How do i get out of a DUI when i wasnt driving?
I had just sat in the vechicle to grab my cell, truck was not running. I was in a gas station with friend and had talked to a state patrolmen, when i walked outside and the cell was ringing inside the truck, so i jumped in to grab it real quickly. i didnt drive to the gas station, but got arrested.

Some laws define driving as being behind the wheel on a public road. Some require the vehicle to be running. Some that it has recently moved or is moving.

fight it in court. How did the vehicle get to the gas station, Say a friend drove it. Have an alibi. Ask for a jury trial ! You can win the case.

Were you in the drivers seat? Were the keys in the car? Were the keys in your possession? Are there witnesses that say you were seen driving? Laws vary from state to state. Some all it takes is to be in the vehicle with the keys. Always best to get an attorney in these cases, and to remember the DOL/DMV may have issue with you that is separate from this issue and may not be resolved/dismissed even if the DUI is.
