Is an agreement without initials on pages with material terms Vaild for those terms?-Follow up?
Follow up to my previous question which is marked as under..
Can I dispute the terms if the can not produce page initialled by me?
Original question..
<<I had a commitment agreement with my employer. It was a two page printed agreement produced by them. Some terms on the first page are material and are against me, but do not bear initials on that pages by me. I suspect that the page has been replaced (I can not prove). Are those terms valid or disputable? >>
Answers:
The terms are valid UNTIL you dispute them. That page should have been initialed. You problem is proof. You say you can't prove it. Are you sure? Your testimony is proof if you go to court, so if you can testify the 1st page has been changed, you CAN prove it.
Only if you can produce your copy with his and your initials. Otherwise how will you prove that the page has been changed.
that depends. Did you initial on all the other pages? If you did, MAYBE. However, what it really comes down to is your signature on the last page. (Please note that ANYTHING you write or stamp on the page IS A SIGNATURE.)
