I was Over-Paid: Now they want it back?

I'll just give you all the details. I worked for a house painting company for 4 days this summer. When I was hired they told me I would be making $7 an hour and an additional $5 an hour for a certain night we went out and introduced ourselves to the neighborhood. The way the pay system works is you make your hourly wage and then they set a budget number of hours that they figure the house will be done in. If you finish the house before then you get paid $1 for every hour you didnt work. I worked 4 days and was paid 3 days worth of hours. A glitch in the pay-system transferred those hours 4 weeks and I ended up making 4 times as much money as I should have. When I noticed the huge amount of money I figured it was because the house I had been working on was so shitty I must have gotten paid a ton for the beaten budget. I realize that willingly taking money not deserved is theft. So by law I have to pay the money back. I will finish this in extra notes.

ok they have to prove you were overpaid...and all they can do is sue you for it. If you agree to pay it back they will have to wait, it wasn't your mistake so if they want their money they ought to wait for it. or again take you to small claims and sue for it back


you cant go to jail,it their mistake, they should have been more careful,its not ur fault.u r not going to go to jail.
its fair to pay it back but you don't have to , if you want to keep your job its better to pay it back, but he can take you to small claims court , doesn't mean he will win.

why don't you tell him it is spent and to just deduct it from the next pay check
You haven't done anything wrong if you pay it back in a timely manner. I'm not sure if there is an exact rule on this, but 2 days sounds perfectly reasonable to me.
You won't go to jail, but mistake or not, you do owe them the money, and they can still sue you for it. It's better to pay them and avoid a judgment, because they would win if they took you to court. It was an honest mistake on their part and the law would be on their side.
