Ex is in jail, can I sell his stuff?

My ex boyfriend was living at my house until he saved up money to get an apartment. He wasn't on any rental agreement, and he didn't even receive mail. Well, he went to jail, and he'll be gone for about 5 years. His father, and only guardian in the state, gave me permission to sell his things, except for his car. The reason I want to sell it is because he owes money in back rent and bills. Can I legally do this? I can't give my ex 30 days to vacate, since he's already in jail and won't be getting out anytime soon. My roommate/land lord says that since it was left in her house, it's her property and she's going to sell it. But can my ex take legal action once he's out of jail?

Basically, you are storing this stuff for him and you can charge him storage, file lien, then sell it.

Your landlord is full of it! As long as you are still in the apartment, anything he left is YOUR property and has nothing to do with her! Possession is 9 tenths of the law! Don't let her rip you off! I'd get it in writing from the Father that he gives you permission to sell the stuff, just to make sure you've covered yourself. Hope you make a bundle on it and get your money back! Tell the nosy landlord to go spin on a stick!
well technically there is a 30 abandonment law in some states. so as long as he has been gone longer then that. but on the other hand, in some states, if someone is living or staying with u for 15 days or more, u have to legally evict them. but, he hasn't gotten mail there, so i guess he could be considered as never living there. I would go ahead and sell his stuff, i mean, he isn't going to be around for awhile, and it is not your responsibility to lug around with u if u move.

I would ask him. If he says no, then I would dump the stuff with his dad. You don't want him to get out of jail and freak out on you.

As far as the money goes... you are out of luck.

Yes. The reason being is that according to the state(for example,Florida)personal belongings can be disposed of,but not sold until 90 days of him being out of your property. If his stuff got sold as soon as he went inito jail,he can take action. If it happened like four to six months later,then yeah. You mentioned that his legal guardian gave you permision. If he's over 18,his parents have no business saying anything about his property without a written statement signed by him. More than likely,by the time he gets out of jail,he won't care about much. So go ahead and sell the stuff.
To be fair, if there is anyway you can see or contact your ex to get a written statement or agreement from him to sell his things since he owes you money I would do that first if possible. Since his sentence is about 5 years you want to make sure everything is legal and your hands are clean of him in case he does not do the full term. Always protect yourself when dealing with people and possessions don't put yourself in situations where you may have to become the bad guy.(ie get agreements in writing)
Unless you ex-boyfriend is a minor, his father cannot grant you any authority to sell his property. Your roommate is also wrong--property that is left behind does not become hers. But neither of you is obligated to store it, either, and there is a limit to the amount of time abandoned property can remain unclaimed. Check your local laws. Your ex can take action if his property is sold without his permission outside of the laws concerning abandoned property.

Five years of storage fees are likely to exceed the value of the property. The sensible thing is the talk to your ex-boyfriend and ask him to allow you to sell his property, deduct what he owes you, and give him the balance.

YOU don't get to decide. And the property may not be judged 'abandonned' by the court when your ex sues you for illegal conversion.
