What would happen according to the texas laws if a 19 yr old had sex with a 17 yr old?

she will be 18 in a couple of months and he would be 20 a couple of days before she turns 18

Realistically, you could be in a world of trouble; but the government has too many other things to worry about. If her parents do not like you; they can press charges and then you are doomed.
