Do the banks have to pay out if i win my court case next week or can they freeze the payment?
i'm taking my bank to court over unfair bank charges and the court date is next week. the banks have put a freeze on paying out. will they have to pay me out if the court rules in my favour or are they allowed to freeze that aswell. [ uk courts]

No they have to pay out if the court orders them to, unless they appeal, which they probably wont as it will cost to much money, good luck with your case
I depends on what you call unfair charges such as late fees or overdraft fees. When you open an account you should have received dis closers that state what your fees are. Is this small claims court? They might not freeze your accounts, but it will reflect your credit report if not paid.
Gosh i really dont know all i have ben told is that my case is frozen ..

If you win your case try for a a 7 day order and they do not give notice of appeal, in the Bailiff it wil cost you but It may wake them up, and they will have to pay the costs
The court will probably put a stay on the claim until the court case with the FSA has been heard. I did post this to another question on bank charges as I have just found out that there has been an agreed clause between the FSA, the Ombudsman and about 6 banks that the clause is hardship as identified within the banking code. I contacted my bank today and asked what the criteria was and they did not know I can only assume that the complainant must prove hardship financially. If this is proven then the bank MUST progress the complaint and not wait for the court outcome. Mention this to your solicitor because the main court case could take up to a year...
