the state will take her age and use it on an income scale they have. They will average how much a person at her age usually makes, and uses that to set a support amount. Wage with holding is standard with any child support order. If she don't pay right away her debt will rack up and liens will be issued against her property, such as: her bank account, her house, her car, her land, her business. What ever she may own, the state will issue liens on her property, repossess it, sell it, and apply the money they receive to the debt she owes you.

The best thing you can do is go to your State's attorney. In the stte where you live. It will cost you nothing, and he can help you. And she has no right to tell you what to do. Go get her tiger!!

Yes, you can get child support until the children reach their legal age (18 or 21). Paper are gentle file in the State in which you were together before she left the children. I would suggest you get legal assistance for a lawyer or legal aid in you location. The courts will set the amount of money you may receive for each children. Other wise you may have a hard time get any money for the kids.
First you have to file it in the state where you live, which is Connecticut. I would talk to an attorney, but I know in VA that the Sheriff's Deputy has to try to serve her with the papers. If she is not located, then and only then can you place an ad in the paper, which must run 4 consecutive weeks. If she doesn't show up in court after that, then she will be held in contempt of the court. So then if she has legal troubles, they will see that she has delinquent child support, which does not bode well for her. If you know her address, the deputy can serve her personally. Good Luck.
This is what I had to do to track down my ex for support issues. I tried and tried with the "govt agencies" with no results. I can't speak about all states child support offices, but with the ones I dealt with their attitude was "she is the mother, leave her alone, its bad enough she had the kids taken from her".
I finally took a attorney friends advice once I found her in TX. I hired a TX attorney to represent me and things got moving real fast! She tried the dodge of service by refusing to open the door, refused to sign for certified mail, etc. Finally the Judge gave permission to nail the papers to her front door and she was legally served. Then she had the "brass" in court demand that I pay for the door of her apartment from the huge nail the server used. But she was ordered to pay support, of course she didn't and we had to start all over again with the service. It took 3 years of flying to TX, court hearings, delays, etc, and her spending about 3 months total in jail, but she started paying finally. And the child support office had the nerve to send me a complaint letter saying I was being impatient!
My advice is, when you find her again, hire an attorney there to represent you right away! Also, federal law allows the Judge to order the non-custodial parent to pay your legal fees to collect support.
