Cross burning?
What type of legal situation would you find yourself in for burning a cross in someones yard? (in ohio to be specific. Outside of city limits) and are there any tricks to avoiding a bigger problem (such as, so many feet away from there house to avoid an attempted arson charge, etc.)
Answers:
why dont you nail yourself to the cross first to avoid any legal problems
Federal hate crime. Don't do it.
The supreme court has ruled that just burning a cross is itself legal, but IF it can be shown that you intended to intimidate someone, then it can be made a criminal offense.
Why would you burn a cross in someone's yard?
If it's any type of property it can be construed as arson.
I believe it''s a federal felony hate crime
I'm sure it's not a hate crime in San Francisco, either.
But, guaranteed, if you burn a Crescent Moon or certain foreign flags, the Feds and all the media will be on your butt.
Burning symbols is not a good way to win an argument, anyway, since it's merely spectacle, not logic.
I suggest making smores, if the local fire department still allows you to make campfires on your property.
Felonies:
1) Arson (10 Years in prison!) right off the top maybe even more.
2) Threat to commit a crime
3) Hate Crime
4) Reckless endangerment
Misdomeanors
1) Tresspassing
2) Distruction to property
Not to mention lawsuits / court costs
You'll bubba's little bit^h taking it up the @$$ for a long time.
Forget about it. Even burning a cross on your own property is illegal, if it can be shown that you did it in order to threaten or intimidate another individual. I know a crazy guy who lives in North Carolina who got drunk off his @ss one day, and decided to burn a cross in his own front yard. He isn't actually a racist or a member of the KKK, he did it just for kicks. The media and varous gentlemen from the FBI grilled him for about a day before deciding that nothing illegal really happened.
