How do i ask for a change of venue?

I have a mediation hearing next week against my ex. The problem is the new judge is his attorneys sister and has been sort of co counsel for him since our divorce. What if he doesnt recuse himself? I don't have an attorney, that is not an option. How do I handle this, can i ask him to recuse himself or ask for a change of venue? Do I have to file for this? Help! I only have 3 days till court.

Yes you must file a motion asking the judge to recuse himself. Not knowing what state you are in a link to that information is not possible. Try going to your clerks office and see if they have the forms for this. If they do not and you need help finding the correct form feel free to email me and I will locate it for you if possible.


He should recuse himself. I'm sure he knows that your case is coming up. It's a conflict of interest. Call the Court clerks office and ask who you should speak to about getting a change of venue because of the conflict of interest.You should not have a problem, and if you can't afford an attorney, go to the legal aid office in your area. You can usually go in first thing in the morning without an appointment and you'll be able to talk to someone that day. You may have to wait all day, but you should definetly get an attorney.
