Is this illegal?

my high schools policy on cell phones is if they confiscate it do they have the legal right to hold it for a 15 dollar ransom basically? I wont give up my phone or iPod anyways but i would like to know the legal stuff about it..this is new mexico

If they've spelled out that policy, then they have the legal right to enforce it. If you don't want to leave you phone or ipod behind (or at least keep them phone turned off and tucked in a backpack), then pay the fine or drop out of school.
It is high school. They dole out the rules. You know what the punishment would be and if you don't follow the rules, you deal with the punishment. A $15.00 fee isn't bad to get your cell phone back.
i dont think that is. my freind was listening to an mp3 player when a teacher confiscated. he didnt get back . his parents sued the school the teacher was fired and the school wwas nearly faced a lawsuit
i think they can do it, at my highschool if you forgot to lock your locker the maintenance guy would put a padlock on it and you'd have to pay 5 bucks to get him to unlock it, guess i shoulda brought my crowbar
I am not so sure it is. I think a parent could go to the school and ask it to be returned to them. I don't think they can legally require the 15 dollars, but is it worth the 10,000 dollars it would take to fight it in court?
