You would have to check if animals other than pets can be kept in your area. Some areas allow barnyard animals some not.

Roosters can get quite annoying with their crowing. You could try going to court for disturbing the peace. I would talk with the neighbor or talk to other neighbors and see if they have complaints as well.

Maybe but the owner probably isn't...
Well, if you didn't guess, we don't have any NATIONAL laws on rooster ownership. I mean, really, did you think the Founding Fathers were gonna put roosters into the Constitution? You'll need to check with your specific state, or more likely city.

Most places have no laws on rooster ownership, but probably some bigger cities have restrictions on farm animals. The rest of us who don't live in the city think you're kinda crazy to be worried about this, but at least tell us your specific locality if you want a real answer.
We had a rooster in our neighborhood the last couple of years before I went to college. The legality of the issue goes to city ordinances and on top off that, to home association bylaws that you get a copy of when you purchase the home. If you are renting the owner can provide you with a copy. Our neighbor said: his rooster made less noise then all the boys roaring in and of the culdesac to date the complaining neighbor's daughters at all hours. (smile)
Find out if your neighborhood is zoned for farming. It all depends on the city/state. He or she can be evicted if the area isn't zoned for farmlands/stables...
