A friend of mine hired a lawyer to handle something in Virginia for her. We're in Utah.?

She paid him $1000 and then called him back about 2 months later. He basically told her that there was nothing he could do. It doesn't seem to me like he did anything. What can she do? I also told her to get him to send some kind of receipt that shows how many hours he worked on her case and what was done. What would that be called in legal terms?

Your friend is entitled to an itemized bill if she requests one. The state of Virginia has a special set of instructions in a fee dispute.

I would start there and work your way up.

Not being able to do anything may not mean that she owes nothing. She may have misinformed him of the facts of the case (often unintentionally) or he may have had to research the situation.

As far as I know, there are two types of retainers -- those that are refundable and those that are not. If her retainer is refundable (she should look at the fee agreement she has with her attorney) then she should likely get some of it back with a detailed accounting. The attorneys are required to keep these funds in a different account until they are earned (every state has laws regarding co-mingling of client funds with firm funds.)

However, if the retainer was non-refundable then it was earned as soon as the attorney did some work.

Either way, look into the mediation if you can't get a reasonable response from the attorneys office.

ok she can also ask hikm to get her reports showing what he tried to do for her case...i mean that would tell her if he did work on her case or not
and i don't know what would that be called in legal terms ...but that's bribery for sure ...that he takes the money and pretends that he worked then tell her there was nothing he could do ...ok there is always something he can do

and if she asks him to get her some kind of receipt that shows how many hours he worked on her case he might just creat it ...but he should get her a report of what was done and everything
