What is the term means that "because you are too nervous, you shoot someone who is innocent"?

And also, what is the term means that "you didn't shoot someone on purpose but the gun fired by itself" ?

That may be "Executive Privilege," or Legislative Privilege;" depending on how Cheney characterizes the Vice President that week.

Guns don't fire by themselves. If you were holding the gun and it went off, it's most likely you did it by accident if you didn't mean to fire it.

It's manslaughter. Your inappropriate use of a lethal weapon caused an unlawful death. You've caused pain and suffering and you will be held accountable.
