Consumer Problem: What are my rights when returning a faulty watch?

I have purchased a watch from H Samuel in early May. Recently the watch has broken. As their customer, what are my rights? As the item is faulty am I immediately entitled to my money back (by law) or do I have to give them the chance to repair it?

I have everything that came with the watch including my receipt.

The Consumer Act 1982 provides that items should be of satisfactory quality which basically means they should last a reasonable amount of time and that would really depend on how much you paid for it.

But before you enquire as to your legal rights..first step is always to approach the trader and ask what he is prepared to do to resolve it If his suggestion is not to your satisfaction...write to the head office and go from there.


It depends upon the warranty and the terms of sale.
You may very well have to accept a repair or replacement. As long as they are able to rectify the situation they are within their rights.

The watch was also purchased more than 90 days ago, in this instance if you be liable for the damage. The watch itself may not have been defective or faulty, it may have been subject to unusual wear and tear.
They can offer to repair it, depends if this is cost effective for them. They don't automatically have to give you a refund, but might offer you a replacement first. In my experience it's best to play it "nicely nicely".....then hit them with the "not fit for purpose" route
There's usually a manufacturers guarantee for 12 months on a watch so they may offer to have it fixed free of charge..failing this if the goods you have purchased 'not fit for purpose' then ask for a full refund or a replacement.
