Can you file a lawsuit against someone who stole your identity 2 1/2 years ago and you just found out now?

If you just found out they stole your identity now then yeah clearly you have every right to sue, normally time runs out only after about ten years.
civil suits, so far as I know, have no statute of limitations. Even if they did, the damage of identity theft is "ongoing" so long as there are outstanding debts harming your livelyhood.

Before you file any lawsuit, you have to have good, solid proof that this particular someone did indeed steal your identity. Going back 2 1/2 years for proof will be no easy task, because most criminals of this nature find ways to cover their tracks. You can file a complaint with your local law enforcement, which in turn will direct you to a million other people who have to be involved; the process is slow and painful, with only a slim chance that the perpetrator will be caught...
Your recent discovery of the event makes your suit possible. There is no protections for hiding a crime for a few years and then being able to get away with it thereafter. TYhe statute of limitations for most civil actions is One year; yet, there are many exceptions and your case is one of them.
