In Florida, why is it illegal for an 18 year old guy to have sex with his 17 year old girlfriend?
Both were High School seniors at the time, and near graduation. He's accused of rape even though it was consenual.

Because the law says that she isn't old enough to give consent. This isn't a secret, he thought he could get away with it and she did too. He is supposed to have a little more sense and keep it in his pants for a few more months.
A line has to be drawn somewhere, and it Florida its not until shes 18. Its like getting arrested for doing 66, yes its speeding, but not by much. But, its still speeding.
Because she was under age. No matter what the conditions are if one of them over 18 and the other is below 18 then it is considered statutory rape.

Because it is the law! Do I think he should go to jail or be labeled a sex offender? No. Do I think he needs to keep it in his pants until she's 18 and it's not ILLEGAL - yes. The point of the law is to protect minors. Sometimes people like this kid get burned but I'm glad the law exists so creepy, sick perverts don't get away with real sex offenses. He was 18, he knew (or should have if he's 18 and not mentally handicapped in any way) the law but took the risk.

It is likely an accusation of statutory rape. If the age of consent is 18 or above, her "consent" is meaningless under the law.
The age of concent in Florida is 16 to 23. So Its not.
