This is a legal question how long do i have to wait before i can sell a customers property for nonpayment?

i have two antique dining tables that i have restored for a customer the tables are done and the customer is now out of town on vacation and is avoiding all of my calls and not replying to messages i have left on his voice mail.
he owes me $ 950.00 and the tables are a combined worth of $8,500.00 aproximately what do i have to do to resolve this please help

I think you have to send a certified letter indicating that you are intending to sell the tables. Make sure you have a signature on the receipt. they can claim that you stole the tables.

I had the similar situation fixing computers.

This is what I was told to do by my attorney:

1. Send out 2 letters by Certified Mail RRR .. first one with demand for payment and notice that payment is due in 30 days (or whatever your posted terms are). and nonpayment within 7 days of original completion date will incur interest charges like 2-2.5% per month plus a storage fee of $X per month.

2. Second Certified letter after 60 days saying you can no longer afford to keep or store the said tables and will with 30 days put the tables on auction.

3. Keep records of all time and date of all phone calls.

4. Then you can sell it and pay them their share by sending them a letter to pick up the payment of leftover money.

5. Charge them for all telephone calls, mailings, auction expenses. I would even put a notice in the local paper.

6. Bill them for storage (or store in in a self storage, if you have no space) and charge them time and labor for moving the tables and any truck rental.

Then if they sue you, you can always prove that you went beyond normal means to get paid and return the customers goods.

Good heavens, have the decency to wait until the customer returns from vacation!! Most people who are out of town on vacation do not call home to check their voice mail. Take a chill pill and stop harassing the poor guy.

Sue him in small claims court.
send a registered letter giving him 30 days, and then sell them after that.
have you given a slip on what the rules are? usually, it is about a month, then if no show, sell them.

Then, depending how your luck runs, after you get rid of them, the owner will show up and raise hell
