Driving on a revoked license in Michigan?
If my friend with a revoked (not suspended, but revoked) drivers license, drives my car that is titled, registered and insured in my name, and he gets caught, what are the ramifications against me?
He had many drunk driving charges and his license was revoked in 1995 - he has fulfilled all obligations: jail time, fines & fees, counseling, AA, etc., stayed sober, and reapplied for his license in 2005, and was denied.
ANYWAY... I just wanted to know what could happen to ME if he is caught driving my car - even if I didn't know he was driving it.
Also, what would most likely happen to him for driving on a revoked license?
Answers:
If you allow unlicensed drivers to drive your car, your insurance company would deny any claim in the event of an accident. It's possible also that if you allow him to drive your car, you could be held liable for any injuries caused if he had an accident. As far as what would happen IF he's caught driving- Darn little. Michigan doesn't bother enforcing our laws, so butt heads do as they please. One final point. Why bother lying? You say he's fulfilled the obligations he agreed to concerning driving. Well, one of those conditions he agreed to was to NOT drive until he gets a legal license. Obviously, you are aware he IS driving. That ain't fulfilling obligations.
If your caught your in BIG trouble!!
I don't know about MI, but in WI, you can be fined and loose you car if you let him drive it knowing he is without a license. Don't do it. Your insurance will increase, you will get a fine, could loose your license, and maybe even be jailed if he hurts someone. You are responsible for who is driving your vehicle unless it is stolen. If you don't know he is driving it, are you willing to press charges for a stolen car? Think about it.
As far as he is concerned, he probably will go to jail (again) and get a lot more fines. He also will never get his license if he keeps driving.
You should consult an attorney in your area for the most up to date accurate information. Depending on state law you may be liable for his actions since you are the registered owner and you know his license is revoked.
As for your friend, he will more than likely have to go to jail. In some states you can spend a year in jail for driving on a suspended license, I would surmise that the penalty is higher if it's revoked; it may even be a felony and could be prison time. But check with a lawyer in your area.
you're putting yourself on the tippy end of a very long limb
and your "friend" is happily sawing away. When he's driving
your car, you're responsible and without insurance. Quit
letting him behind the steerage NOW !
revoked licenses can , and usually do mean some jail, depending
on the judge. revoked can be turned into permanent revokation.
